MOORPARK CITY COUNCIL AGENDA REPORT TO: Honorable City Council FROM: Shaun Kroes, Program Manager DATE: 07/17/2019 Regular Meeting SUBJECT: Consider Resolution Adopting a Project List to be Funded by Senate Bill 1 (SB 1) State Transit Assistance and Authorizing the City Manager to Execute Application Documents BACKGROUND Senate Bill 1 (SB 1), the Road Repair and Accountability Act of 2017, includes funding for transit services, for which the City of Moorpark (City) is eligible. There are two formula funding sources: State Transit Assistance (STA) which has previously existed but has now been augmented with additional funds; and State of Good Repair (SGR), also an STA funding source. The City submitted a Project List to the California Department of Transportation (Caltrans) to receive SGR funding in Fiscal Year (FY) 2018/19. The City also submitted a Project List for STA funding to Caltrans, though it was not specifically required. The City receives the STA and SGR funding through the Ventura County Transportation Commission (VCTC). The 2019 SB 1 SGR Formal Draft Guidelines have been posted to the Caltrans SGR website. The State Controller’s Office (SCO) is expected to release a revised allocation estimate for FY 2019/20 in early August. Project Lists for FY 2019/20 are due to Caltrans by September 1, 2019. One new requirement for FY 2019/20 is that it appears that the City’s Project List will need to be submitted to Caltrans by VCTC instead of the City. In FY 2018/19, the City Council approved Resolution No. 2018-3734, designating that the FY 2018/19 SGR and STA allocations be spent on improvements to the Moorpark Metrolink Station and authorized the City Manager to execute all required documents of the SGR program with Caltrans. It is staff’s understanding that the City will not need to submit new certifications or an Authorized Agent form as these documents were executed in FY 2018/19 at the City’s start of the SGR program, with the City Manager designated as the Authorized Agent. Item: 10.K. 371 Honorable City Council 07/17/2019 Regular Meeting Page 2 DISCUSSION The STA funding can be used for transit agency capital projects and operations. Operational expenditures would be subject to farebox requirements. The SGR funding (also from STA) is specifically for eligible transit maintenance, rehabilitation and capital projects. Staff is proposing that the FY 2019/20 STA and SGR funding again be used to fund work at the Metrolink Station, including the North and South Parking Lots. Use of the funds for these purposes provides necessary maintenance/rehabilitation funding and avoids farebox ratio requirements that would be applicable to transit operation services. Moorpark’s current estimated allocation for FY 2019/20 is $3,715 for SGR funding and $26,667 for STA funding. Moorpark’s allocation is based on reported “transit revenue (non-Federal and State)” reported on the prior (from two fiscal years ago) State Controller Reports (SCR). As previously mentioned, this year’s requirement is that the City’s Project List be submitted by VCTC instead of by the City. A new Resolution (attached) has been drafted approving the FY 2019/20 Project List and also now recognizing that the Project List will be submitted by VCTC. The Resolution, as drafted, includes a section authorizing the City Manager to execute all required documents of the SGR program with Caltrans as well as VCTC. The City will also have to submit a separate claim to VCTC to receive the SGR and STA funding, similar to last year. FISCAL IMPACT There is no fiscal impact with the approval of the Project List. The FY 2019/20 budget includes $26,700 in State Transit Assistance Fund (2413), with $3,700 designated as SB-1 SGR Allocation and $23,000 designated as STA-Transit Allocation. The FY 2019/20 SGR funding is proposed to be spent on the Metrolink North Parking Lot Expansion Project (C0032) and the STA funding is proposed to be spent on the Metrolink South Parking Lot South Entry Project (C0029). The SGR and STA funding numbers are still estimates and subject to change. STAFF RECOMMENDATION Adopt Resolution No. 2019-____, and authorize the City Manager to submit the Project List to the Ventura County Transportation Commission or California Department of Transportation prior to September 1, 2019. Attachment: Draft Resolution 372 ATTACHMENT RESOLUTION NO. 2019-____ A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF MOORPARK, CALIFORNIA, AUTHORIZING THE EXECUTION OF THE CERTIFICATIONS AND ASSURANCES FOR THE CALIFORNIA STATE OF GOOD REPAIR PROGRAM AND ADOPTING A PROJECT LIST TO BE FUNDED BY THE STATE OF GOOD REPAIR (SGR) AND STATE TRANSIT ASSISTANCE (STA) ALLOCATIONS FOR FISCAL YEAR 2019/20 WHEREAS, the City of Moorpark is an eligible project sponsor and may receive State Transit Assistance funding from the State of Good Repair Account (SGR) now or sometime in the future for transit projects; and WHEREAS, the statutes related to state-funded transit projects require a local or regional implementing agency to abide by various regulations; and WHEREAS, Senate Bill 1 (2017) named the Department of Transportation (Department) as the administrative agency for the SGR; and WHEREAS, the Department has developed guidelines for the purpose of administering and distributing SGR funds to eligible project sponsors (local agencies); and WHEREAS, the City of Moorpark wishes to delegate authorization to execute these documents and any amendments thereto to the City Manager; and WHEREAS, it is the desire of the City of Moorpark to designate $3,715 of FY 2019/20 SGR funds and $26,667 of FY 2019/20 State Transit Assistance (STA) funds available to Moorpark Metrolink Station Improvements projects. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF MOORPARK DOES HEREBY RESOLVE AS FOLLOWS: SECTION 1. That the fund recipient agrees to comply with all conditions and requirements set forth in the Certification and Assurances document and applicable statutes, regulations and guidelines for all SGR funded transit projects. SECTION 2. That the City Manager be authorized to execute all required documents of the SGR program and any Amendments thereto with the California Department of Transportation and/or the Ventura County Transportation Commission as necessary. SECTION 3. That the following project is planned to be funded with FY 2019/20 SGR and STA revenues: Description & Location: Moorpark Metrolink Station Improvements. Various improvements at the Metrolink Station located in Moorpark, including 373 Resolution No. 2019-____ Page 2 improvements along the Station and/or the North and/or South Parking Lots, consistent with SGR Guidelines. Estimated useful life: 20 years Anticipated year of construction: 2019 SECTION 4. That the City Clerk is directed to transmit a copy of this resolution to the Ventura County Transportation Commission. SECTION 5. That the City Clerk shall certify to the adoption of the resolution and shall cause a certified resolution to be filed in the book of original resolutions.
