Diaz, Captai� CITYOF OOR ARK,, tingQRNIA city o� 7 a0D 4 ACTION: V� DATE: July 14, 2004 (CC Meeting of 7/21/04) SUBJECT: Consider Resolution Revising Administrative Fees for City Impound Fees from Eighty Dollars ($80) to One Hundred Ten Dollars ($110) for the Release of Vehicles Impounded by the Moorpark Police Department BACKGROUND A review of the fee schedule for the release of a vehicle impounded within the city limits of Moorpark indicates that all costs are not being recovered in the current fee of eighty dollars ($80) . In an effort to recover all costs incurred by the City of Moorpark a recommended increase in the fee to one hundred ten dollars ($110) is recommended. DISCUSSION The Moorpark Police Department on average tows more than 220 vehicles per year. A vehicle impounded by the Moorpark Police Department receives many stages of review and employee time spent processing the report. Below are all the stages of review and the amount of time and costs incurred at each stage of review by the designated police department personnel. The employee time and cost incurred by the Patrol Sergeant and Traffic Senior Deputy is associated with the review /correction of the completed tow reports. The employee time and cost incurred by the Community Services Senior Deputy (CSO Senior), Management Assistant, Records Technician, Sheriff's Service Technician (SST), and the Traffic Cadet are for the duplication of the tow report, receiving of fee(s), and receipt given to the registered owner of the towed vehicle. * The fee for the report is a standard fee set forth by the Sheriff's Business Office for all reports. This includes the duplication of any tow report whether it is a vehicle towed in the unincorporated area or contract city jurisdiction. Impound Fees Charged by the Ten Ventura County Cities and County Jurisdictions: A survey of the ten cities within Ventura County was conducted to determine their fees for the release of impounded vehicles. 1. Thousand Oaks - $110.00 11. Oxnard - $395.00 (* *unlicensed driver) $235.00 (* *unregistered veh(s) /arrests) * *The City of Oxnard no longer utilizes the 30 day impound for the first occurrence. Instead, they assess a three hundred ninety -five dollar ($395.00) fee for unlicensed drivers and two hundred thirty -five dollar ($235.00) for unregistered vehicles and other arrests involving the towing of the arrestee's vehicle. Oxnard enters into a contract with the registered owner and in the event of a second occurrence the 30 -day impound condition is instituted. On the second occurrence a three hundred ninety -five dollar ($395.00) fee for unlicensed drivers is still required for release of the vehicle in addition to the 000193 Honorable City Council July 21, 2004 Regular Meeting Page 3 daily storage costs levied by the storage facility. The remaining nine cities do not have a graduated scale for the thirty -day impound. Staff Recommendation Adopt Resolution No. 2004- Attachment: Resolution No. 2004- 000194 RESOLUTION NO. 2004- A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF MOORPARK, CALIFORNIA, ADOPTING REVISED ADMINISTRATIVE FEES FOR TOWING OF VEHICLES AND RESCINDING RESOLUTION NO. 2002 -2014 WHEREAS, Resolution No. 2002 -2014 established an administrative fee for City police services attendant to the impounding of vehicles pursuant to Section 22850.5 of the California Vehicle Code; and WHEREAS, the amount of that administrative fee has not been increased to reflect rising costs associated with vehicle impounds; and WHEREAS, the City of Moorpark also incurs costs associated with the removal and storage of vehicles illegally parked within the City of Moorpark; and WHEREAS, it is appropriate that the City establish fees for City police services which are not of benefit nor the responsibility of the public at large; and WHEREAS the City's costs associated with the towing of a vehicle in either a traffic stop /impound situation, or illegally parked vehicle situation ( "storage ") should not be borne by the general public, but by the owner of said vehicle; and WHEREAS, the County of Ventura Sheriff's office, with whom the City contracts for police services, has indicated that the City's administrative costs associated with impound and vehicle storage situations is or exceeds one hundred ten dollars ($110.00). NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF MOORPARK DOES HEREBY RESOLVE AS FOLLOWS: SECTION 1. The City Council determines that adoption of the fees set forth herein is exempt from the requirements of the California Environmental Quality Act pursuant to Section 21080(b) (8) thereof and State CEQA Guidelines Section 15273A in that these fees are for the purpose of meeting operating expenses including employee wage rates and fringe benefits and purchasing or leasing supplies, equipment and materials, and will only partially reimburse the City of Moorpark for the cost of providing such services. 000195 Resolution No. 2004 - Page 2 SECTION 2. Resolution No. 2002 -2014 is hereby rescinded. SECTION 3. The City Council hereby approves the fee schedule attached as Exhibit "A" - Police Service Fees. Such fees apply to vehicle tows, whether for impound or storage purposes, as described herein. SECTION 4. All police "Towing Fees" and charges shall be reviewed and updated annually by the department as part of the budget process to ensure that they are current and are related to actual cost. SECTION 5. All persons subject to any of the fees established herein shall be processed consistent with those applicable policies set forth by the County of Ventura Sheriff Department, acting as contractor to the City for Police Services. SECTION 6. The City Clerk shall certify to the adoption of this resolution and shall cause a certified resolution to be filed in the book of original resolutions. Administrative Fee A fee of $110.00 will be assessed for each person who owns a vehicle which is towed for impound or storage purposes, pursuant to this resolution. B. Penaltv for Late Pavment A penalty fee in the amount of ten percent (100) shall be added each month to any fee imposed in the event the fee is not paid within thirty (30) days after the billing date. 000197
