Gilbert, Director of Public Works DATE: February 19, 2004 (Council Meeting 3 -3 -04) SUBJECT: Right -of -Way Acquisition for New Los Angeles Avenue Bridge Widening Project DISCUSSION A. Background The construction of the New Los Angeles Avenue Bridge Widening Project was completed in the Spring of 2002. In May of 2002 the City Council accepted the work as complete and authorized the recordation of the Notice of Completion. B. Right -of -Way Needs As mentioned in the May 2002 staff report, it was necessary to acquire a small piece [190 sf] of street right -of -way from the shopping center property to accommodate the sidewalk which was constructed on the south side of the highway immediately west of the bridge. This requirement was discovered shortly after the construction contract was awarded. In order to not delay construction, a Right -of -Entry Permit was obtained from the property owner to allow construction to proceed concurrently with right -of -way acquisition efforts. At the time the Notice of Completion was approved by the City Council, the City (through its property acquisition agent) was still negotiating the acquisition of the project. C. Right-of-Wav Acquisition The subject property was eventually acquired, in fee, from the property owner for $2,280. Total acquisition costs, including title work, engineering, and professional services, was $7,318. Riaht -of -Wav Acceptance Although the above mentioned acquisition efforts were mentioned in the May 2002 staff report, staff did not ask, at that time, that the subject right -of -way be accepted by the City Council and the related deed recorded upon execution of the deed by the seller. Subsequently the deed was executed and acquisition costs were paid. It is now appropriate to accept and record the deed. E. Riaht -of -Wav Convevance In that the sidewalk should be part of the highway right -of- way, it is the intent of staff to convey the subject property to Caltrans. STAFF RECOMMENDATION Authorize the City Clerk to record the deed for the subject right - of -way and the related Certificate of Acceptance and authorize said property to be conveyed to the State of California [ Caltrans] and for the Mayor and staff to execute all documents related to that conveyance.
