DISCUSSION
Consider Ordinance for a One -Half Cent
Transportation Sales Tax Proposition
On May 7, 2004, the Ventura County Transportation
Commission (VCTC) adopted the attached Ordinance
(Attachment A) authorizing a transportation sales tax
proposition for the November 2004 Ballot. The Ordinance
contains the expenditure plan for the use of the sales tax.
In order to qualify for the Ballot, the Ordinance has to be
approved by at least half of the 10 Ventura County cities
representing half of the incorporated population. If the
necessary affirmative action is achieved, VCTC must then
get approval from the Board of Supervisors.
Ventura County is the largest county in the state and the
only county in southern California without a half -cent
transportation sales tax. VCTC is proposing to place a ',�
cent sales tax measure that, over a 30 year period, will
generate an estimated $1.5 billion countywide ($50,000,000
annually) . It is estimated that the City of Moorpark will
receive $869,700 annually as its share. The revenue from
the sales tax will be used to fund transportation and
transit projects only. The intent is that the revenue
generated from the tax will supplement, not supplant,
existing transportation funding sources.

The expenditure plan adopted by VCTC for the expenditure of
the sales tax revenue is as follows:
40% - Highway Projects
40% - Local Streets and Roads
20% - Transit, Metrolink, bikeways
Attached to the Agenda Report is a letter from VCTC
requesting the City's consideration of the sales tax
measure (Attachment B) , Estimated Annual Sales Tax Revenue
(Attachment C), a memo regarding Polling Analysis
(Attachment D), and polling data (Attachment E).

"MAINTAIN LOCAL STREETS AND PREVENT WORSE TRAFFIC CONGESTION"
RETAIL TRANSACTION AND USE ORDINANCE
PREAMBLE
Maintenance and repair of existing roadways in Ventura County and improvements to
relieve congestion cannot be accomplished with available funds. Without additional funds, the
system will bog down and pavement will continue to crumble into permanent disrepair. State
highway funds are on hold again and needed projects are being delayed. Local governments
must either generate revenues to expand our system and maintain our investments or watch the
system collapse and endanger the health, welfare and safety of Ventura County residents.
The establishment of a one -half percent sales tax for transportation to supplement
traditional revenues and revenues to be generated through locally- adopted developer fees and
assessment districts is the only way we can be sure the transportation system will serve the
current and future travel needs in Ventura County. This measure is consistent with SOAR and
the General Plans of the cities in Ventura County and is designed to help maintain our quality of
life. It will guarantee reduced fares for seniors and persons with disabilities and assure the
continuation of Metrolink and other rail and bus services.
The Ventura County Transportation Commission will continue to seek maximum funding
for transportation improvements through State and Federal programs. The Commission will not
provide sales tax revenues to any city or to the County unless the revenues currently used by that
agency for transportation are continued to be used for transportation purposes. These funds may
only be used for transportation purposes in Ventura County and cannot be diverted by the State
or other governmental agencies for another purpose.
The Ventura County Transportation Commission ordains as follows:
SECTION 1. SUMMARY. This ordinance shall be known and may be cited as the Ventura
County Maintain Local Streets and Prevent Worse Traffic Congestion Expenditure Plan. The
Project Expenditure Plan is set forth in Section 6 herein. This ordinance provides for the
implementation of the Ventura County Transportation Commission Maintain Local Streets and
Prevent Worse Traffic Congestion Expenditure Plan. This commitment to improve the quality of
life in Ventura County shall be funded by a one -half of one percent transactions and use tax
established for thirty years. The revenues shall be deposited in a special fund and used solely for
transportation projects and programs within Ventura County. The specific projects and programs
are identified in the Expenditure Plan, Section 6, of this ordinance.
SECTION 2. DEFINITIONS.
a. Expenditure Plan. "The Expenditure Plan" means the Ventura County Transportation
Commission Expenditure Plan shown in Section 6 of this Ordinance.
b. "County" means the Ventura County.
c. "Commission" means the Ventura County Transportation Commission as set forth in
Sections 130053, 130053.5 and 130053.7 of the Public Utilities Code.

SECTION 3. AUTHORITY. This Ordinance is enacted, in part, pursuant to the provisions of
Division 19 of the Public Utilities Code (commencing with Code Section 180000) of the Public
Utilities Code, and Section 7252.22 of the Revenue and Taxation Code.
SECTION 4. IMPOSITION OF TRANSACTIONS AND USE TAX. In addition to any other taxes
authorized by law, there is hereby imposed in the incorporated and unincorporated territory of the
County of Ventura, in accordance with provisions of Part 1.6 (commencing with Section 7251) of
Division 2 of the Revenue and taxation Code which provisions are adopted by reference and
Division 19 of the Public Utilities Code (commencing with Code Section 180000), a retail
transactions and use tax at the rate of one -half of one percent (1/2 %) for thirty years in addition to
any existing or future authorized state or local transactions and use tax.
SECTION 5. PROJECT EXPENDITURE PLAN PURPOSES. These dedicated funds may only
be used for transportation purposes in Ventura County including the administration of Division 25,
including legal actions related thereto, the construction, capital, acquisition, maintenance and
operation of streets, roads, highways, including state highways and public transit and for related
purposes. These purposes include expenditures for the planning, environmental reviews,
engineering, design and related right -of -way acquisition.
SECTION 6. PROJECT EXPENDITURE PLAN. The revenues received by the Ventura County
Transportation Commission from this ordinance (estimated to be $50 million per year, or $1.5
billion over thirty years), after deduction of the required Board of Equalization costs for performing
the functions specified in Section 180204 of the Public Utilities Codes, and for the administration
of the Ventura County Half Cent Sales Tax, in an amount not to exceed one percent (1 %), shall
be used for transportation projects and programs as set forth in this Expenditure Plan. The
Commission shall allocate annually the remaining Retail Tax Revenues 40% to Road and
Highway projects, 20% to Transit, Rail, Bicycle and Pedestrian projects and 40% returned to the
cities and the county, on a per capita basis, for local street purposes. A summary of the major
projects and programs is provided as follows:
• Reduce Congestion, improve safety and widen Highways 101, 23, 118 and 126.
• Maintain local streets, county roads and coordinate traffic signals countywide.
• Expand Metrolink rail services and local bus services.
• Guarantee lower fares for senior citizens and persons with disabilities.
• Construct needed truck weigh stations and bike paths
• Improve railroad crossings countywide and access to California State University
Channel Islands (CSUCI)
• Authorize bonds to expedite and finance improvements
• Conduct independent yearly audits of the programs.
SECTION 7. PROJECT EXPENDITURE PLAN AMENDMENTS The Expenditure Plan may be
amended, if required, in accordance with the Public Utilities Code 240302, as amended. This
section currently provides the following process for amendment: (1) initiation of the amendment
by the Commission reciting findings of necessity; (2) approval of the Board of Supervisors; and,
(3) approval by a majority of the cities constituting a majority of the incorporated population,
unless such process is amended in a manner consistent with State legislation.
Commencing in 2015 and at least every ten years thereafter, the Commission shall review and,
where necessary, propose revisions to the Expenditure Plan. Such revisions shall be submitted
for approval according to the procedures set forth above. Until a revision is approved, the then
existing Expenditure Plan shall remain in full force and effect.

SECTION 8. MAINTENANCE OF EFFORT. It is the intent of the Commission that revenues
provided from this Ordinance be used to supplement existing revenues being used for
transportation improvements and programs and shall not be used to replace existing revenues.
Local jurisdictions shall be required to certify that they are spending all local transportation
funding for transportation purposes. All eligible local agencies will be required to spend the
revenue that they receive within three years of receipt. Unexpended funds, upon audit, must be
returned to the Commission for reallocation.
No revenues shall be allocated for any state highway projects until the Commission has certified
that Ventura County is receiving at least its County Minimum share of highway funds from the
state. Part of the certification shall include a finding that the state has not reduced any state
highway allocations to Ventura County as a result of the addition of any local revenues as
provided herein. This certification shall be made biennially in the Regional Transportation
Improvement Program.
SECTION 9. PRIVATE SECTOR FUNDING. Revenues provided from this Ordinance shall
not be used to replace private developer funding which has been or will be committed for any
project. Nothing in this ordinance shall be construed to preclude cities or the County from
adopting or adjusting appropriate traffic mitigation fees within their respective jurisdictions.
SECTION 10. BONDING AUTHORITY. In order to accelerate the construction of needed
transportation facility improvements, upon voter approval of the ordinance, the Commission shall
have the authority to sell or issue, from time to time, on or before the collection of taxes, bonds or
the evidence of indebtedness, including, but not limited to, capital appreciation bonds, in the
aggregate principal amount at any one time outstanding of not to exceed $500 million, and to
secure such indebtedness solely by way of future collection of taxes, for capital outlay
expenditure for the purposes set forth in Section 5 hereof, including to carry out the projects
described in the Expenditure Plan, Section 6. The Commission, in allocating the annual revenues
from the Ordinance, shall meet all debt service requirements prior to allocating funds for other
projects.
SECTION 11. LIMITATION OF ADMINISTRATIVE EXPENSES. Revenues may be expended
by the Commission for salaries, wages, benefits, overhead, auditing and those services including
contractual services necessary to administer the Ordinance; however, in no case shall such
expenditures exceed one percent (1 %) of the annual revenues provided by the Ordinance. Costs
of performing or contracting for project related work shall be paid from the revenues allocated to
the appropriate purpose as set forth in Section 6 herein. An annual independent audit shall be
conducted to assure that the revenues expended by the Commission under this section are
necessary and reasonable in carrying out its responsibilities under the Ordinance.
SECTION 12. ESTABLISHMENT OF SEPARATE ACCOUNTS. Each agency receiving funds
pursuant to Section 5 shall deposit said funds in a separate Transportation Improvement Account.
Interest earned on funds allocated pursuant to this Ordinance shall be expended only for those
purposes for which the funds were allocated or shall be returned to the Commission for
reallocation. The Commission reserves the right to audit any such accounts.
SECTION 13. IMPLEMENTING ORDINANCES. Upon approval of this Ordinance by the voters
the Commission shall adopt implementing ordinances and rules and take such other actions as
may be necessary and appropriate to carry out its responsibilities.

SECTION 14. ANNUAL APPROPRIATIONS LIMIT. Article XIII (B) of the California Constitution
requires the establishment of an annual appropriations limit for certain governmental entities.
The maximum annual appropriations limit for the Commission has been established as $400
million in order to implement and deliver the program approved by the voters. The appropriations
limit shall be subject to adjustment as provided by law. All expenditures of the transactions and
use tax revenues imposed in Section 3 are subject to the appropriations limit of the Commission.
SECTION 15. EFFECTIVE AND OPERATIVE DATES. This Ordinance shall become effective
only if a 2/3's majority of the electors voting on the Ordinance at the election held on November 2,
2004 vote to approve the Ordinance. If so approved, the provisions of this Ordinance shall
become operative upon the initiation of revenue collection, anticipated to be on April 1, 2005.
SECTION 16. REQUEST FOR ELECTION. The Commission hereby requests the Ventura
County Board of Supervisors to place this Ordinance before the voters for approval on the
November 2, 2004 ballot.
The proposition to be placed on the ballot shall contain a summary of the transportation projects
and programs and shall read substantially as follows:
Proposition "A ", half -cent transportation sales tax.
To maintain streets and prevent worse traffic congestion, improve safety and air quality
and match state and federal transportation grants, this measure authorizes a one -half
cent sales tax to:
• Reduce Congestion, improve safety and widen Highways 101, 23, 118 and 126.
• Maintain local streets, county roads and coordinate traffic signals countywide.
• Expand Metrolink rail services and local bus services.
• Guarantee lower fares for senior citizens and persons with disabilities.
• Construct needed truck weigh stations and bike paths
• Improve railroad crossings and access to California State University Channel
Islands (CSUCI)
• Authorize bonds to expedite and finance improvements
• Conduct independent yearly audits of the programs.
SECTION 17. SEVERABILITY. If any section, part, clause or phrase of this Ordinance is for any
reason held invalid or unconstitutional, the remaining portions shall not be affected but shall
remain in full force and effect.

SUBJECT: Half -cent Sales Tax Ordinance
At our May 7th meeting, the Ventura County Transportation Commission
approved the enclosed "Maintain Local Streets and Prevent Worse Traffic
Congestion" Sales Tax Ordinance and directed that it be transmitted to all of the
cities for approval to place on the November 2, 2004 ballot. State Law requires
that the Ordinance be approved by half the cities representing half of the
population of the incorporated areas before the Commission can request that the
Board of Supervisors place the measure on the November ballot.
The Commission responded to the request made by a number of the cities for an
increase in the percentage of sales tax revenue that will be returned to the cities
for local streets and roads by shifting 10 percent from transit to local streets. You
will note that the new expenditure plan allocates 40 percent to road and highway
projects, 40 percent to the cities and the county on a per capita basis for local
streets, and 20 percent to transit, rail, bicycle and pedestrian projects.
Please understand that by approving the ordinance for placement on the ballot,
the city is not taking a stance one way or the other on the sales tax itself. Based
on polling results and the positive feedback we've received during recent public
education efforts, it is clear that the voters want to weigh in on this issue. Putting
the measure on the ballot affords them that opportunity.
Attached are four documents: the ordinance, a table showing the estimated
revenue return to the cities and the county, an analysis of the poll conducted by
VCTC in April, and the top lines from that poll.

RE: April Polling Analysis
J. Moore Methods conducted a tracking poll in mid -April 2004 to measure
public support for a half -cent transportation sales tax in Ventura County. The
sample of 600 interviewees was drawn from the County Registrar of Voters
and reflects likely voters. All elements of the poll were conducted by
telephone and have a margin of error of + or — 3.5 percentage points.
This poll, while affected by local events and news stories on some of the
days it was conducted, suggests that voter support for a sales tax for
transportation improvement remains high and growing in Ventura County.
We believe the data we gathered in this poll was affected by concurrent polls
regarding separate but somewhat similar ballot proposals in Ventura County,
as well as by news coverage of County Board of Supervisors' activities
around the polls and the ballot measures while the last half of our survey was
in the field.
From Friday, April 23, through Sunday, April 25, news stories appeared in a
number of local newspapers regarding the other polls and related board
action. A review of our data shows a sharp change in polling numbers
starting Friday evening, April 23, 2003.

Clearly, we were seeing very encouraging results before the confusion of the
news stories and board actions. Voter sentiment appeared to be at the two -
thirds support level required for passage of sales tax measures in California.
Consequently, we recommend that VCTC continue to move forward with an
ordinance for the November ballot.
To illustrate, we presented a hypothetical ballot question that returned a
support level of 64 percent in a poll in December 2003. It delivered a similar
result this time around (within the margin of error):
The ballot question you could be voting on reads as follows:
Proposition "A," half -cent transportation sales tax.
To relieve traffic congestion, improve safety and air quality and
match state and federal transportation grants, this measure authorizes
a half -cent sales tax to:
- reduce congestion, improve safety and widen Highways 101, 23, 118

- expand Metrolink rail services, bike paths and local bus services
- guarantee lower fares for seniors and disabled persons
- improve railroad crossings and access to California State University,
Channel Islands
- conduct independent yearly audits to ensure all voter mandates are
met.

However, a review of survey results shows the following shift before and
after Friday, April 23.

We believe an eight -point percentage shift in such a short time is outside of
normal random error. The confusion is further reflected in the doubling of
the number of undecided voters.
VCTC Education Program
The poll demonstrated that VCTC's public education program succeeded in
increasing awareness of the agency's transportation planning effort.
Awareness has risen from 14 percent in December to 42 percent in the new
round of polling.
Transportation Expenditure Plan Projects
Support for the project list in the draft expenditure plan remains solid. These
projects remain among the highest priorities of local voters:
1. Widening congested sections of Highway 101
2. Synchronizing traffic signals
3. Conducting independent yearly audits to ensure all voter
mandates are met
4. Fixing potholes and maintaining city streets and county roads

5. Guaranteeing lower transit fares for seniors, disabled persons
and other people who can't drive
6. Widening congested sections of Highway 118
7. Widening congested sections of Highway 23
8. Making pedestrian safety improvements
Transportation Revenue Allocation
We tested voter support for allocation of the sales tax in two ways:
• 30% for local roads, 30% for transit, 40% for highway improvements
• 40% for local roads, 20% for transit, 40% for highway improvements
With voters about evenly split, we recommend the formula be 35% local
roads, 25% transit and 40% highway improvements.
Key Arguments in Favor of Sales Tax Measure
A number of supportive arguments, highlighted in the mail program,
continue to resonate with voters. These arguments are valuable in
determining WHY voters support a local transportation sales tax. In ranked
order, the most persuasive arguments were these:
1. Improving freeway interchanges and fixing and widening
major roads are necessary to reduce traffic congestion.
2. Eighteen counties representing 80 percent of California's
population have enacted half -cent sales taxes to fund local
transportation projects. If county voters approve this measure,
100 percent of the funds will stay in the county to pay for the
specific projects the voters approved.
3. If the Ventura County sales tax measure is approved now, work
on local transportation improvements can begin right away,
rather than waiting 10 years or longer.
4. If this measure is approved, construction on Highway 23, 118
and Lewis Road can begin within six months rather than being

put off for five or 10 years until the state's budget problems get
solved.
5. Improving the roads now will make it safer to drive.
6. If we pass this half -cent sales tax, the county will be able to
receive additional state money, which is only available to
counties who can put up some of their own money too.
Conclusion
With the poll before April 23, 2004 demonstrating 2/3's support for a
transportation measure, VCTC should continue to move forward with
adoption of a transportation sales tax ordinance for the November ballot.
We believe the decision should now be left to the voters.
