All items listed are heard and acted upon by the City Council unless otherwise noted. 1. CALL TO ORDER: Mayor Parvin called the meeting to order at 6:30 p.m. 2. PLEDGE OF ALLEGIANCE: Shaun Kroes, Program Manager, led the Pledge of Allegiance. 3. ROLL CALL: Present: Councilmembers Enegren, Mikos, Pollock, Simons, and Mayor Parvin. Staff Present: Troy Brown, City Manager; Kevin Ennis, City Attorney; Deborah S. Traffenstedt, Assistant City Manager; Irmina Lumbad, Interim Finance Director; Jeremy Laurentowski, Parks and Recreation Director; Karen Vaughn, Community Development Director; Brian Chong, Assistant to the City Manager; Shaun Kroes, Program Manager; Jessica Sandifer, Community Services Manager; Atanas Beltchev, Information Systems Manager; Captain Victor Fazio, Sheriffs Department; and Blanca Garza, Deputy City Clerk. 4. PROCLAMATIONS AND COMMENDATIONS: A. Proclamation Recognizing April as National Arab Heritage Month. The Mayor presented Mrs. Barakat with a Proclamation Recognizing April as National Arab Heritage Month. B. Recognition of Mesa Verde Cheer Team. Mayor Parvin recognized and presented certificates of recognition to the Mesa Verde Cheer Team. Minutes of the City Council/Successor Agency Moorpark, California Page 2 April 3, 2019 5. PUBLIC COMMENT: Chuck Hamm, a Moorpark resident of Spring Road, requested a bidding process be considered for Professional Consultant Services and that the City Council adopt a Resolution consistent with Moorpark Municipal Code Section 3.04. 6. REORDERING OF, AND ADDITIONS TO, THE AGENDA (Pursuant to Council Rules of Procedure, Section 2.9, Items to be withdrawn from the Consent Calendar shall be identified at this time.) CONSENSUS: It was the unanimous consensus of the Council to pull Agenda Item 10.B. from the Agenda and Item 10.C. for individual consideration at the request of the City Manager. 7. ANNOUNCEMENTS, FUTURE AGENDA ITEMS, AND REPORTS ON MEETINGS/CONFERENCES ATTENDED BY COUNCILMEMBERS AND MAYOR: Councilmember Pollock reported the events he attended and participated in since the last City Council meeting, which included the City's Employee Recognition Event dinner, a County Deputy ride along; the State of the City luncheon; a farewell event for John Riley at Enegren's; the Moorpark College Community Forum; Supervisor Bob Huber's Town Hall at Enegren's; a League of California Cities Environmental Quality Committee meeting in La Mesa; and an Executive Committee meeting of the Channel Counties Division for the League of California Cities in Solvang. Councilmember Mikos reported she attended a meeting of the Economic Development Collaborative Ventura County meeting in Camarillo; the Santa Monica Mountains Conservancy meeting in Thousand Oaks; the State of the City luncheon, and the Employee Recognition Event. Councilmember Mikos also remarked she attended the Moorpark College 10-Year Master Plan meeting, and she reminded them to ensure they talk with the City's Public Works staff to ensure there is not a disconnect with regard to grading and drainage matters as happened previously, in order to protect the Moorpark residents. Mayor Parvin invited the community to join the Spring Fever Skate Night on Saturday, April 6 from 5 p.m. to 8 p.m. at the Arroyo Vista Community Park to enjoy a fun evening of skating with music, contests, and prizes! Mayor Parvin announced that the Moorpark City Library is celebrating Dia de los Ninos, Children's Day, on Wednesday, April 10 from 10 a.m. to 1 p.m. outside in the park next to the Library. "Join us and First 5 as we celebrate children, Minutes of the City Council/Successor Agency Moorpark, California Page 3 April 3, 2019 families, and reading with crafts, stories, and songs in multiple languages! This celebration emphasizes the importance of literacy for children of all linguistic and cultural backgrounds." Mayor Parvin reported she attended Maureen Benson's retirement luncheon and the Moorpark Women's Fortnightly Spring luncheon and fundraiser; delivered the State of the City presentation; participated in Supervisor Bob Huber's Town Hall meeting at Enegren's; attended an event for Commander John Riley at Enegren's; participated in a remote access network meeting with countywide Chiefs of Police and the Undersheriff; participated in the Ventura Council of Governments administrative meeting and a Moorpark Chamber mixer hosted by the Rotary Club of Moorpark; and announced it is Distracted Driver Awareness Month and encouraged all drivers to not be distracted drivers in Moorpark. Mayor Parvin announced that the Boys and Girls Club of Moorpark is hosting their 32nd Annual Auction and Dinner Gala event on April 13, and for tickets or more information call (805) 529-1140. 8. PUBLIC HEARING: A. Public Hearing to Receive Public Comments and Consider Second Reading and Adoption of Ordinance No. 467, an Ordinance of the City of Moorpark, California, Providing for the Election of City Councilmembers by Districts with an At-Large Elected Mayor, Establishing the Boundaries and Identification Number of Each District, Establishing the Election Order of Each District, Amending Chapter 2.08 ("Municipal Elections") of the Moorpark Municipal Code, and Making a Determination of Exemption Pursuant to the California Environmental Quality Act. Staff Recommendation: Open the public hearing and receive public comments, close the public hearing, waive full reading, and adopt Ordinance No. 467. ROLL CALL VOTE REQUIRED Ms. Traffenstedt gave the staff report. Mayor Parvin opened the public hearing. Antonio Castro, a Moorpark resident, offered his appreciation for the Council's previous action for this Ordinance pertaining to the downtown district and encouraged tonight's culminating action. Mayor Parvin closed the public hearing. Mr. Ennis read the title of Ordinance No. 467. AN ORDINANCE OF THE CITY OF MOORPARK, CALIFORNIA, PROVIDING FOR THE ELECTION OF Minutes of the City Council/Successor Agency Moorpark, California Page 4 April 3, 2019 CITY COUNCILMEMBERS BY DISTRICTS WITH AN AT-LARGE ELECTED MAYOR, ESTABLISHING THE BOUNDARIES AND IDENTIFICATION NUMBER OF EACH DISTRICT, ESTABLISHING THE ELECTION ORDER OF EACH DISTRICT, AMENDING CHAPTER 2.08 ("MUNICIPAL ELECTIONS") OF THE MOORPARK MUNICIPAL CODE, AND MAKING A DETERMINATION OF EXEMPTION PURSUANT TO THE CALIFORNIA ENVIRONMENTAL QUALITY ACT MOTION: Mayor Parvin moved and Councilmember Enegren seconded a motion to waive full reading, declare Ordinance No. 467 read for the second time, and adopted as read. The motion carried by roll call vote 4-1, with Councilmember Mikos dissenting. 9. PRESENTATION/ACTION/DISCUSSION: NONE. AT THIS POINT in the meeting Councilmember Enegren announced he would recuse himself from participation in discussion of Item 10.C. due to a potential conflict of interest and left the dais. The time was 7:02 p.m. 10. CONSENT CALENDAR: C. Consider Renewal of Exclusive Negotiating Agreement with Daly Group, Inc. for High Street Property (APN 512-0-090-115). Staff Recommendation: Approve Exclusive Negotiating Agreement with Daly Group, Inc., subject to final language approval of the City Manager, and authorize City Manager to execute the agreement. Ms. Sandifer and Mr. Brown gave the staff report. Mr. Vince Daly, Daly Group, addressed the City Council and requested renewal of the Exclusive Negotiating Agreement for the High Street Property. MOTION: Councilmember Pollock moved and Councilmember Mikos seconded a motion to approve Exclusive Negotiating Agreement with Daly Group, Inc., subject to final language approval of the City Manager, and authorized the City Manager to execute the agreement. The motion carried by voice vote 4-0, with Councilmember Enegren absent. AT THIS POINT in the meeting, Councilmember Enegren returned to the dais and the meeting continued with the balance of the Consent Calendar. CONSENT CALENDAR: (ROLL CALL VOTE REQUIRED) MOTION: Councilmember Mikos moved and Mayor Parvin seconded a motion to approve the balance of the Consent Calendar with the exception of 10.B. which was removed from the Agenda. The motion carried by unanimous roll call vote. A. Consider Warrant Register for Fiscal Year 2018/19 — April 3, 2019. Staff Recommendation: Approve the warrant register. D. Consider Amendment No. 4 to Agreement for Professional Services between the City of Moorpark and Nobel Systems. Staff Recommendation: Authorize the City Manager to sign Amendment No. 4 to the Agreement for Professional Services between the City of Moorpark and Nobel Systems, subject to final language approval by the City Manager. E. Consider Cooperative Agreement with the Ventura County Transportation Commission for Administration of Funds from the Proposition 1B Public Transportation Modernization, Improvement and Service Enhancement Account. Staff Recommendation: Approve Cooperative Agreement with the Ventura County Transportation Commission for administration of funds from the Proposition 1B Public Transportation Modernization, Improvement and Service Enhancement Account and authorize the Mayor to execute the Agreement, subject to final language approval of the City Manager and City Attorney. F. Consider Amendment No. 1 to the Agreement with Lance, Soil & Lunghard, LLP for Professional Auditing Services. Staff Recommendation: Approve Amendment No. 1 to the Agreement with Lance, Soil & Lunghard; and authorize the City Manager to execute the Amendment, subject to the final language approval by the City Manager and City Attorney. 11. ORDINANCES: (ROLL CALL VOTE REQUIRED) A. Consider Ordinance No. 470 Amending Section 2.04.010, Meetings— Time; of Chapter 2.04, City Council; of Title 2, Administration and Personnel; of the Moorpark Municipal Code. Staff Recommendation: Waive full reading, declare Ordinance No. 470 read for the second time, and adopted as read. ROLL CALL VOTE REQUIRED Mr. Ennis read the title of Ordinance No. 470. Minutes of the City Council/Successor Agency Moorpark, California Page 6 April 3, 2019 AN ORDINANCE OF THE CITY OF MOORPARK, CALIFORNIA, AMENDING SECTION 2.04.010, MEETINGS—TIME; OF CHAPTER 2.04, CITY COUNCIL; OF TITLE 2, ADMINISTRATION AND PERSONNEL; OF THE MOORPARK MUNICIPAL CODE MOTION: Mayor Parvin moved and Councilmember Pollock seconded a motion to waive full reading, declare Ordinance No. 470 read for the second time, and adopted as read. The motion carried by roll call vote 4-1, with Councilmember Mikos dissenting. 12. CLOSED SESSION: Mr. Brown requested the City Council go into Closed Session for discussion of Item 12.A. on the agenda. Mr. Brown noted for the record that Item 12.A. is titled, "Public Employee Appointment and Employment pursuant to Government Code Section 54957 (b)(1)" and should read, "Public Employee Performance Evaluation" pursuant to Government Code Section 54957, and noted it is acceptable to adjourn into Closed Session under that Government Code section. MOTION: Councilmember Mikos moved and Councilmember Pollock seconded a motion to recess to closed session for discussion of Item 12.A. on the agenda, as clarified by Mr. Brown that this agenda title should read "Public Employee Performance Evaluation". The motion carried by unanimous voice vote. The time was 7:16 p.m. A. PUBLIC EMPLOYEE PERFORMANCE EVALUATION Pursuant to Government Code Section 54957 (b)(1) Title: City Manager Present in closed session were Councilmembers Enegren, Mikos, Pollock, Simons, and Mayor Parvin; and Troy Brown, City Manager. The City Council reconvened into open session at 7:20 p.m. Mr. Brown stated Item 12.A. was discussed and there was no action to report.
