Recommendation: Appoint two (2) Councilmembers to an Ad-Hoc Committee to

SUBJECT: Consider the Establishment of an Ad-Hoc Committee to Develop a Draft
Development Agreement (No. 2016-02) between Moorpark Property 67
LLC (James Rasmussen) and the City of Moorpark for General Plan
Amendment No. 2016-02, Zone Change No. 2016-02, Residential
Planned Development Permit No. 2016-02, and Vesting Tentative
Subdivision Map for Tract No. 5847, for a 138-Unit Single-Family Home
Project on 68.26 Acres, Located West of Gabbert Road and North of the
North Hills Parkway/North Hills Industrial Park
BACKGROUND
On November 5, 2014, the City Council adopted Resolution No. 2014-3327, approving
General Plan Amendment Pre-Screening Application No. 2010-01. This resolution
authorized staff to accept an application to amend the General Plan land use designation
of 68.26 acres of vacant hillside property located west of Gabbert Road, from Rural Low
Density Residential to Low Density Residential, Medium/Low Density Residential, and
Open Space. The application is associated with a proposal to develop a 138-unit single-
family residential project on the site, provided all other necessary entitlement applications
for the proposed project including an application for a development agreement, were filed
concurrently by James Rasmussen on behalf of West Pointe Homes. On October 31,
2016, the Applicant submitted the necessary applications and the project has been under
review.
DISCUSSION
Government Code Section 65864 and City of Moorpark Municipal Code Section 15.40
provide for Development Agreements between the City and property owners in connection
with proposed plans of development for specific properties. Development Agreements are
designed to strengthen the planning process, to provide some certainty in the development
process and to assure development in accordance with the terms and conditions of the
agreement.

As with past projects involving changes in land use, it is recommend that and Ad-Hoc
Committee be appointed to negotiate a Development Agreement for the proposed project.
Currently, four Ad-Hoc Committees exist for Development Agreement negotiations:
1. Hitch Ranch Property Owners (SP No. 2004-01) Development Agreement
Members: Councilmember Mikos and Councilmember Pollock
2. Daly Group (Depot) Project
Members: Mayor Parvin and Mayor Pro Tem Simons
3. Area Housing Authority of County of Ventura and Many Mansions for Scattered
Site Housing Project
Members: Councilmember Enegren and Councilmember Simons
4. Mansi - High St. Mixed Proposal
Members: Councilmember Enegren and Councilmember Mikos
Upcoming projects that may require Ad-Hoc Committees include the Sunbelt Enterprises
(Kavlico) project.
COUNCIL GOAL COMPLIANCE
This action is consistent with City Council Strategy 5, Goal 1, Objective 2 (5.1.2):
“Present for City Council consideration General Plan Amendment (GPA) of Land Use
Element and accompanying entitlements for GPA 2016-02 (Moorpark 67/Rasmussen/West
Point Homes) and GPA 2015-01 for Sunbelt Specific Plan.”
FISCAL IMPACT
There is no fiscal impact associated with this action.
STAFF RECOMMENDATION
Appoint two (2) Councilmembers to an Ad-Hoc Committee to develop a draft Development
Agreement for this project.
