Hogan, Community Development Directo Prepared by Paul Porter, Principal Planne DATE: August 11, 2004 (CC Meeting of 9/15/04) SUBJECT: Consider Permit Adjustment No. 2004 -10 for Commercial Planned Development No. 2001 -01: 1) Approval of a Site Plan and Building Elevations for a 4,850 Square -Foot Panera Bread Restaurant Building on Pad 1 of the Moorpark Marketplace; and 2) Approval of a New Sidewalk Section on the West Side of the Food Court, Located South of New Los Angeles Avenue, East of Miller Parkway and West of the SR -23 Freeway on the Application of Zelman Moorpark, LLC. BACKGROUND On March 20, 2002, the City Council approved Commercial Planned Development (CPD) Permit No. 2001 -01 on the application of Zelman Retail Partners, Inc. for the Moorpark Marketplace shopping center. The building elevations for all but the four (4) pad buildings were approved as part of the CPD Permit. Since the specific businesses for the pad buildings were not yet known, a condition was added requiring that a modification to the CPD Permit be requested to allow for review of the site plan and building elevations at these locations. Three (3) of the four (4) pad buildings have already been approved. Previous approvals have been for the In -N -Out, Del Taco and Denny's restaurants. The Zoning Code provisions for the review of modifications have been amended since the condition was placed on the Moorpark Marketplace project, and minor modifications no longer exist. The proper instrument for considering such a request is now a Permit Adjustment, which does not require a public hearing. On August 10, 2004, the applicant submitted an application for Permit Adjustment No. 2004 -10 to CPD No. 2001 -01 for approval S: \Community Development \DEV PMTS \P A \2004 \ -10 Zelman Moorpark, LLC (CPD2001- 01) \CCpanerabread.ccreport.doc 000144 Honorable City Council September 15, 2004 Page No. 2 of: 1) A site plan and building elevations for a Panera Bread Restaurant on Pad 1 of the approved Moorpark Marketplace site plan; and 2) Installation of a sidewalk section (6' X 8') through the planter between the Jamba Juice and the parking lot on the west side of the building. DISCUSSION Panera Bread Site Plan and Building Elevations The site plan and building elevations for the Panera Bread Restaurant have been prepared by the architectural firm of Perkowitz and Ruth, the architectural firm for the Moorpark Marketplace. The proposed 4,850 square foot Panera Bread building is adjacent to and east of the shopping center entry on New Los Angeles Avenue. The restaurant entrance is on the southeast corner of the building. The building elevations are designed to be compatible with the Mediterranean theme of the Moorpark Marketplace. Several architectural elements similar to the other three pad buildings are provided to furnish visual relief from the overall massing of the building. Decorative design features include the use of cultured stone, various roof elements, ceramic tile for accent, a clay tile roof, window awnings, patio cover, wood lattice, and exposed rafter tails. The pad for the building is approximately eleven feet (11') below the street level of New Los Angeles Avenue. The building's parapet wall, at twenty -four feet (24') above the pad, will screen all rooftop equipment from public view along New Los Angeles Avenue. Rooftop equipment will be painted to match the parapet walls to ensure that any views from the SR -23 freeway will not be dominated by unsightly equipment. The trash enclosure and loading area are at the north end of the pad. The trash enclosure will include a tile roof to prevent trash from being thrown over the fence into the enclosure and to meet stormwater quality requirements. Additional landscaping is proposed beyond that in the approved landscaping plan for the Moorpark Marketplace. Trees, shrubs, 000145 Honorable City Council September 15, 2004 Page No. 3 and ground cover consistent with the existing landscaping found throughout the Moorpark Marketplace are part of the proposed enhanced landscaping. The overall project design utilizes high - quality materials at an appropriate scale and provides visual interest with massing, architectural elements and additional landscaping. Installation of Sidewalk The applicant is also requesting approval of a previously installed section of sidewalk through the planter area between Jamba Juice and the parking lot located on the west side of the food court. The sidewalk section enhances pedestrian access to Jamba Juice, however the sidewalk color is inconsistent with the approved sidewalk colors for the Moorpark Marketplace and the existing adjacent sidewalk colors. The applicant has indicated the sidewalk will be stained with a color consistent with the adjacent sidewalk to bring it in compliance with approved sidewalk colors for the shopping center. The applicant will do a sample staining of the concrete with CS -15 Antique Amber over 3611 Oyster White. If the color is not a reasonable match to the color of the adjacent sidewalk, the applicant will remove the sidewalk and replace it with new concrete with Mesa Beige integral color. No modifications to the shopping center Conditions of Approval are necessary as part of this requested Permit Adjustment. STAFF RECONaENDATION Direct staff to prepare a letter approving Permit Adjustment No. 2004 -10 to Commercial Planned Development No. 2001 -01. Attachments: 1. Moorpark Marketplace Site Plan 2.
