SUBJECT: Authorization to Process Documents Related to Right -of-
Way Acquisition for the Spring Road Widening Project
DISCUSSION
A. Project Description [Project 80261
The conceptual design for the subject project was approved by
the City Council in November of 1998. The project provides for
widening to the east side of the street [see Exhibit 1] south
of Flinn Avenue, in order to provide for the construction of a
landscaped median and the addition of Bike Lanes. [Note: Such
widening between Flinn Avenue and the rail crossing has already
been constructed as a part of the Flinn Avenue Realignment
Project.] The conceptual design also provides for a double
left -turn lane for southbound traffic at the New Los Angeles
Avenue intersection.
B. Improvements South of New Los Angeles Avenue
In that the project requires the centerline to be shifted to
the east, it will be necessary to also widen the east side of
the street south of New Los Angeles Avenue [and relocate the
existing raised median] in order to provide for the proper
alignment of lane line striping. This work was not anticipated
in the initial design concept and was only recently added to
the project design requirements. Attached as Exhibit 2 is a
sketch showing the required additional street widening and
proposed on -site modifications.

C. Addendum to Mitiaated Neaative Declaration
A Mitigated Negative Declaration for the project was approved
in May of 2003. That document did not address required street
widening south of New Los Angeles Avenue. It was necessary,
therefore, to document the impacts of this component of the
project. An Addendum to the Mitigated Negative Declaration,
addressing this additional work, was prepared and approved by
the Community Development Department, consistent with the CEQA
requirements. A copy of that document is attached as Exhibit
3.
D. Protect Design
The project design is almost complete. Right -of -way needs have
been determined. Legal descriptions and deeds have been
prepared.
The project requires acquisition of approximately ten feet
(10') of additional street right -of -way along the east side of
the street.
E. Right-of-wav Acquisition
The City has retained the services of a property acquisition
agent to assist in acquisition efforts. Title, appraisal and
other related tasks are in progress. All right -of -way
acquisition efforts at the southeast corner of New Los Angeles
Avenue and Spring Road have been deferred until the above
referenced Addendum to the approved Mitigated Negative
Declaration is approved.
F. Authorization
In order to expedite right -of -way acquisition efforts, it is
requested below that the City Council authorize the City
Manager to execute all necessary documents related to the
acquisition of the street rights -of -way and related easements
required for this project. Said authority would include
authorizing payment of amounts consistent with the values set
forth in an approved Appraisal Report. Should it become
necessary to initiate eminent domain proceedings for any such
acquisition, the matter would be brought to the City Council
for authorization to initiate such proceedings.
It is also requested below, that the City Clerk be authorized
to prepare and record Certificates of Acceptance for the
rights -of -way to be acquired.

STAFF RECObMNDATION
Authorize the City Manager to execute documents related to the
acquisition of certain street rights -of -way and related property
rights required to construct the subject project and authorize the
City Clerk to record Certificates of Acceptance for the deeds for
said properties.

ADDENDUM TO
MITIGATED NEGATIVE DECLARATION

The following Addendum to a Mitigated Negative Declaration has been prepared in accordance with the
California Environmental Quality Act of 1970 as amended (CEQA), the State CEQA Guidelines, and the
Environmental Procedures of the City of Moorpark.
PROJECT TITLE:
Project No. 8026: Spring Road Widening
PREVIOUS ENVIRONMENTAL DOCUMENTATION:
A Mitigated Negative Declaration prepared for the Spring Road Widening Project (Project No. 8026) was
adopted by Resolution No. 2003 -2079 of City Council on May 7, 2003.
ADDITIONAL INFORMATION INCLUDED AS PART OF ADDENDUM:
Since the adoption of the Mitigated Negative Declaration for the Spring Road Widening Project, the
proposed project has been amended to include the widening of Spring Road on its east side south of the
Los Angeles Avenue /New Los Angeles Avenue intersection. The widening involves the acquisition of
additional right -of -way approximately eighteen feet (18') in width for a distance of approximately two -
hundred and fifty feet (250'). The purpose of this amendment is to allow for the proper alignment of
Spring Road through its intersection with Los Angeles Avenue /New Los Angeles Avenue with an
additional northbound through lane. Some minor widening and right -of -way acquisition is also proposed
on the south side of New Los Angeles Avenue (east of Spring Road) as part of this amendment.
Conceptual plans for the project amendment are attached to this Addendum and are incorporated herein.
FINDINGS PURSUANT TO SECTION 15164 OF THE STATE CALIFORNIA
ENVIRONMENTAL QUALITY ACT (CEQA) GUIDELINES:
Minor technical changes or additions to the previously prepared Mitigated Negative Declaration are
necessary and none of the conditions described in Section 15162 of the State CEQA Guidelines calling
for the preparation of a subsequent Mitigated Negative Declaration have occurred in that:
1. No substantial changes are proposed in the project that would require major revisions of the
Mitigated Negative Declaration due to the involvement of new significant environmental effects or
a substantial increase in the severity of previously identified effects.
• The additional street widening proposed on Spring Road south of the Los Angeles
Avenue /New Los Angeles Avenue intersection would allow for proper alignment with the
Spring Road widening proposed on the north side of Los Angeles Avenue that was
addressed under the previous Mitigated Negative Declaration.
• The additional right -of -way needed from two (2) properties (Moorpark Plaza and Chevron
Station) is approximately 5,600 square feet. The acquisition of this additional right -of -way
would not change the land uses of the property from which this right -of -way is to be
obtained.
The widening of Spring Road south of Los Angeles Avenue would result in the loss of
three (3) off - street parking spaces at the Moorpark Plaza shopping center. This is

approximately 1.1 percent of the existing 269 parking spaces. At present, 269 spaces
are required for the uses in the shopping center. Section 17.52.100 of the Moorpark
Municipal Code allows for the uses to continue without being classified as nonconforming
as a result of the acquisition of the additional right -of -way. The loss of the off - street
parking is not considered a significant adverse environmental effect due to its small
percentage of total parking available at the shopping center.
• The Spring Road driveway to the Moorpark Plaza Shopping Center will remain open
during the construction of proposed improvements as it is outside the limits of the project.
Street access to the Chevron station will be maintained during construction as a condition
of the construction contract.
• Four (4) liquidamber trees, two (2) fan palm trees, one (1) California Pepper, and one (1)
ornamental pear tree will be removed as part of the proposed amendment to the project.
The previously adopted mitigation measures requiring replacement trees for the
ornamental trees to be removed would still apply to the project, reducing potential
significant impacts to a less -than significant level.
• The previously adopted mitigation measures limiting construction hours would still apply
to the project, reducing potential significant impacts to a less -than significant level.
2. No substantial changes have occurred with respect to the circumstances under which the project
is undertaken which will require major revisions of the previous Mitigated Negative Declaration
due to the involvement of new significant environmental effects or a substantial increase in the
severity of previously identified effects.
• The area around the additional proposed right -of -way is similar in character and land use
to the area described in the previous Mitigated Negative Declaration. The conclusions of
the Initial Study still apply to the expanded project area.
3. No new information of substantial importance, which was not known and could not have been
known with the exercise of reasonable diligence at the time the previous Mitigated Negative
Declaration was adopted, shows that the project will have one or more significant effects not
discussed in the previous Mitigated Negative Declaration.
The previous Mitigated Negative Declaration was adopted on May 7, 2003 and its
conclusions remain current.
• Development now taking place along Spring Road (Police Station, Realignment of Flinn
Road, and Commercial Planned Development Permit No. 2002 -01: Greeneway) was
known at the time of the preparation of the Initial Study for the previously adopted
Mitigated Negative Declaration.
