Applicant: North Park Village, LP (APN: 500 -0- 120 -065; 500 -0- 170 -135; 500 -0- 180 -125, -135, - 145, -155, -165, -175, -185, -195, -205, -215, -225, - 235, -245, -255; 500 -0 -281 -165, -175; 500 -0- 292 -135, - 145, -195, -215, -225; 615 -0- 110 -205, -215; 615- 0 -150- 185) BACKGROUND /DISCUSSION On October 20, 2004, the City Council took additional testimony on the North Park project and discussed project issues related to biology, water supply, water quality, groundwater, and oil wells. Topics originally scheduled for discussion on Oc�ober 20, 2004, included the mitigation monitoring program, Environmental Impact Report (EIR) findings, development agreement, and ballot issues. These issues were deferred to the November 17, 2004 Council meeting. A number of questions were raised by the City Council on October 20, 2004. Topics included second dwelling units, grading prior to the construction of freeway access, visual simulation locations, timing and cost of traffic improvements and use of eminent domain, lake management, effectiveness of water quality devices, valley fever, landfill plans, oil operations and Phase 2 mitigation, school improvements, observatory construction, and fire station plans. Staff is working on the responses to these 0013001 Honorable City Council November 17, 2004 Page 2 questions and should have information to present at the next meeting on this project. A draft Mitigation Monitoring Program and draft EIR Findings were provided to the City Council in May 2004 along with all Planning Commission materials on this project. The Mitigation Monitoring Program and draft EIR Findings were presented to the Planning Commission at their March 16, 2004 meeting, and modified by the Planning Commission as part of their recommendation to the City Council on April 6, 2004. Staff is also recommending a further modification as noted in Response No. 7 in the October 20, 2004 staff report. To address concerns raised by Mr. Randy Griffith, a public speaker at the September 15, 2004 City Council meeting, amendments to the draft mitigation monitoring program are recommended to ensure the Phase 2 assessment work program is reviewed by the City prior to initiation of the work and to ensure that soil gas sampling is specifically addressed in this program. Staff is not prepared at this time to present development agreement or ballot issue information to the City Council for discussion. In order to provide staff and the applicant sufficient time to answer the questions asked at the last Council meeting as well as the ballot issue and development agreement, it is suggested that the December meeting be suspended. It is recommended that these two discussion items and answers to the outstanding questions be deferred to the January 19, 2005 City Council meeting.
