Bobardt, Planning Man e DATE: January 23, 2004 (CC Meeting of 2/4/2004) SUBJECT: Consider Adoption of a Resolution of Intent Directing the Planning Commission to Study, Hold a Public Hearing and Provide a Recommendation on Zoning Ordinance Amendments to Amend Title 17 Relating to the Keeping of Animals and Regulation of Flagpoles in Residential Areas. BACKGROUND /DISCUSSION Local regulations for the keeping of animals are included in both Title 6 and Section 17.28.030 of the Moorpark Municipal Code. The regulations in Title 6 focus on animal control and licensing. The regulations in Section 17.28.030 address appropriate limits in the number and type of animals based on zoning and lot size. These zoning regulations are based on formulas included in Ventura County's Zoning Ordinance, when it was adopted to apply to the City of Moorpark in 1983, and included in the City of Moorpark Zoning Ordinance adopted in 1991. Flagpoles are currently regulated as accessory structures. Section 17.24.020 (A) of the Zoning Code regulates minimum setbacks and maximum heights for accessory structures in residential zones. It is appropriate to revisit regulations periodically to ensure that they reflect current desired norms, avoiding land -use nuisances without being overly restrictive. The Municipal Code calls for a Resolution of City Council to initiate an amendment to the Zoning Ordinance. The attached draft resolution, if adopted by City Council, would direct staff and the Planning Commission to study and provide a recommendation to the City Council on an amendment to Title 17 of the Moorpark Municipal Code related to the keeping of animals and regulation of flagpoles in residential areas. 000139 Honorable City Council February 4, 2004 Page 2 STAFF RECOINIl-fNDATION Adopt Resolution 2004- , directing the Planning Commission to study, hold a public hearing, and provide a recommendation to the City Council on an amendment to Title 17 of the Moorpark Municipal Code related to the keeping of animals and regulation of flagpoles. ATTACHMENT: Draft Resolution No. 2004- S: \Community Development \DEV PMTS \Z O A \Initiations \cc 040204 stf rpt Animal ZOA Initiation.doc 0001"0 RESOLUTION NO. 2004- A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF MOORPARK, CALIFORNIA, DIRECTING THE PLANNING COMMISSION TO STUDY, HOLD A PUBLIC HEARING AND PROVIDE A RECOMMENDATION TO THE CITY COUNCIL ON ZONING ORDINANCE AMENDMENTS THAT WOULD AMEND TITLE 17 OF THE ZONING ORDINANCE RELATED TO THE KEEPING OF ANIMALS AND REGULATION OF FLAGPOLES IN RESIDENTIAL AREAS. WHEREAS, Section 17.44.050 of the Municipal Code provides that the City Council may initiate proceedings to consider amendments to the Zoning Ordinance by the adoption of a resolution of intent; and WHEREAS, the City Council wishes to initiate proceedings to consider Zoning Ordinance Amendments that would amend Title 17 (Zoning) regarding the keeping of animals and regulation of flagpoles in residential areas. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF MOORPARK DOES HEREBY RESOLVE AS FOLLOWS: SECTION 1. INITIATION OF PROCEEDINGS: The City Council hereby authorizes the initiation of proceedings to consider Zoning Ordinance Amendments that would amend Title 17 (Zoning) regarding the keeping of animals and regulation of flagpoles in residential areas. SECTION 2. DIRECTION TO PLANNING COMMISSION: The Planning Commission is hereby directed to study, hold a public hearing, and provide a recommendation to the City Council on this matter. SECTION 3. CITY CLERK CERTIFICATION AND FILING: The City Clerk shall certify to the adoption of this resolution and shall cause a certified resolution to be filed in the book of original resolutions.
