Lindley, Director of Community Services] March 31, 2004 (Meeting of April 7, 2004) SUBJECT: Consider Award of Corporation for Improvement Project DISCUSSION Contract to Casron Services the Villa Campesina Park On February 4, 2004, the City Council approved the design and specifications for improvements at Villa Campesina Park. The bid process for the construction of the improvements closed on March 24, and the City Council is now being asked to approve the award of a contract to the apparent lowest qualified bidder, Casron Services Corporation. The Villa Campesina Park improvements include a half -court basketball court and a playground. The City received four bid proposals from the following contractors: Contractor Malibu Pacific Inc Casron Services Corp. Premium Const. Inc. Nye and Nelson Inc. Bid Amount $43,581.25 $39,805 $46,855 $68,740 Of the four bidders, only Malibu Pacific enclosed the two addendums in their proposal envelope as instructed. However, Casron Services Corporation caught their error and faxed the addendums to the City prior to the bid opening. This is a minor procedural error that does not affect the bid amount. Upon the advice of the City Attorney, City has the authority to accept the Casron bid proposal as M: \MLindley \PARKS \villa campesina bid award ccagd.doc 000161. The Honorable City Council April 7, 2004 Page 2 complete. The other two bidders failed to submit the addendums. The apparent second lowest qualified bidder, Malibu Pacific, had a mathematical error in the total. When the unit prices in Malibu's proposal are totaled, their lump sum is $38,081.25, which would make it the lowest bid price. This is a difference of $5,500 from what is listed as the lump sum total. However, the City Attorney has stated that you cannot correct an error if it benefits the bidder; i.e., changes the standing results. Therefore, staff finds that the apparent lowest qualified bidder is Casron Services Corporation at $39,805. Casron Services Corporation possesses the necessary licenses to perform the work and has experience constructing similar projects for other cities. The City included $80,300 in the FY 03/04 budget for this project. To date, $32,000 has been spent on the playground equipment, soils tests and project management. Based on Malibu Pacific's bid price of $38,081, it is estimated that the total project will be completed for approximately $70,000. STAFF RECOMMENDATION Award a contract to Casron Services Corporation for the construction of improvements at Villa Campesina Park for a cost not to exceed $39,805 and authorize the City Manager to execute the contract.
