MOORPARK CITY COUNCIL AGENDA REPORT The Honorable City Council John Brand, Senior Management Analystlz April 22, 2004 (CC meeting of May 5, 2004) s�saeo�� AA SUBJECT: Consider Resolution Authorizing Submittal of a Three Year (2004 -2007) Used Oil Recycling Block Grant Application to the California Integrated Waste Management Board SUMMARY The City Council is being asked to consider a resolution approving the submittal of the City's annual application for a Used Oil Block Grant to the state of California Integrated Waste Management Board. DISCUSSION The City began receiving Used Oil Recycling Block Grants when the program began in 1993. The grants are administered by the California Integrated Waste Management Board (CIWMB). The main purpose of this grant program is to provide funding to local governments to establish used oil collection programs that encourage recycling or appropriate disposal of used oil. Recently the state allowed Used Oil Block Grant funds to be spent on certain federally- mandated National Pollutant Elimination System (NPDES) activities connected to illegal disposal of motor oil. The main way used oil is recycled is through the monthly Household Hazardous Waste (HHW) collection events. Moorpark residents can attend HHW events three times per month: on the second Friday; on the Saturday following the second Friday; and on the third Saturday of the month. The exception is December when HHW drop offs occur only on the second Friday and the Saturday after it. Local business can also become a state - certified used oil collection center by applying to the CIWMB. The certified centers must accept, at no charge, a maximum of 20 gallons of used lubricating oil from a person, per day. A certified center must offer a $0.04 per quart recycling incentive to the walk -in clients. Over the years, three 000122 Used Oil Block Grant 2004 -2007 CC Meeting of May 5, 2004 Page 2 (3) auto - related businesses in Moorpark have become certified collection centers only to quit the program because it interfered with their regular business operations. It is staff's objective to establish another local used oil collection center this year. Grant funds may be used to purchase equipment for a certified center such as holding tanks and tools to test for contamination. The funding is distributed on a per capita basis. Moorpark is entitled to receive $10,703.99 for Fiscal Year 2004 -2005. Not all of the money has to be spent in the Fiscal Year for which the funds are awarded. Typically, the City deposits the grant in its Solid Waste AB 939 Fund (Fund 5001). The City must complete a funding request form and adopt an appropriate authorizing resolution to receive the funds. The grant administrators at the CIWMB have the authority to determine if grant funds can be used for a particular activity. Approved uses include purchasing equipment, contaminated oil disposal, overhead costs, staff time, public information, promotional items, and now NPDES activity related to preventing disposal of used motor oil into the environment. Historically the City ha balanced mix of all the application must contain governing body authorizing the individual authorized and requests for payments. The grant .n approved resolution from each City's submittal of the application and identify to executive any agreements, contracts, Used Oil Block Grant 2004 -2007 O O O 12 3 RESOLUTION NO. 2004- A RESOLUTION OF THE CITY OF MOORPARK, CALIFORNIA, AUTHORIZING SUBMITTAL OF A USED OIL BLOCK GRANT APPLICATION TO THE CALIFORNIA INTEGRATED WASTE MANAGEMENT BOARD, AND AUTHORIZING THE CITY MANAGER TO EXECUTE ANY AGREEMENTS, CONTRACTS, AND REQUESTS FOR PAYMENT WHEREAS, the City of Moorpark recognizes that it is in the public interest to enact and implement an integrated waste management plan to address the state's diminishing landfill space and the potential adverse environmental impacts from inappropriate disposal of waste materials including used oil; and WHEREAS, the people of the State of California have enacted the California Oil Recycling Enhancement Act and related legislation that provides funds to cities and counties for establishing and maintaining local used oil collection programs that encourage recycling or appropriate disposal of used oil; and WHEREAS, the people of the State of California have enacted §47000 et seq of the California Public Resources Code that provides grants to local governments to establish and implement waste diversion and separation programs to prevent disposal of hazardous waste, including household hazardous waste, in solid waste landfills; and WHEREAS, the California Integrated Waste Management Board has been delegated the responsibility for the administration of these programs within the state, setting up necessary procedures governing application by cities and counties under these programs. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF MOORPARK DOES HEREBY RESOLVE AS FOLLOWS: SECTION 1. The City Council of the City of Moorpark authorizes the submittal of grant applications to the California Integrated Waste Management board for all 000124 Resolution No. 2004- • Page 2 available grants under the California Oil Recycling Enhancement Act and all available Household Hazardous Waste grants under the California Integrated Waste Management Act through June 30, 2007. SECTION 2. The City Manager, Community Services Director, Community Services Senior Management Analyst, or a designee named by the City Manager, is hereby authorized and empowered to execute in the name of the City of Moorpark all necessary applications, contracts, payment requests, agreements and amendments hereto for the purposes of securing grant funds and to implement and carry out the purposes specified in the grant application. SECTION 3. The City Clerk shall certify to the adoption of the resolution and shall cause a certified resolution to be filed in the book of original Resolutions.
