AN ORDINANCE OF THE CITY COUNCIL OF THE CITY
OF MOORPARK, CALIFORNIA, AMENDING SECTION
3.08.010 AND SECTION 3.08.030 OF CHAPTER
3.08 OF TITLE 3 OF THE MOORPARK MUNICIPAL
CODE, ESTABLISHING INFORMAL BIDDING
PROCEDURES FOR CERTAIN PUBLIC PROJECTS
WHEREAS, per Resolution No. 86 -286, the City has elected
to become subject to the provisions of the uniform construction
accounting procedures to govern the selection of contractors to
perform public projects pursuant to Public Contract Code Section
22032; and
WHEREAS, Public Contract Code Section 22032 identifies the
procedures and dollar limitations that the City may follow to
enter into contracts for the construction of public projects;
and
WHEREAS, the bid limits specified in Section 22032 have
increased and the municipal code section(s) referenced need to
be amended;
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF MOORPARK
DOES ORDAIN AS FOLLOWS:
SECTION 1. That Sections 3.08.010 and 3.08.030, and no
other code sections of Chapter 3.08 of the Moorpark Municipal
Code, are hereby amended in their entirety to read as follows:
"Section 3.08.010 Applicability of provisions.
The provisions of this chapter shall apply to construction
on public projects of more than twenty five thousand dollars
($25,000.00) but not more than one hundred thousand dollars
($100,000.00). These dollar amounts shall be deemed to
automatically increase or decrease, without further amendment to
this chapter, as of the effective date of any amendments to
Public Contract Code Section 22030 et seq. or its successor
section."
"Section 3.08.030 Mailed notice of bids.
All contractors on the list for the category of work being
bid and /or all construction trade journals specified by the

commission pursuant to Public Contracts Section 22036 shall be
mailed a notice inviting informal bids unless the product or
service is proprietary. All mailings of notices to contractors
and construction trade journals pursuant to this section shall
be completed not less than ten (10) calendar days before bids
are due."
SECTION 2. If any section, subsection, sentence,
clause, phrase, part or portion of this Ordinance is for any
reason held to be invalid or unconstitutional by any court of
competent jurisdiction, such decision shall not affect the
validity of the remaining portions of this Ordinance. The City
Council declares that it would have adopted this Ordinance and
each section, subsection, sentence, clause, phrase, part or
portion thereof, irrespective of the fact that any one or more
section, subsections, sentences, clauses, phrases, parts or
portions be declared invalid or unconstitutional.
SECTION 3. This Ordinance shall become effective thirty
(30) days after its passage and adoption.
SECTION 4. The City Clerk shall certify to the passage
and adoption of this ordinance; shall enter the same in the book
of original ordinances of said City; shall make a minute of the
passage and adoption thereof in the records of the proceedings
of the City Council at which the same is passed and adopted; and
shall, within fifteen (15) days after the passage and adoption
thereof, cause the same to be published once in the Moorpark
Star, a newspaper of general circulation, as defined in Section
6008 of the Government Code, for the City of Moorpark, and which
is hereby designated for that purpose.
