VCTC is responsible for transportation policies, projects, funding and priorities for projects that involve highways, bus services, bicycling and bike paths, aviation, commuter and freight railroads, and other transportation issues. VCTC controls the use of federal, state and local funds for transportation and related projects. It also serves as the Airport Land Use Commission, Service Authority for Freeway Emergencies, and the Congestion Management Agency. Currently, VCTC has a governing board of seven members: two county supervisors; three elected city members; and two public members. The ten cities rotate for voting membership on the commission. The county and the cities each appoint a public member. It is the objective of the commission to reorganize so that each city and the five supervisors are voting members. To accomplish this, a bill (AB 773) was adopted by the legislature but vetoed by Governor Davis. On December 5, VCTC developed revised legislation (Attachment "A ") and requested comments from the county and cities. The revision provides for alternates that may attend and vote twice each year at a VCTC meeting. Any councilmember may serve as its city alternate, and the county supervisors may appoint staff or a citizen as an alternate. There would still be two public representatives, one appointed by the cities and one by the supervisors. Attachment "A ": draft legislation Zjs ATTACHMENT "A" BILL NUMBER: BILL TEXT INTRODUCED BY An act to amend Sections 130054.1 and 130054.8 of the Public Utilities Code, relating to transportation, and declaring the urgency thereof, to take effect immediately. LEGISLATIVE COUNSEL'S DIGEST Ventura County Transportation Commission. Existing law establishes the Ventura County Transportation Commission. Existing law provides that the 8- member commission is comprised of two members from the Ventura County Board of Supervisors, 3 members appointed by the Ventura County City Selection Committee, one citizen member appointed by the Ventura County Board of Supervisors, one citizen member appointed by the Ventura County City Selection Committee, and one nonvoting member appointed by the Governor. Existing law provides for alternate commission members and specifies 4 -year terms for members. This bill would change the composition of the commission to include five members from the Ventura County Board of Supervisors, one member from each incorporated city within Ventura County who shall be a mayor or council member, one citizen member appointed by the Ventura County Board of Supervisors, one citizen member appointed by the Ventura County City Selection Committee, and one nonvoting member appointed by the Governor. The bill would delete the provisions regarding alternate commission members for citizen representatives, and the length of terms. The bill would declare that it is to take effect immediately as an urgency statute. Vote: 2/3. Appropriation: no. Fiscal committee: no. State - mandated local program: no. THE PEOPLE OF THE STATE OF CALIFORNIA DO ENACT AS FOLLOWS: SECTION 1. Section 130054.1 of the Public Utilities Code is amended to read: 130054.1. (a) The Ventura County Transportation Commission shall consist of the following members: (1) Five members of the Ventura County Board of Supervisors appointed by that board . (2) One member from each incorporated city within Ventura County who shall be a mayor or city council member. The term of any council member or mayor serving on the commission shall terminate when the member ceases holding that public office or when replaced by the city council. 000187 (3) One citizen member aopointed by the Ventura County Board of Supervisors, who shall not be an elected official, but who shall be a resident of Ventura County. (4) One citizen member appointed by the Ventura County City Selection Committee, who shall not be an elected official, but who shall be a resident of Ventura County. (5) One nonvoting member appointed by the Governor. (b) (1) A member of the Ventura County Board of Supervisors may appoint an alternate to represent and vote in place of the member for no more than two meetings per year. (2) Each incorporated city in Ventura County may appoint an alternate, who shall be a mayor or city council member, to represent and vote in place of its Commission member for no more than two meetings per year. SEC. 2. Section 130054.8 of the Public ttilities Code is amended to read: 130054.8. The Governor shall appoint a nonvoting member to each of the commissions to represent the interest of the state. SEC. 3. This act is an urgency statute necessary for the immediate preservation of the public peace, health, or safety within the meaning of Article IV of the Constitution and shall go into immediate effect. The facts constituting the necessity are: The Ventura County Transportation Commission faces a significant financial shortfall in funding from the State Highway Account resulting from the suspension of allocations for projects in the county which will have a significant impact on the Comm iss'ion's ability to meet its responsibilities to the general public to provide funding for safe and efficient transportation systems and projects. To adequately address this issue in a timely and efficient manner every city and the county must be represented on the Commission to consider and act on alternative funding strategies to meet the countywide transportation priorities and needs, and therefore it is necessary that this act take effect immediately.
