SUBJECT: Consider the Removal of General Plan Amendment No.
2003 -02, Zone Change No. 2003 -02, Residential Planned
Development No. 2003 -02 and Vesting Tentative Tract
Map No. 5425 on Application of Shea Homes, Inc. from
the Application Completeness Requirements of the
Commercial Demand Study
BACKGROUND /DISCUSSION
At the last City Council meeting, staff was directed to set
reconsideration of whether Shea Home's application processing
for a General Plan Amendment, Zone Change and Residential
Planned Development should continue to be held pending
completion of a comprehensive Commercial Demand Study. Shea
Homes, Inc. has submitted applications to allow construction of
ninety -five (95) duplex condominium units on 13.95 acres. The
applications consist of a General Plan Amendment, Zone Change,
Vesting Tentative Tract Map and Residential Planned Development.
The applicant has also requested a Development Agreement with
the City for this project. This property is currently,
predominantly zoned, for commercial use. Shea Homes, Inc. has
contributed to the preparation of the Commercial Demand Study.
On January 15, 2003, the Affordable Housing /Community
Development Committee (Mayor Hunter and Councilmember Mikos)
recommended to the City Council that a Commercial Demand Study
be prepared for the four (4) acre site (Grand Moorpark), located
on the North side of Los Angeles Avenue, west of Mission Bell
Plaza, as well as, the Shea Homes site. The City Council
concurred with this recommendation. The City Council had
previously authorized the former purchaser of the Shea Homes

site to submit a General Plan Amendment and Zone Change
application without the need for a Commercial Demand Study.
Shea Homes agreed to participate in the Commercial Demand Study,
however, due to delays in receiving funds and the need to re-
scope the study, preparation of the Commercial Demand Study was
delayed.
The Shea Homes applications are ready to proceed to the Planning
Commission and on to the City Council, pending either completion
of the Commercial Demand Study or release, by the City Council,
of Shea Homes' obligation to have the study completed prior to
any city action on its applications. In either event, the
applicant would not go the Planning Commission until the
proposed Ad Hoc Committee meets with the applicant concerning a
Development Agreement and related development items.
