SUBJECT: Consider Ten -Year Extension of the City's Tree
Maintenance Agreement with West Coast Arborist
SUMMARY
The City Council is being asked to approve a ten -year extension
to the City's Tree Maintenance Agreement with West Coast
Arborist (WCA) . The existing Agreement is set to expire on June
30, 2004. WCA approached the City with a request to extend the
existing agreement for a ten -year term. All other provisions in
the agreement would remain the same. If approved, the Agreement
with WCA would be extended through June 30, 2014, with no cost
increase.
DISCUSSION
A ten -year extension would lock in tree maintenance services
(trimmings and removals) at existing prices, which are very
competitive. The current Agreement includes a provision which
allows either party to terminate the Agreement upon 30 -days
written notice, with or without cause. Should the City wish, at
anytime in the future, it can solicit tree maintenance cost
proposals and select a new contractor. There appears to be no
risk to the City for extending the agreement's term. The benefit
is maintaining the low, competitive prices we now have.
To date, WCA's performance has been good. They have responded
quickly and courteously to staff and resident inquires and
requests for corrections. As required by the Agreement, they
previously prepared a City -wide tree inventory of all City
maintained trees. The data is kept current by both WCA and City

staff on a monthly basis. WCA has several certified arborists on
staff and they have willingly assisted the City with tree
evaluations at no cost.
STAFF RECOMMENDATION
Authorize the City Manager to sign the attached amendment,
extending the City's tree maintenance agreement with West Coast
Arborist through June 30, 2014, with all other provisions
remaining the same.

AMENDMENT NO. 2
TO AGREEMENT FOR TREE MAINTENANCE SERVICE
THIS AMENDMENT TO AGREEMENT, made and entered into this 1 st day of July,
2004, by and between the City of Moorpark, a municipal corporation located in the County of
Ventura, State of California, hereinafter referred to as "Agency" and West Coast Arborist, Inc., a
private corporation, hereinafter referred to as "Contractor ".
WITNESSETH
Whereas, on July 31, 2000, the City and Contractor entered into an Agreement pertaining
to tree maintenance services; and
Whereas, on July 1, 2001, the City and Contractor entered into Amendment No. 1,
providing for a cost of living increase and a one year extension, and allowing a provision for
additional three (3) one -year extensions with no cost increases; and
Whereas, on June 5, 2002, the City and Contractor agreed to a one (1) year extension with
no cost increase; and
Whereas, on June 4, 2003, the City and Contractor agreed to a one (1) year extension with
no cost increase; and
Whereas, the City and Contractor have discussed and agreed to a ten (10) year extension,
at existing rates, and now wish to document said Agreement by jointly approving Amendment
No. 2 to the July 31, 2000, Agreement.
NOW, THEREFORE, in consideration of the mutual convents, benefits and premises
herein stated, that parties hereto agree and amend the aforesaid Agreement as follows:
I. Term
The Term of said Agreement shall be amended to extend to ten (10) years, through June
30, 2014.
II. Remaining Provisions
All other provisions of the aforesaid Agreement (Attachment A) shall remain in full force
and effect.
