Hogan, Community Development Directo August 12, 2004 (CC Meeting of 9/1/04) SUBJECT: Consider Approval of a Budget Amendment to Transfer and Appropriate Funds to Cover the Cost of a Grading Permit for a Fire Rebuild DISCUSSION Charles Abbott and Associates (CAA) , the City's Building and Safety and Engineering Services consultant, donated $5,000 to be used by the City toward costs associated with October 2003 fire. On December 17, 2003, the City Council approved the transfer of $4,500 from the General Fund Reserve to supplement the donated $5,000, to cover the total cost of waiver of building permit fees for homes which were destroyed in the fire (Attachment 1). As part of the Council action it also approved the waiver of any required grading permit fee as a result of reconstruction. At the time of the December report no grading was anticipated for any of the three fire rebuilds. Now, due to a desire to increase fire access and safety, the building pad of 7177 Walnut Canyon Road needs to be relocated, necessitating grading. The City's cost for a grading permit in this case is $6,700. Additionally, since it was anticipated that all building permits would be issued in fiscal year 2003 -2004, the $4,500 allocation and the $3,500 remaining from the CAA donation were not carried over into the 2004 -2005 budget and would need to be reallocated at this time. The total appropriation would be $14,700. STAFF RECOMMENDATION ROLL CALL VOTE 1. Hogan, Community Development Director DATE: December 8, 2003 (CC Meeting of 12/17/03) SUBJECT: Consider Waiver of Building Permit Fees for Rebuilding of Homes Destroyed in the Simi Fire and Resolution Amending FY 2003 -04 Community Development Budget BACKGROUND /DISCUSSION In previous action by the City Council it directed Staff to waive the payment of processing fees for temporary use permits and Zoning Clearances for fire rebuilds and to use the donation by Charles Abbott Associates to pay for the required fees. The City Council further direction staff to examine the waiver of building permit fees for the people desiring to rebuild their homes destroyed in the recent Simi Fire. Six homes were destroyed in the recent fire. Three homes were mobilehomes, two of which were in the Villa del Arroyo Mobilehome Park and are subject to permits of the State Housing and Community Development Depart located on a homesite. Of the applicant has already decided to destroyed by the fire with a foundation. City Code allows for this purpose when it is placed on a ment. One mobilehome was three remaining homes, one replace the house that was mobilehome on a permanent a mobilehome to be used for permanent foundation. For purposes of this report the following assumptions are made: 1. No fees, other than building permit fees, will be assessed. 2. Other agency fees are not covered by any waiver of City fees. 3. Any fees that were not paid at the time of construction of the original structure will not be CC ATTACHMENT 1 0000261 Honorable City Council December 17, 2003 Page 2 assessed for the fire rebuild. 4. Building permit fees that are waived include any required grading permit fees necessary for the rebuild. 5. Fee waivers are only for replacement of up to the square footage of the structure prior to the fire. 6. Fee waiver does not include the replacement of accessory structures. 7. All replacement structures shall meet the current building and grading requirements adopted by the City. Should the City Council wish to waive the cost of building permits for the above - listed fire - rebuilds, the total cost would be $8,699.15. So far, approximately $300 of the $5,000 of Charles Abbott Associates donation has been used. Staff would suggest that if the City Council were to grant such a waiver of building permit fees that the wavier would expire on December 31, 2004; it would apply only to the current owner; utilize the remaining Charles Abbott Associates donation; and \ \mor pri sery \City Share \Community Development \ADMIN \COUNCIL \Misc Reports \Fire Rebuld.doc 000262 Honorable City Council December 17, 2003 Page 3 allocate up to $4,500 to cover costs not covered by the donation. Authorize staff to implement the fee waiver for building permits consistent with the report Attachment: Resolution No. 2003- \ \mor pri sery \City Share \Community Development \ADMIN \COUNCIL \Misc Reports \Fire Rebuld.doc 0(1) 0 021 1f3 RESOLUTION NO. 2004- A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF MOORPARK, CALIFORNIA, AMENDING THE FISCAL YEAR 2004/2005 COMMUNITY DEVELOPMENT BUDGET BY APPROPRIATING $14,700, $8,000 FROM THE COMMUNITY DEVELOPMENT FUND AND $6,700 FROM THE GENERAL FUND RESERVE, FOR WAIVER OF BUILDING PERMITS AND GRADING PERMIT FEES FOR 7177 WALNUT CANYON ROAD, 6395 GABBERT ROAD AND 1055 MARINE VIEW LANE DESTROYED IN THE SIMI FIRE. WHEREAS, on June 16, 2004, the City Council adopted the budget for fiscal year 2004/2005; and WHEREAS, at a duly noticed City Council meeting on December 17, 2003, a staff report was presented to the City Council, requesting a budget amendment allocating $4,500 from the General Fund for waiver of building permit fees for homes destroyed in the Simi Fire; and WHEREAS, at the close of the budget for fiscal year 2003/2004, $3,500 of the $5,000 donated by Charles Abbott and Associates remained; and WHEREAS, the previously allocated $8,000 was not carried over into the 2004 -2005 Fiscal Year Budget; and WHEREAS, at a duly noticed City Council meeting on September 1, 2004, a staff report was presented to the City Council, requesting a budget amendment allocating $14,700, $8,000 from the Community Development Fund and $6,700 from the General Fund, for waiver of building permit and grading permit fees for 7177 Walnut Canyon Road, 6395 Gabbert Road, and 1055 Marine View Lane destroyed in the Simi Fire; and WHEREAS, Exhibit "A" hereof describes said budget amendment and its resultant impact to the budget line items(s). NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF MOORPARK DOES HEREBY RESOLVE AS FOLLOWS: SECTION 1. A budget amendment re- allocating $8,000 from the Community Development Fund and transferring a total of $6,700 from the General Fund, for a total of $14,700 for waiver of building permit and grading permit fees, as more particularly described in Exhibit "A" attached hereto, is hereby approved.
