SUBJECT: Consider the Establishment of an Ad -Hoc Committee to
Develop a Draft Development Agreement Between Shea
Homes, Inc. and the City of Moorpark for a General
Plan Amendment, Zone Change, Vesting Tentative Map and
Residential Planned Development
BACKGROUND /DISCUSSION
Shea Homes, Inc. has submitted applications to allow
construction of ninety -five (95) duplex condominium units on
13.95 acres located at the terminus of Fremont Street, south of
Los Angeles Avenue (Highway 118) and east of Majestic Court. The
application consists of a Residential Planned Development (RPD),
a Vesting Tentative Tract Map to subdivide five (5) parcels into
one (1) lot for condominium purposes, a General Plan Amendment
(from Residential Medium Density and General Commercial to
Residential Very High Density and Floodway), and a Zone Change
(from R -1 and CPD to Residential Planned Development [RPD] and
Open Space [OS]). This project is proposed to be built together
with, and as an extension of Tract No. 5133 /Residential Planned
Development No. 98 -01. The application consists of a General
Plan Amendment No. 2003 -02, Zone Change No. 2003 -02, Vesting
Tentative Tract Map No. 5425, and Residential Planned
Development No. 2003 -02. A Development Agreement is also
proposed.
The majority of the site is currently zoned Commercial Planned
Development (CPD). A small portion on the west, adjacent to the
Fremont Tract, is zoned Single Family Residential (R -1) . The
applicant is requesting an ultimate density of twelve (12) units
per acre. In 2001, the City Council authorized submittal of a

General Plan Amendment and Zone Change under a previous
application by L.T. Development. Shea Homes, Inc. subsequently
purchased the properties and submitted the proper applications.
Government Code Section 65864 and City of Moorpark Municipal
Code Section 15.40 provide for Development Agreements between
the City and property owners in connection with proposed plans
of development for specific properties. Development Agreements
are designed to strengthen the planning process, to provide
developers some certainty in the development process and to
assure development in accordance with the terms and conditions
of the agreement.
As with past projects involving changes in land use and
Development Agreements, it is recommended that an Ad -Hoc
Committee be appointed to negotiate a Development Agreement for
the proposed project.
STAFF RECOMMENDATION
Appoint two (2) Councilmembers to an Ad -Hoc Committee to develop
a draft Development Agreement between Shea Homes, Inc. and the
City of Moorpark.
