Chudoba, Senior Management Analyst K G November 12, 2003 (CC Meeting of 11/19/03) SUBJECT: Consider Continuation of Local Emergency BACKGROUND On October 26, 2003, the Director of Emergency Services (City Manager) proclaimed the existence of a Local Emergency due to the "Simi Fire" (Resolution 2003 - 2136). On October 31, 2003, the City Council ratified this proclamation (Resolution 2003 - 2137). Government Code Section 8630 requires the City Council to review the need to continue this proclamation at least every 21 days until the Local Emergency is terminated. The proclamation of a Local Emergency authorizes the undertaking of extraordinary police powers, provides limited immunity for emergency actions of public employees and governing bodies, authorizes the issuance of orders and regulations to protect life and property, and activates pre - established Local Emergency provisions such as special purchasing and contracting. DISCUSSION According to the Ventura County Fire Protection District, the "Simi Fire" burned about 3,044 acres in Moorpark. Staff estimates that six residences were destroyed, seven residences were damaged, and outbuildings on eight other properties suffered structural damage. The blaze was fully contained on November 1, 2003. Staff is compiling additional information in anticipation of disaster relief funding and related assistance for affected property owners. At this time, staff recommends that the City Council continue the proclamation of a Local Emergency to finalize damage assessment and evaluate post -fire impacts.
