But I hope you look into this further. While I encourage you to adopt some language for the purpose of compliance and some level of transparency in contracting, I can see this resolution does not improve the status quo much if at all, except to codify current practice. We can all probably agree that Moorpark needs some change. A lot of people argue about what exactly needs to be changed for Moorpark to be more the kind of town we all envision but here we've identified an issue that can really make a change: who gets what contracts. Who should the City hire for professional services contracts, and how? The way the City hires, and does business is not as open as other cities. And this is one way we've limited ourselves for so many years. This is one of those important areas where a little transparency goes a long way. What I see in the resolution being proposed is a codification of the status quo. The City here would give itself the ability to NOT subject itself to bidding (on these contracts) whenever the purchasing agent (staff) decided to apply the waiver exception in item (4)(B). This doesn't do a thing to change the process that resulted in the hiring of some of the "professionals" doing substandard work for the City now. I suggest tightening up the waiver language some by requiring an exception to apply before the waiver is available. Exceptions can include: . 1. In an emergency; 2. When the services can be obtained from only one (1) source which has been reviewed and approved in writing by the City Manager; 3. When, in the judgment of the City Manager or City Council (as applicable given the monetary limitations of this chapter), compliance with the procedure is not in the best interest of the City; 4. When processed through a cooperative purchasing agreement with another public agency whose procurement process is substantially consistent with the provisions of this chapter; or 5. Contracts for City-managed professional services in an amount up to One Hundred Thousand and no/100ths ($100,000.00) Dollars if the following criteria are met: a) a third party has entered into a reimbursement agreement, approved as to form by the City Attorney, requiring reimbursement of such costs to the City, b) an applicant for development entitlements has deposited the full amount of the contract with the City, and c) the funds are to be used for development-related studies, such as an environmental impact report. That language is just an example of what other cities use. My only interest here is to improve the City. I assure you I have no plans to apply for any professional services contracts with the City of Moorpark - not in real estate, legal services or otherwise. I think it matters what process the City uses to hire out professional services contracts. Moorpark needs change, and improving this language is one way to get some of the change we need.
