Bobardt, Planning Mana e t DATE: May 5, 2004 (CC Meeting of 05/19/2004) SUBJECT: Consider General Plan Amendment No. 2001 -05, Specific Plan No. 2001 -01, and Zone Change No. 2001 -02, for 1,650 Housing Units on 3,586.3 Acres Located Generally North of Moorpark College and State Route 118 on Land Immediately Outside City of Moorpark Municipal Boundaries. DISCUSSION Planning Commission agenda reports and minutes, including reports and minutes related to the public hearing on the Draft EIR, have been transmitted to the City Council previously under separate cover. In addition, the Resolution containing the Planning Commission's recommendation has been included with this information. Main topics discussed by the Planning Commission included traffic, natural resource protection, water quality and groundwater, oil wells, land uses, public amenities, and project design. The following is a synopsis of the main topics of each Planning Commission meeting: October 7, 2003: October 21, 2003: November 4, 2003: November 18, 2003: December 2, 2003: December 16, 2003: January 6, 2004: January 20, 2004: February 3, 2004: February 17, 2004: March 2, 2004: March 16, 2004: April 6, 2004: Regulatory Context Project Description General Plan Issues Specific Plan Issues Schools Revised Draft EIR Initial Staff Recommendation Freeway Traffic Groundwater Supply and Oil Wells Groundwater Quality Miscellaneous Unresolved Issues Proposed Final EIR Planning Commission Recommendation Entitlement decisions to be made by the City Council at this time include consideration of a General Plan Amendment (GPA), a Specific Plan, and a Zone Change. Staff reports to the Planning Commission for the October 7, 2003, November 4, 2003, November 18, 2003, and January 6, 2004 meetings focus on the issues associated with each of these decisions. Prior to Council action on the GPA, Specific Plan and Zone Change, direction may be given for the Planning Commission to consider and make a recommendation on a Development Agreement, to be acted on by Council. The City Council will also need to consider setting this matter before the voters under Measure "S" (Moorpark SOAR Ordinance). This consideration not only includes whether or not 000019 Honorable City Council May 19, 2004 Page 3 the project should be placed on the ballot, but what decisions associated with the project should be placed on the ballot. Because of the size of the project and the complexity of the issues involved in its consideration, staff presentations, public testimony and deliberation on the project are expected to take a substantial amount of meeting time. The following are the main discussion items expected by staff: 1. Regulatory Context and Establishment of Review Schedule 2. Project Description - General Plan and Specific Plan Proposals 3. Environmental Impact Report • EIR Review Process • Traffic: Surface Streets and Freeways • Biology: Habitat, Sensitive Species, Mature Trees • Water Supply, Water Quality, Groundwater Issues and Oil Wells • Public Facilities and Services • Other EIR Topics • Mitigation Monitoring Program • Findings 4. Planning Commission Recommendation on General Plan Amendment, Specific Plan, and Zone Change 5. Development Agreement 6. Ballot Issues Staff has identified three options for project review over several City Council meetings: Option 1: Schedule the project for each regular City Council meeting allowing for one to two hours of public hearing and discussion continuing the hearing until the Council is ready to act on this project. Option 2: Schedule the project for one special Council meeting each month devoted to public hearing and discussion continuing the hearing until the Council is ready to act on this project. 000020 Honorable City Council May 19, 2004 Page 4 Option 3: Schedule the project for one regular Council meeting each month to discuss pre- selected topics, with the allowance for a special meeting as needed to conclude on the specific topics of that meeting and continue the hearing until the Council is ready to act on this project. Staff recommends the third option since specific topics would be known well in advance, and a known review schedule for the public hearing is established. One regular meeting per month also allows staff sufficient time to respond to issues raised by the public or the Council between meetings. Special meetings will afford sufficient time for each topic as needed, maintaining flexibility. If this option is selected, the following could be considered as a tentative review schedule, with special meetings to be determined as needed. May 19, 2004: Regulatory Context June 16, 2004: Project Description and EIR Review Process July 21, 2004: Traffic, Public Facilities and Services, and Other EIR Topics September 15, 2004: Biology, Water Supply, Water Quality, Groundwater, and Oil Wells October 20, 2004: Mitigation Monitoring Program, Findings, Development Agreement (Based On Direction of City Council) and Ballot Issues STAFF RECOMAENDATION Open the public hearing, take testimony, direct staff to prepare materials appropriate for the schedule in Option 3, and continue the agenda item with the hearing open to June 16, 2004. 000021
