BACKGROUND /DISCUSSION
On April 21, 2004, the City Council set a public hearing for May
5, 2004, to consider adjusting real time billing rates, updating
the schedule for land use development processing fees and
rescinding Resolution No. 99 -1659. In accordance with California
Government Code Section 66016, which sets forth the notification
and hearing process required prior to levying new fees or
service charges, or prior to increasing an existing fee or
service charge, notice of this City Council public meeting has
been mailed and published.
The attached April 21, 2004, Agenda Report provides the details
of the proposed billing rate and fee adjustments including the
draft Resolution. In accordance with Government Code Section
66017, the proposed deposit and fee schedule will be effective
sixty (60) days following the adoption of the Resolution.
STAFF RECOMMENDATION
1. Open the public hearing, take public testimony and close
the public hearing.
2. Adopt Resolution No. 2004- approving adjustments to
real time billing rates, updating the schedule of land

SUBJECT: Consider Setting a Public Hearing Date to Consider a
Resolution Adjusting Real Time Billing Rates, Updating
the Schedule for Land Use Development Processing Fees
and Rescinding Resolution No. 99 -1659
BACKGROUND
The last comprehensive update of fees and deposits for land use
development entitlement processing, and establishment of real
time billing rates occurred in 1998 (Resolution No. 98- 1551),
over six years ago. Since that time the schedule of fee
deposits has been modified periodically to reflect changes in
entitlement processing categories and to more clearly
differentiate fee categories, to be consistent with the demands
for staff time for specific types of applications, while
retaining the real time billing rate of $88.00 per hour set in
-1998. The most recent update of the fee schedule was per
Resolution No. 99 -1659 adopted October 6, 1999 (Attachment 1).
This update specifically addressed the deposits for review of
projects in the Downtown Specific Plan Area.
Several comprehensive changes to the Zoning Code regarding
permits and entitlement process and procedures have occurred
over the past year. In addition, the Administrative Services
Director has reviewed the real time billing rates, and has
recommended adjustment in those rates. The attached Resolution
includes adjustments in the real time billing rates, adjustment
in deposit amounts and fee categories to reflect the recommended
rate changes and the demand of staff time. The deposit /fee

schedule also addresses changes to the permit and entitlement
process and includes three new fee categories as discussed
below.
California Government Code Section 66014 provides for cities to
charge fees to recover the costs associated with processing land
development zoning and use permit applications. Section 66016
sets forth the notification and hearing process required prior
to levying new fees or service charges, or prior to increasing
an existing fee or service charge. Notice of the City Council
Public meeting will be mailed and published in accordance with
those requirements.
DISCUSSION
Over the past year, the Community Development Department has
processed several Zoning Code amendments for City Council
approval. These amendments were aimed at simplifying,
clarifying and consolidating the entitlement and permit process,
and have resulted in a proposal for new application deposit
categories and adjustment in other categories to better reflect
the demand on staff time. One significant change is the
elimination of the "per unit" or "per lot" calculation for many
of the categories. Those deposit rates are now a flat rate per
application. The categories that previously required per unit
calculations have been expanded to adjust for variations in
project size. An example is the Tentative Tract Map application
deposit. There are now two categories, "less than thirty (30)
lots" and "thirty (30) lots or more." Attachment 2 provides a
comparison of current fee deposit and flat fee rates with the
proposed fee deposit and flat fee rates.
The deposit rates have also been adjusted to reflect the
Administrative Services Director recommended real time billing
rates for staff. The Administrative Services Director has
calculated the cost recovery rate for those staff positions that
may be required to expend time on land development entitlement
processing or other cost recovery activities on behalf of the
City. The calculated rate is based upon staff's hourly rate
plus benefits, citywide and department overhead cost
percentages, and adjustment to a productive hourly rate to
reflect approved annual leave. The proposed staff billing
rates, including calculation factors, are reflected in Table 1
attached to the Resolution.

The Administrative Services Director also compared the proposed
billing rates to the Consumer Price Index (CPI) changes over the
period from 1998 to 2004. Applying the CPI adjustment to the
$88 planning staff rate resulted in a rate of $101.45. Staff is
recommending a rate of $100 in the category for Planners and the
Community Development Senior Management Analyst who perform the
majority of billable staff time for development projects. The
CPI analysis is also included in Table 1.
Government Code Section 66014 (b) provides for inclusion of the
costs reasonably necessary to prepare and revise plans and
policies that a local agency is required to adopt before it can
make necessary findings and determinations. To this end, an
Advanced Planning Fee is proposed. The fee would be assessed at
five percent (5 %) of each building permit issued for a valuation
of $10,000 or greater. The Advanced Planning Fee would be used
to partially fund required updates to the General Plan and the
maintenance of the City's Traffic Model. The current Traffic
Model Maintenance fee of $264 would be incorporated into the
Advanced Planning Fee and would be eliminated as a separate fee.
The Miscellaneous Fees section of the schedule includes new
records imaging fees for Engineering, Building and Safety and
Planning drawings and permit /entitlement files. The fees are
based on the cost of imaging plus City administration. The
Miscellaneous Fees section also includes a proposed Condition
Compliance Inspection Fee, to be assessed for new commercial and
industrial projects over five - thousand (5,000) square feet, and
multi - family residential projects in excess of ten (10) units.
The proposed fee will provide funds for staff to conduct annual
condition complsance inspections within the critical first five
years of the project's life.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
MOORPARK, STATE OF CALIFORNIA, ESTABLISHING A
SCHEDULE OF LAND USE DEVELOPMENT PRELIMINARY
PROCESSING FEE DEPOSITS AND RESCINDING RESOLUTION
NO. 99 -1593
WHEREAS, the City of Moorpark provides land use development
planning services; and
WHEREAS, the City Council has determined that the cost of
these services shall be offset by fees which accompany -land use
entitlement requests; and
WHEREAS, the Community Development Department staff costs
are charges against fees, based upon real time cost accounting;
and
WHEREAS, the City Council did consider and adopt Resolution
98 -1551 which established a schedule of land use development
processing fees on December 2, 1998; and
WHEREAS, the City Council did consider and adopt under
Ordinance No. 265 revised procedures for the processing of
development applications within the Downtown Specific Plan area,
not previously a portion of the City's entitlement procedures;
and
WHEREAS, a fee for such revised entitlements is necessary;
and
WHEREAS, it is necessary to differentiate within certain
fee categories, fees consistent with the demands for staff time
for specific forms of applications.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF MOORPARK
DOES HEREBY RESOLVE AS FOLLOWS:
SECTION 1. That the Community Development Department staff
shall bill actual time spent on land use applications at a real
time cost accounting rate of $88.00 per hour.
SECTION 2. Contract services shall be billed at cost, plus
fifteen percent (15%), including but not limited to the City
Attorney, geotechnical /geological services, landscape consultant
reviews and inspections, and the City Engineer, except where
otherwise specified.

SECTION 3. That the Community Development Code Enforcement
staff shall bill actual time spent on land use applications and
other items eligible for cost recovery at a real time cost
accounting rate of $82.00 per hour.
SECTION 4. That the Administrative Services staff shall
bill actual time spent on land use applications and other items
eligible for cost recovery at a real time cost recovery rate
of $90.00 per hour.
SECTION 5. That the Director of Community Development has
the authority to reduce certain deposit amounts up to fifty
percent (50%), where the project involves multiple applications
of the same type of project on the same property, to be
processed concurrently.
SECTION 6. That there is a need to provide incentive to
the economic development of the Downtown Specific Plan area
through the reduction of development processing and review fees
established in "Exhibit All such that projects within the
boundaries of the adopted Downtown Specific Plan shall be
required to pay a fee equal to the lesser of the
following: (1) A fee not more than fifty percent (50 %) of the
established deposit /review fee as shown upon the fee schedule in
"Exhibit A or (2) a fee equal to the actual cost to process
and review such applications when such costs may be less than
the fee in (1) above.
SECTION 7. That the schedule of Land Development
Preliminary Processing Fee Deposits shall be as identified as
those revised fees shown in "Exhibit All to this Resolution.
SECTION 8. That this Resolution shall become effective
sixty days (60) following the public meeting held on October 6,
1999 (December 4, 1999), pursuant to Government Code Section
66016, implementing those changes to the fees described herein
immediately upon the effective date set forth herein.
SECTION 9. That Resolution No. 99 -1593 adopted December 2,
1998, is hereby repealed upon the effective date of this
Resolution.

adoption of this resolution and shall cause a certified
resolution to be filed in the book of original Resolutions.

RESOLUTION NO. 2004-
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
MOORPARK, CALIFORNIA, ESTABLISHING A SCHEDULE OF
LAND USE DEVELOPMENT PRELIMINARY PROCESSING FEE
DEPOSITS AND RESCINDING RESOLUTION NO. 99 -1659
WHEREAS, the City of Moorpark provides land use development
planning services; and
WHEREAS, the City Council has determined that the cost of
these services shall be offset by fees which accompany land use
entitlement requests; and
WHEREAS, the Community Development Department staff costs
are charged against fees, based upon real time cost accounting;
and
WHEREAS, on September 23, 2003, the City Council did
consider and adopt Ordinance No. 297 which amended the Zoning
Code relating to entitlement process and procedures; and
WHEREAS, Ordinance 297 established modified categories for
entitlement process; and
WHEREAS, a fee for such entitlements are necessary; and
WHEREAS, it is necessary to differentiate within certain
fee categories, fees consistent with the demands for staff time
for specific forms of applications.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF MOORPARK
DOES HEREBY RESOLVE AS FOLLOWS:
SECTION 1. The City of Moorpark staff shall bill actual
time spent on land use applications and other at a real time
cost accounting rate per Table 1.
SECTION 2. Contract services shall be billed at cost, plus
fifteen percent (15 %), including but not limited to the City
Engineer, except where otherwise specified; City Attorney;
geotechnical /geological services, landscape architect review and
inspection services; lighting engineer review and inspection
services and planning consultant services.
SECTION 3. The Community Development Code Compliance
Officer shall bill actual time spent on land use application and

other items eligible for cost recovery at a real time cost
accounting rate per Table 1.
SECTION 4. The Administrative Services staff shall bill
actual time spent on land use application and other items
eligible for cost recovery at a real time cost accounting rate
per Table 1.
SECTION 5. The Community Development Director has the
authority to reduce certain deposit amounts up to fifty percent
(500), where the project involves multiple applications of the
same type of project on the same property, to be processed
concurrently.
SECTION 6. The Schedule of Land Development Preliminary
Processing Fee Deposits shall be identified as those revised
fees show in "Exhibit A" to this Resolution
SECTION 7. This Resolution shall become effective sixty
(60) days following the public meeting held on May 5, 2004,
pursuant to Government Code Section 66016, (July 4, 2004)
implementing those changes to the fees described herein
immediately upon the effective date set forth herein.
SECTION 8. Resolution No. 99 -1659 adopted the 6th day of
October, 1999, is hereby rescinded upon the effective date of
this Resolution.
SECTION 9. The City Clerk shall certify to the adoption of
this resolution and shall cause a certified resolution to be
filed in the book of original resolutions.
