September 17, 2003 A Special Meeting of the City Council of the City of Moorpark was held on September 17, 2003, in the Community Center of said City located at 799 Moorpark Avenue, Moorpark, California. 1. CALL TO ORDER: Mayor Hunter called the meeting to order at 6:47 p.m. 2. ROLL CALL: Present: Councilmembers, Harper, Mikos, Parvin, and Mayor Hunter. Absent: Councilmember Millhouse (arrived at 6:55 P.M.) Staff Present: Steven Kueny, City Manager; Joseph Montes (arrived at 6:52 p.m. via conference call) ; Mary Lindley, Community Services Director; Barry Hogan, Community Development Director; and Deborah Traffenstedt, Assistant to City Manager /City Clerk. 3. PUBLIC COMMENT: 4. PRESENTATION /ACTION /DISCUSSION: A. Consider Clarification of the Street Standards for Tentative Tract 5307 in Order to Meet the Requirements of the Americans with Disabilities Act (ADA) Relative to Access for the Development Located at the Northeast Corner of Los Angeles Avenue and Flory Avenue on the Application of Colmer Construction. Staff Recommendation: Provide direction to staff to approve the use of concrete rolled curbs as the standard for street improvements for Tract 5307. Mr. Hogan gave the staff report. 000017 Minutes of the City Council Moorpark, California Page 2 September 17, 2003 MOTION: Councilmember Harper moved and Councilmember Parvin seconded a motion to approve the use of concrete rolled curbs as the standard for street improvements for Tract 5307. The motion carried by voice vote 4 -0, Councilmember Millhouse absent. 5. CLOSED SESSION: Mr. Kueny announced that the City Council would be going into closed session for discussion of Item S.B. (two cases) and Item 5.C. MOTION: Councilmember Harper moved and Councilmember Mikos seconded a motion to adjourn to closed session for a discussion of Item 5.B. (two cases) and Item 5.C. The motion carried by unanimous voice vote. The time was 6:52 p.m. B. CONFERENCE WITH LEGAL COUNSEL - ANTICIPATED LITIGATION Initiation of litigation pursuant to Subdivision (c) of Section 54956.9 of the Government Code: (Number of cases to be discussed - 4) C. CONFERENCE WITH REAL PROPERTY NEGOTIATOR (Pursuant to Government Code Section 54956.8) Property: APN 511 -0- 090 -340, Moorpark, CA 93021 Agency Negotiator: Steven Kueny, City Manager Negotiation Parties: The City of Moorpark and the Margaret Irene Gisler Cullen Trust Under Negotiation: Price and terms of payment Present in closed session were Councilmembers Harper, Mikos, Millhouse (arrived at 6:55 p.m.), Parvin, and Mayor Hunter; Steven Kueny, City Manager; Joseph Montes, City Attorney; Barry Hogan, Community Development Director; and Deborah Traffenstedt, Assistant to City Manager /City Clerk. The Council reconvened into open session at 7:12 p.m. Mr. Kueny stated that two cases under Item S.B. and Item 5.0 were discussed. He announced that for the first case under Item 5.B., the Council had approved an amendment to a previously approved Settlement Agreement between the City and Asadurian Investments Corporation and Manuel Asadurian, Jr., to correct an error and provide for a new deed of trust for the purpose of securing a promissory note. He also announced that there was no action to report for the second case discussed under Item 5.B. and for Item 5.C. 111 � Minutes of the City Council Moorpark, California Page 3 September 17, 2003 6.
