SUBJECT: Consider Permit Adjustment No. 2004 -16 for Minor
Changes to Lot Configuration and Pad Elevation
Deviation within Vesting Tentative Tract No. 5130
(SunCal Properties).
BACKGROUND
On December 17, 2003, the City Council approved Vesting
Tentative Tract Map No. 5130, for the subdivision of 72 acres of
land into 110 residential lots, east of Walnut Canyon Road and
north of Wicks Road. A grading permit has not yet been issued
for this project. A copy of the approved subdivision map is
attached. The applicant is now seeking a Permit Adjustment for
minor changes to the approved Vesting Tentative Tract Map.
DISCUSSION
Two changes are proposed to the Vesting Tentative Tract Map to
address issues that have arisen in the refinement of the project
design: 1) the need for a water easement for Waterworks District
No. 1 to be included on the Final Map, and 2) the need for Lot
77 to be above the adjacent street level for proper drainage.
The proposed changes would qualify for Permit Adjustment
findings as they do not alter any of the findings for approval
of the project, do not require any change to the environmental
document prepared for the oroject, and would not have any
adverse effect on surrounding properties. The Community
Development Director is the decision maker on a Permit
Adjustment. However, since this project will return to Council
for consideration of a Final Map, direction is sought on this
Permit Adjustment application to ensure that these changes would

not affect "substantial conformance" findings conditioned by the
Vesting Tentative Tract Map.
The fifteen -foot (15') wide Waterworks District Easement, placed
between Lots 3 and 4 as shown on Attachment 2, involves minor
changes to lot configuration. The required easement results in
a need to move eleven (11) lots along the eastern edge of the
project in a southerly direction. Some of the wider lots would
become slightly narrower to accommodate the easement; however,
the typical lot widths would remain at 80 feet as previously
approved. All other lot lines will be left as approved.
In addition, there is a sinale lot (lot 77) within the tract
which is proposed to deviate from its approved elevation by more
than 5 feet (the maximum deviation allowed by condition without
a Permit Adjustment) . This lot, detailed in Attachment 3, is
proposed to be 6.8 feet higher than originally proposed. The
deviation is required to maintain proper drainage and to avoid
excessive use of retaining walls within the tract. The lot will
be approximately at street level, and less than two -feet (2')
lower than the adjacent lot to the north. Allowing this change
will enable the lot to fit in with the rest of the surrounding
tract. The changes to this tract will not alter the appearance
of character of the tract or the resulting neighborhood.
STAFF RECOMMENDATION
Direct staff to prepare a letter approving Permit Adjustment No.
2004 -16 as requested for Vesting Tentative Tract No. 5130.
