SUBJECT: Consider Rejection of Claim: M. Anne Dickson
BACKGROUND
On September 9, 2003, the City received the above referenced claim
for an injury and property damage sustained on a City street. The
claim was forwarded to the City's claims adjuster for review.
DISCUSSION
The claim was submitted for an injury and property damage that
occurred on July 1, 2003. The claim generally describes a trip and
fall type incident on Buttercreek Road, due to materials left on the
sidewalk in the vicinity of the storm drain. Ruiz Engineering, the
2003 Overlay Project contractor, was performing street overlay
related work in the area on July 1. Staff's understanding is that
the City's claims adjuster has tendered the claim to Ruiz Engineering
for their investigation and handling.
The City's claim adjuster has recommended that a standard rejection
letter be sent to the claimant.
STAFF RECOMMENDATION
Reject the claim and direct staff to send a standard rejection letter
to the claimant.
