HomeMy WebLinkAboutAGENDA REPORT 2004 0505 CC REG ITEM 10CTO: FROM: DATE: MOORPARK CITY COUNCIL AGENDA REPORT Honorable City Council ITEM IC)- c. os-as-- aoo�C__ Mike Mathews, Senior Management Analyst April 27,2004 (CC Meeting of 05/05/04) !jA /� 11A SUBJECT: Consideration of an Agreement with the California Department of Transportation (Caltrans) for the Maintenance of State Highways in the City of Moorpark SUMMARY The City of Moorpark sweeps State Highway 23 (Moorpark Avenue) and State Highway 118 (Los Angeles Avenue) in the City of Moorpark under an agreement with the California Department of Transportation (Caltrans) that was executed in 1985. Caltrans wishes to update the agreement. BACKGROUND In the agreement dated July 1, 1985 between Caltrans and the City of Moorpark, the City agreed to sweep State Highways 23 & 118 in accordance with Section 27 of the Streets and Highways Code. The agreement capped the Caltrans cost at $8,000 for biweekly sweeping. Until very recently, the City was able to fund the sweeping of the State Highways within the $8,000 cap. Starting July 1, 2002, the City started sweeping all arterial streets weekly to meet the requirements of the National Pollution Discharge Elimination System (NPDES) . The cost to sweep the State Highways for Fiscal Year 2002 -03 was $8,420. 1111 s Honorable City Council Meeting of May 5, 2004 Page 2 DISCUSSION New Agreement The new agreement proposed by Caltrans caps the sweeping costs at $5,750 annually. Caltrans does not allow for annual cost -of- living increases. Fiscal Impact Since the sweeping costs are currently about $8,500 and Caltrans is offering $5,750, in effect the City is being asked to subsidize Caltrans maintenance obligations. NPDES It is the view of staff that the sweeping of the State Highways within the City of Moorpark is a requirement of the Caltrans NPDES permit and that Caltrans should be providing this service. Escape Clause According to the terms of the contract, either party may terminate the agreement upon 30 days written notice to the other party. STAFF RECOMMENDATION Authorize the Mayor to send a letter to Caltrans giving thirty (30) days notice of cancellation of the "Agreement for Maintenance of State Highways in the City ", pursuant to Section J of said agreement. 0000'79
