Diaz, Captain DATE: November 25, 2003 (CC Meeting of 12/3/03) /a -3 -OW3 ,,W A#-ed 9077/W-� SUBJECT: Consider Adoption of a Resolution Amending the Fiscal Year 2003/04 Budget to Appropriate $10,000 from the General Fund Reserve for Payment of the Megan Barroso Reward and Authorize the Payment of the Reward SUMMARY The purpose of this report is to request an appropriation from the General Fund Reserve of $10,000 for the reward related to the provision of critical information that led to the arrest and conviction of Vincent Sanchez in the murder of Moorpark College student and resident Megan Barroso. BACKGROUND The murder of nineteen year old Moorpark College student and Moorpark resident Megan Barroso tragically occurred in the early morning hours of July 5, 2001, near State Route 23 and New Los Angeles Avenue. On July 18, 2001, the Moorpark City Council committed ten thousand dollars ($10,000) to a reward fund, which was to be consistent with the same terms of the Ventura County Sheriff's Department reward. The intent was that the City's $10,000 reward would be in addition to the $15,000 reward fund initiated by the County of Ventura, to assist in obtaining information in the arrest and conviction of Megan's killer. The Council's reward appropriation subsequently lapsed, and requires re- appropriation. As we are all now aware, Simi Valley resident Vincent Sanchez has been arrested and convicted partly because of information and evidence provided by the two prior roommates of Vincent Sanchez. Both witnesses testified for the prosecution and their testimony was critical to Vincent Sanchez's conviction and subsequent death penalty sentencing. 000121 0121 Honorable City Council December 3, 2003 Regular Meeting Page 2 DISSCUSSION Since there is not a centralized reward fund, the County Sheriff's Department will be determining their reward payment separate from the City of Moorpark. Staff recommends that payment from the City's reward fund to the two witnesses should follow the County of Ventura's reward payment action, so as to be consistent with the same percent allocation used by the County. STAFF RECOMONDATION (ROLL CALL VOTE REQUIRED) 1. Approve the appropriation of $10,000 from the General Fund Reserve, and adopt Resolution No. 2003- amending the FY 2003/04 budget. 2. Direct staff to make a payment to two witnesses, following the County of Ventura reward payment action, using the same percent allocation formula for reward payment. 000122 RESOLUTION NO. 2003- RESOLUTION OF THE CITY COUNCIL OF THE CITY OF MOORPARK, CALIFORNIA, AMENDING THE FISCAL YEAR 2003/04 BUDGET TO APPROPRIATE $10,000 TO THE MEGAN BAROSSA REWARD FUND BY TRANSFERRING FUNDS FROM THE GENERAL FUND RESERVE BALANCE (1000) TO THE CITY COUNCIL COMMUNITY PROMOTION EXPENDITURE BUDGET (1000.1100.9240) WHEREAS, on June 18, 2003, the City Council adopted the FY 2003/04 Budget; and WHEREAS, on July 18, 2001, the City Council approved the establishment of a $10,000 reward fund to assist in obtaining information in the arrest and conviction of the Megan Barroso killer, and the reward fund appropriation subsequently lapsed; and WHEREAS, on December 3, 2003, staff presented the Council with a report which requests the appropriation of $10,000 from the General Fund Reserve balance to the City Council Community Promotion expenditure budget for the Megan Barroso Reward Fund; and WHEREAS, Exhibit "A ", hereof, describes said budget amendment and its resultant impacts to the budget line items. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF MOORPARK DOES HEREBY RESOLVE AS FOLLOWS: SECTION 1. A budget amendment to appropriate $10,000 from the General Fund Reserve Balance to the City Council Community Promotion expenditure budget, as more particularly described in Exhibit "A ", attached hereto, is hereby approved. SECTION 2. The City Clerk shall certify to the adoption of the resolution and shall cause a certified resolution to be filed in the book of original resolutions.
