Hogan, Community Developmen Directo By: Scott Wolfe, Principal Planner DATE: January 8, 2004 (CC Meeting of 1/21/04) SUBJECT: Vesting Tentative Tract Map No. 5045 - Modification #1 BACKGROUND In 1995, Morrison - Fountainwood- Agoura submitted applications for the development of Specific Plan Area No. 2. These applications included the request for approval of the Specific Plan, as well as a General Plan Amendment, Zone Change, Vesting Tentative Tract Map, and a Development Agreement. The Specific Plan and accompanying applications were approved on September 15, 1999. In April of 2001, Pardee Homes purchased the property from Morrison - Fountainwood- Agoura. In February of 2002, Pardee Homes submitted an application for amendments to the Tentative Tract Map lot configuration and road alignments within the project. This Permit Adjustment application was submitted primarily to address concerns brought up by City staff, particularly intersection alignment and sight distance issues. This request led to a reconfiguration of the Tract, resulting in the addition of private recreational lots within the Tract, and the reduction of single- family residential lots within the Specific Plan Area from 570 to 560. Also, included within this reconfiguration was the addition of turn - around "bulbs" in the streets at the entrances to neighborhoods, which were to accommodate the placement of gates. The Permit Adjustment request was approved by the Community Development Director on December 30, 2003, with the condition that the turn - around "bulbs" would not be permitted unless the City Council subsequently approved a modification allowing the installation of gates. If a request for gates is not approved by the City Council, the entry streets S: \Community Development \DEV PMTS \R P D \2002 \03 Pardee \cc agenda report - mod.doc 0 ©0 0 0 1L Honorable City Council January 21, 2004 Page 2 would reflect a standard street section, with the additional right -of -way for the bulbs either added to the adjacent residential lots, or utilized for enhanced neighborhood entry monumentation and landscaping. In response to this condition of the Permit Adjustment, the applicant is now requesting that the City Council approve the privatizing of streets and the installation of gates at the entrances to neighborhoods within Vesting Tentative Tract Map No. 5045. DISCUSSION The gates will only restrict access to individual neighborhoods, and will not impact the main circulation system within the project, as the major streets are public and are required to remain open to allow access to public facilities. Additionally, the gates are not proposed to affect access to trails within the project. Equestrian and multipurpose trail access points are located along the major roadways which are to remain public and are not gated. The gates and private streets will be required to meet City standards with the turn - around features approved by the City Engineer. The design of the gates themselves, if approved, will be reviewed through the forthcoming Residential Planned Development Permit review process. However, they will be required to be decorative, to have failsafe mechanisms to allow for operation in the event of a power failure, and to include separate pedestrian gates to allow pedestrians ingress and egress. The installation of the gates and the privatizing of the streets within the neighborhoods of this project are not anticipated to result in adverse impacts. No additional environmental documentation beyond that prepared for Specific Plan No. 1995 -02 and Vesting Tentative Tract Map No. 5045 is necessary for this proposed modification. The benefit to the City will be the reduction of street maintenance costs required within the project. The issue of whether or not gates are appropriate in this project is a matter of policy which is appropriately decided by the City Council. 0 0000ti Honorable City Council January 21, 2004 Page 3 RECOMMNDATION 1. Open the public hearing, accept public testimony, and close the public hearing. 2. Adopt Resolution No. 2004- approving Modification No. 1 to Vesting Tentative Tract Map No. 5045. 000003 RESOLUTION NO. 2004 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF MOORPARK, CALIFORNIA, APPROVING MODIFICATION NO. 1 TO VESTING TENTATIVE TRACT MAP NO. 5045 TO ALLOW THE GATING OF RESIDENTIAL STREETS WHEREAS, at a duly noticed Public Hearing on January 21, 2004, the City Council considered Modification No. 1 to Vesting Tentative Tract Map (VTTM) No. 5045 to allow the gating of residential streets; and WHEREAS, at its meeting of January 21, 2004, the City Council conducted a public hearing, and after receiving public testimony closed the public hearing; and WHEREAS, the City Council concurs with the Community Development Director's determination that this proposed modification will not result in any adverse environmental impacts and that no additional environmental review is necessary to supplement the environmental review record prepared for Specific Plan No. 1995 -02 and Vesting Tentative Tract Map No. 5045; and WHEREAS, on January 21, 2004, the City Council, after review and consideration of the agenda report and any supplements thereto, written public comments and testimony received at the public hearing, has reached a decision on this matter. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF MOORPARK DOES HEREBY RESOLVE AS FOLLOWS: SECTION 1. MODIFICATION FINDINGS: A. The request is consistent with the intent and provisions of the City's General Plan, Specific Plan No. 1995 -02, and Title 17 of the Moorpark Municipal Code in that the proposed gating does not involve a change in land use from that approved under Specific Plan No. 1995 -02. B. The request is compatible with the character of surrounding development because gating does not affect the residential character of the development, and will result in a condition similar to Tentative Tract 5130 (Vistas at Moorpark) to the west. 000004 Resolution No. 2004 - Page 2 C. The proposal would not be obnoxious or harmful or impair the utility of neighboring property or uses because the proposed gates would only restrict access to the residential streets of the Specific Plan, while public facilities within the project area will remain available and open to public use. D. The proposal would not be detrimental to the public interest, health, safety, convenience or welfare, because the proposed gates will be required to be functional even in the event of a power outage and because the applicant will be required to place the gates to the satisfaction of public safety agencies. SECTION 2. CITY COUNCIL APPROVAL: The City Council hereby approves Minor Modification No. 1 to Vesting Tentative Tract Map No. 5045 to allow the gating of residential streets within the Vesting Tentative Tract Map boundaries, subject to conditions of approval attached as Exhibit A. SECTION 3. CERTIFICATION OF ADOPTION: The City Clerk shall certify to the adoption of this resolution and shall cause a certified resolution to be filed in the book of original resolutions. Traffenstedt, City Clerk 000005 Resolution No. 2004 - Page 3 EXHIBIT A CONDITIONS OF APPROVAL FOR VESTING TENTATIVE TRACT MAP 5045, MODIFICATION NO. 1 1. All prior conditions of Vesting Tentative Tract Map No. 5045 shall continue to apply, except as amended herein. 2. All access gates shall be constructed to the satisfaction of the Community Development Director, City Engineer, Fire Protection District and the Moorpark Police Department, so as to allow the opening of the gates to allow for emergency ingress or egress in the event of a power failure. Separate pedestrian access shall also be provided within the gates, with the design subject to the review and approval of the Community Development Director. 3. The Final Map shall show all streets as private, not open to the public, except for Spring Road, "A" Street, and "C" Street. The Homeowners Association shall be responsible for the ownership and maintenance of all private streets. 4. Prior to the recordation of the Final Map, the applicant shall dedicate vehicular access rights to the City of Moorpark for all streets, public and private, within Tract 5045. 000006
