SUBJECT: Consider Resolution Updating Solid Waste Collection Fees
DISCUSSION
This item, if approved, would make the annual adjustment to solid
waste collection fees as specified in the Franchise Agreements
between the City and the refuse haulers. There are two (2)
components used in considering an increase in rates: the Consumer
Price Index (CPI) and the Simi Valley Landfill tipping fees.
Per the City's Franchise Agreements, the amount of the CPI increase
is 860 of the CPI for all consumers in the Los Angeles Urbanized
Area during the period September- September, less housing. The
benchmark annual Consumer Price Index (CPI) for this purpose was
1.590. The landfill tipping fees also increased. On July 1, 2004,
the county increased the landfill surcharge it charges and previous
Council action deferred adjusting rates until this time, when the
Council traditionally considers annual rate adjustments. In July,
the county landfill surcharge went up $1.65 per ton for trash
disposal and yard trimmings, resulting in per ton charges of $41.45
and $30.65 per ton respectively. Additionally, effective January 1,
2005 the landfill rates will be raised again due to an increase in
actual landfill costs. The hauler disposal rate will go up an
additional $0.80 to $42.25, and the yard trimmings rate will be
$31.15.

With the CPI and landfill rate adjustments, the City's regular
residential solid waste rate will increase $0.63 per month, to
$22.49, representing a 2.9% increase. The CPI component created
$0.30 of the rate increase, the county landfill surcharge from last
July accounts for $0.22, and the landfill operating cost increase
accounts adds a final $0.11, totaling $0.63 per regular customer.
The senior citizen and super recycler rates will increase $0.43 per
month to $16.82 per month. Commercial rates will increase about
3.5% depending on the weight capacity that is factored into the
rate structure for the various commercial service levels. There are
no proposed changes in the AB 939 fees. The fee funds the City's
solid waste and recycling programs. The regular residential
customer pays $1.20 for AB 939 ($1.14 for seniors and super
recyclers), and commercial customers pay 8% for AB 939. The rate
adjustments are calculated in accordance with the Franchise
Agreements. The new rates would become effective January 1, 2005.
Attachment "A" is the rate resolution and proposed rate sheet.
Attachment "B" is a rate calculation worksheet showing the 2005
proposed solid waste collection rates in relation to the existing
rates.
STAFF RECOMMENDATION
Adopt Resolution No. 2004- , Rescinding Resolution No. 2003-
2146, approving new year 2005 Solid Waste Collection Fees effective
January 1, 2005.

RESOLUTION NO. 2004-
A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF MOORPARK, CALIFORNIA, UPDATING THE SOLID
WASTE COLLECTION SERVICE FEE SCHEDULE AND
RESCINDING RESOLUTION NO. 2003 -2146
WHEREAS, the City provides residential and commercial solid
waste and recycling collection services; and
WHEREAS, on September 18, 2002, the City Council granted
exclusive franchise agreements with G.I. Industries and Moorpark
Rubbish Disposal for the collection, transportation, recycling, and
disposal of solid waste in residential and commercial - industrial
areas within City limits; and
WHEREAS, the Franchise Agreements provide for adjustments to
the service fee schedule pursuant to a specified formula; and
WHEREAS, the City Council declares its intention of
maintaining reasonable rates for collection, management, and
disposal of solid waste and recyclables within the City limits.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF MOORPARK DOES
HEREBY RESOLVE AS FOLLOWS:
SECTION 1. Effective January 1, 2005, the monthly
residential solid waste, recycling, and green waste collection rate
shall be as shown in Attachment "1,"
SECTION 2. Effective January 1, 2005, the commercial,
industrial, and multi - family solid waste, recycling, and composting
bin collection rates shall be as shown in Attachment "1."
SECTION 3. Effective, January 1, 2005, the temporary bins
and roll - off /drop box rates for solid waste, recycling, and
composting bin services shall be as shown in Attachment "1."
SECTION 4. Effective January 1, 2005, the annual Solid
Waste Management Fee for exemption to the required solid waste
collection service shall be $24.40.
SECTION 5. The City's Residential Franchise Agreements
Service Fee Schedules (Exhibit "F" of Residential Franchise
Agreements) are hereby replaced with the attached Service Fee
Schedule upon the effective date of this resolution.

SECTION 6. The City's Commercial Franchise Agreements
Service Fee Schedules (Exhibit "F" of the Commercial Franchise
Agreements) are hereby replaced with the attached Service Fee
Schedule upon the effective date of this resolution.
SECTION 7. This resolution shall be effective January 1,
2005.
SECTION 8. This Resolution hereby rescinds Resolution
2003 -2146 in its entirety upon the effective date of this
resolution.
SECTION 9. The City Clerk shall certify to the adoption of
the resolution and shall cause a certified resolution to be filed
in the book of original Resolutions.
