Borchard, Administrative Services Director Nk DATE: April 6, 2004 (CC Meeting of 4/21/04) SUBJECT: Consider an Ordinance Amending Section 2.12.120 of the Municipal Code Providing Authority to Sign Written Contracts BACKGROUND /DISCUSSION Section 2.12.120 of the Moorpark Municipal Code currently authorizes the City Manager to execute contracts up to a maximum of $25,000 for which a budget appropriation has already been approved by the City Council. Section 2.12.120 also provides that the City Manager's designee is authorized to execute contracts up to a maximum of $5,000 for which a budget appropriation has been approved by the City Council. In order to simplify internal processing and improve customer service, staff is proposing that Section 2.12.120 be amended to allow contracts to be executed by the City Manager up to a maximum of $50,000 and by the City Manager's designee up to a maximum of $10,000 for which a budget appropriation has been approved by the City Council. It is the City Manager's intention that all or most of the contracts to be signed by others so authorized be a pre- approved City standard contract. It is also proposed to change the reporting of these contracts from a weekly to a monthly basis. In the past there were often weeks with no signed contracts and this will be a more efficient reporting system. AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF MOORPARK, CALIFORNIA, AMENDING SECTION 2.12.120 OF CHAPTER 2.12 (CITY MANAGER) OF THE MUNICIPAL CODE, PROVIDING AUTHORITY TO SIGN WRITTEN CONTRACTS WHEREAS, Government Code Section 40602 states that the legislative body may provide by ordinance that written contracts made or entered into by the City may be signed by an officer other than the mayor; and WHEREAS, it is administratively expeditious that the City Manager and the City Manager's designee be authorized to sign certain contracts; NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF MOORPARK DOES ORDAIN AS FOLLOWS: SECTION 1. That Section 2.12.120 of the Moorpark Municipal Code is hereby amended in its entirety to read as follows: Section 2.12.120 Authority to sign written contracts. A) The city manager may execute on behalf of the city any contract which has received prior approval of the city council. B) The city manager shall be authorized without prior approval to execute contracts up to a maximum of fifty thousand dollars ($50,000) for which a budget appropriation has already been approved by the city council. C) The city manager's designee shall be authorized without prior approval to execute contracts up to a maximum of ten thousand dollars ($10,000) for which a budget appropriation has already been approved by the city council. D) A list of contracts executed by the city manager and /or his designees pursuant to subsections B and C of this section shall be presented to the council for their information in a subsequent monthly report. 000015 Ordinance No. Page 2 SECTION 2. If any section, subsection, sentence, clause, phrase, part or portion of this Ordinance is for any reason held to be invalid or unconstitutional by any court of competent jurisdiction, such decision shall not affect the validity of the remaining portions of this Ordinance. The City Council declares that it would have adopted this Ordinance and each section, subsection, sentence, clause, phrase, part or portion thereof, irrespective of the fact that any one or more section, subsections, sentences, clauses, phrases, parts or portions be declared invalid or unconstitutional. SECTION 3. This Ordinance shall become effective thirty (30) days after its passage and adoption. SECTION 4. The City Clerk shall certify to the passage and adoption of this ordinance; shall enter the same in the book of original ordinances of said City; shall make a minute of the passage and adoption thereof in the records of the proceedings of the City Council at which the same is passed and adopted; and shall, within fifteen (15) days after the passage and adoption thereof, cause the same to be published once in the Moorpark Star a newspaper of general circulation, as defined in Section 6008 of the Government Code, for the City of Moorpark, and which is hereby designated for that purpose.
