Gilbert, Director of Public Works Date: September 7, 2004 (Council Meeting 9- 15 -04) Subject: Discussion of the Requirements for the Vacation of That Portion of Lassen Avenue East of Park Lane BACKGROUND On September 1, 2004, the City Council discussed the desirability of vacating the subject street segment. The City Council directed that this matter be placed on a future City Council Agenda for discussion. DISCUSSION A. Location / Description Attached as Exhibit 1 (page 1) is a copy of Assessor Map No. 511 -08, which clearly shows the "dedicated- but - not - improved" segment of Lassen Avenue located east of Park Lane. B. Remnant Parcels North of Lassen Avenue It should be noted that there are certain "remnant" parcels located north of the subject street segment and south of the alley connecting Cornett Avenue and McFadden Avenue. Those parcels are shown on Assessor Map 511 -10 (excerpt attached as Exhibit 1, Page 2). It should also be noted that those "remnant" parcels are owned by the Birkenshaw estate. Alleys As noted above (and shown on Exhibit 1 - page 2), there is an alley connecting the McFadden Avenue and Cornett Avenue. This alley will not be affected by the subject street vacation. It should be noted, however, that there is also an "unused" alley located west of Cornett Avenue. It is the view of staff that the subject street vacation effort should also include the vacation of this unused alley. It is not known at this time what the impact of such a vacation will be. It is possible that, upon vacation of this alley, the south half of the alley would revert to the owner of the "remnant" parcel located south of the alley and owned by the Birkenshaw estate. D. Preliminary Enaineerina and Title Investiqation It will be necessary to undertake some engineering investigation to obtain the record documents which created the subject segment of Lassen Avenue. Those documents will hopefully reveal whether or not this "paper" street is owned in "fee" by the City, or if it is only a street easement. Knowledge of these facts will be relevant to the vacation process. It then may also be necessary to conduct a "Street Search" (a Title Search for a street) to determine the underlying fee ownership of the street. In the case of streets created over fifty (50) years ago (as in this case), such Street Searches often prove to be time consuming and costly. E. Summary of Street Vacation Requlations and Requirements The process required for vacating a street is generally described as follows: • Completion of the engineering and title ownership investigation discussed above; • Identification of any and all utilities which may occupy the street; Note: It is known that there is a City storm drain located in the subject street segment. • Determination of the impacts of the proposed vacation on any existing utilities; • Informal notification of all affected public agencies, emergency response providers and utilities of the intent to vacate the street; • Final determination of the viability and /or impacts of the proposed vacation; Vacate_ lassen -0409 ()00.24 Vacation of Lassen Avenue September 15, 2004 Page 3 • Adoption of a Planning Commission Resolution finding that the proposed street vacation is not in conflict with the Circulation Element of the Moorpark General Plan; • Adoption of a Resolution of Intent by the City Council; • Publishing and posting a Notice of Public Hearing on the proposed action; • Posting of such a notice on the property; • Mailing of the Notice to all public agencies, emergency response providers, utilities and owners of adjacent properties; • Conduct a public hearing on the matter; and • Adoption of a Resolution vacating the street. C. Lead Agent With regard to the subject street vacation, it is the view of staff that all of the above described engineering and administrative efforts be undertaken by the developer of the Birkenshaw property.
