Gilbert, Director of Public Works DATE: December 5, 2003 (Council Meeting 12- 17 -03) SUBJECT: Adjustment to the Hourly Rates Charged for Engineering Services. OVERVIEW This requests approval of a 2.2% increase to the rates charged by the Charles Abbott Associates for engineering services. DISCUSSION A. Background: In March of 1991 the City entered into an Agreement with Charles Abbott Associates to provide Engineering Services to the City. B. Retainer 1. Agreement: Paragraphs A & B of Section I of the Agreement provide for an automatic adjustment (not to exceed 7 %) to the retainer for Engineer and Traffic Engineering Services, to occur on December 1 of each year, based upon the change in the Consumer Price Index. 2. Last Adjustment: The last adjustment to the Retainer amounts was made in November 2002, effective December 1, 2002. 3. CPI Increase 2003: There has been a 2.2% increase in the CPI [ "U. S. Using that 2.2% inflation factor, changes to the existing amounts for the Engineering retainers are summarized as follows: Current Revised Amnt. ($) Service Amount ($) Effective 12 -1 -0]. No City Council action is necessary. C. Request for Adjustment to Hourly Rates for Services 1. Agreement: The Agreement for Engineering Services also states that the City may consider a request for a Cost -of- Living Adjustment to the hourly rates charged for Engineering Services. 2. Past Years: It has been the practice of the City Council in past years to approve the requests from Charles Abbott Associates for an adjustment to the hourly rates for engineering services, based upon the same CPI increase data used to adjust the amount of the retainers. 3. Request for Increase: Attached as (10- 21 -03) requesting an increase charged for engineering services. requested increase is 2.2% -- the automatic increase to the retainer past years, it is requested that this effective as of December 1, 2003. Attachments: Exhibit 1: Request Engfee03 000288 CAA October 21, 2003 1- F � 4 Steven Kueny, City Manager City of Moorpark 799 Moorpark Ave. Moorpark CA, 93021 Dear Steve, As outlined by provisions in our contract for Engineering Services to the City of Moorpark dated March 1, 1991 and modified on October 20, 1999, we will be increasing our retainer tees and fee rates to keep pace with Consumer Price Index (CPI). During the period of August 2002 through August 2003 the increase in the CPI for "U.S. Cities Average for All Urban Consumers" during the period increased 2.2 %. This is the index specified in our contract with the City. Our rates will be increased by 2.2% and the increase will take effect December 1, 2003. I have attached Exhibits 'A' and 'B' that show the retainer fees and hourly rates, respectively, that will take effect on December 1. 1 have also attached, as Exhibit 'C', a copy of the Bureau of Labor Statistics CPI printout of changes in the CPI. The chart covers the time period from January 1993 to September 2003. It shows the 12 months percent changes for the "Consumer Price Index - All Urban Consumers ".
