SUBJECT: Consider Adoption of Resolutions Approving Future
Applications for Safe Neighborhood Parks, Clean Water,
Clean Air, and Coastal Protection Bond Act of 2002
Funds.
BACKGROUND
The Safe Neighborhood Parks, Clean Water, Clean Air, and Coastal
Protection Bond Act of 2002 (Proposition 40) received approval
by California voters. Like its predecessor Proposition 12,
Proposition 40 has a number of provisions that provide funding
to local governments to develop, improve, and maintain parks.
Of significance to Moorpark is the Robert i- Z'Berg- Harris Urban
Open Space and Recreation Grant and the Per - Capita Grant Funds.
Combined, these two Proposition 40 funding sources will provide
the City of Moorpark with $306,621 in park improvement funds.
1. Roberti- Z'Berg- Harris Grant: $220,000
2. Per Capita Grant: $86,621
Important facts about the grant funds include:
• Grantees must have fully executed contracts for their
Per - Capita and Roberti- Z'Berg- Harris Grant projects by
June 30, 2006. All approved projects must be completed by
June 30, 2011, or the funds will revert to the
Legislature.
• Per Capita grants are for capital outlay only, including
property acquisition and development. Grantees may spend

up to 250 of the funds for non - construction costs,
including grant administration, plans, and permits.
• The Per Capita Grants do not require a match, whereas the
Roberti- Z'Berg- Harris Grant requires a 30% match.
Prior to applying for the per capita grant funds identified
above, the City must adopt the attached resolutions (Attachments
A and B respectively) addressing both the Roberti- Z'Berg- Harris
Grant and the Per - Capita Grant. The Resolutions state that the
City approves future filings for grant funds, certifies that the
City will have sufficient funds to operate and maintain the
improvements it constructs using grant funds, indicates that the
City understands the grant procedures, and appoints the City
Manager as the designated position to conduct all negotiations
and execute and sign all documents. Once the adopted Resolutions
are filed with the state, the City will receive a contract for
the funds. Upon execution of the contract, the City's funds will
be encumbered and Moorpark will have up to June 30, 2011, to
complete its projects.
Staff will return to the Council at a future date to discuss the
use of the funds for park improvement projects including the
proposed purchase of Gilser Cullen Trust property on Poindexter
Avenue to expand Poindexter Park.
STAFF RECObMNDATION
Adopt the attached resolutions approving future Proposition 40
(Safe Neighborhood Parks, Clean Water, Clean Air, and Coastal
Protection Bond Act of 2002) grant applications (Robert i-Z'Berg-
Harris Funds and Per Capita Grant Funds).

RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
MOORPARK, CALIFORNIA, APPROVING THE APPLICANT
TO APPLY FOR GRANT FUNDS FOR THE ROBERTI-
Z'BERG- HARRIS BLOCK GRANT PROGRAM UNDER THE
CALIFORNIA CLEAN WATER, CLEAN AIR, SAFE
NEIGHBORHOOD PARKS, AND COASTAL PROTECTION
BOND ACT OF 2002.
WHEREAS, the people of the State of California have enacted
the California Clean Water, Clean Air, Safe Neighborhood Parks,
and Coastal Protection Act of 2002, which provides funds for the
Roberti - Z'Berg- Harris Block Grant Program for grants to eligible
Applicants; and
WHEREAS, the California Department of Parks and Recreation
has been delegated the responsibility for the administration of
the program, within the state, setting up necessary procedures;
and
WHEREAS, said procedures established by the California
Department of Parks and Recreation require the Applicant's
Governing Body to certify by resolution the approval of the
Applicant to apply for the Roberti- Z'Berg- Harris allocation; and
WHEREAS, the Applicant will enter into a Contract with the
State of California for the project(s).
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF MOORPARK,
DOES HEREBY RESOLVE AS FOLLOWS:
SECTION 1. Approves the filing of an Application for
local assistance funds from the Roberti- Z'Berg- Harris Block
Grant Program under the California Clean Water, Clean Air, Safe
Neighborhood Parks, and Coastal Protection Act of 2002; and
SECTION 2. Certifies that the Applicant has or will
have sufficient funds to operate and maintain the project(s);
and
SECTION 3. Certifies that the Applicant has reviewed,
understands, and agrees to the General Provisions

contained in the Contract shown in the Procedural Guide; and
SECTION 4. Certifies that the project(s) conforms to
the recreation element of any applicable City or county general
plan; and
SECTION 5. Appoints the City Manager as agent to
conduct all negotiations, execute and submit all documents
including, but not limited to, Applications, agreements, payment
requests and so on, which may be necessary for the completion of
project(s).
SECTION 6. The City Clerk shall certify to the adoption
of the resolution and shall cause a certified resolution to be
filed in the book of original Resolutions.

acquisition and development of neighborhood, community, and
regional parks and recreation lands and facilities; and
WHEREAS, the California Department of Parks and Recreation
has been delegated the responsibility for the administration of
the grant program, setting up necessary procedures; and
WHEREAS, said procedures established by the California
Department of Parks and Recreation require the Applicant's
Governing Body to certify by resolution the approval of the
Applicant to apply for the Per Capita Allocation; and
WHEREAS, the Applicant will enter into a Contract with the
State of California.
