SUBJECT: Consider Ventura County Local Agency Formation
Commission ( LAFCO) Composition and Vacancy
BACKGROUND
At the December 1, 2004 meeting, City Council discussed the Port
of Hueneme /Oxnard Harbor District boundaries, and directed staff
to bring back for the December 15, 2004 meeting, a report on the
composition of Ventura County LAFCO and upcoming vacancies on
the Commission.
DISCUSSION
Ventura County LAFCO is composed of seven voting members, with
four alternate members who vote only in the absence or
abstention of a voting member. The seven members and their
alternates represent all levels of local government. Two members
and one alternate member are members of the Ventura County Board
of Supervisors. Two members and one alternate member are members
of the city councils of the cities in Ventura County. Two
members and one alternate member are members of the boards of
the independent special districts in Ventura County. One member
and one alternate member are members of the public at large who
are not elected officials. Members are selected and appointed
pursuant to the provisions of the Cortese - Knox - Hertzberg Local
Government Reorganization Act of 2000 (California Government
Code 56000 et seq.).
The two city council members currently serving on the Commission
are Don Waunch from the City of Camarillo and Evaristo Barajas
from the City of Fillmore. The alternate councilmember is John

Zaragoza from the City of Oxnard. Councilmember Barajas' did
not run for re- election, and will be leaving the Fillmore City
Council, so his ability to serve on LAFCO ends. The City
Selection Committee, comprised of the Mayors from each of the
ten cities in the County, is scheduled to meet on December 20,
2004, to select a city council member to replace Mr. Barajas for
the remainder of his term, until January 1, 2006. Applications
are not processed for the city council position. The City
Selection Committee will choose a council member from one of the
ten city councils. The Council may want to direct staff to
prepare a letter for the Mayor's signature requesting that the
City Selection Committee appoint a member of the Moorpark City
Council as a city representative to LAFCO.
A special district voting member position is also currently up
for election by the Independent Special District Selection
Committee, and interviews for an alternate public member will be
conducted over the next week or so. That member will be
selected by the six other LAFCO members.

NOTICE IS HEREBY GIVEN that a special meeting of the City Selection Committee of
Ventura County will be held on Monday, December 20, 2004 at 7:30 a.m., in the Administrative
Conference Room, Camarillo City Hall, 601 Carmen Drive, Camarillo, California.
The purpose of this meeting is to elect a Chair and Vice -Chair for the City Selection
Committee.
Fu -they, the Committee will also consider the request of the Ventura Local Age-icy
Formation Commission to appoint one city- appointed regular Commissioner to a new tour year
term or appoint the current City Alternate Commissioner to anew four year term which wouiu
then create a need to appoint a city- appointed alternate Commissioner.
The Committee will also consider the request of the Community Commission for Ventura
County (CCVC) to appoint two (2) nominees for the City quadrant of the CCVC Board of
Commissioners for a three (3) year term of office, Commission member will need to attend 8 of
12 meetings scheduled per year.
The Committee will also consider the request of the Air Pollution Control District and the
Air Pollution Control Board to appoint one city member to the Air Pollution Control District
(APCD) Board to fill the positions to be vacated by Oxnard Mayor Manuel Lopez. Health and
Safety Code section 40100.5 (c) calls for approval by a majority of the cities, which contain a
majority of the population in the incorporated area of the district.
The Committee will also consider the request of the Ventura County Transportation
Commission (VCTC) to reappoint Brian Humphrey or appoint a new City Citizens
Representative to the Ventura County Transportation Commission (VCTC) per AB 2784.

NOTICE IS ALSO GIVEN that Government Code Section 50271 requires that when a
mayor is unable to attend a meeting of a city selection committee, he shall designate another
member of the city's legislative body to attend and vote at the meeting in his place as his
representative.
THIS NOTICE is given in accordance with the provisions of Government Code Section
50278, which requires two weeks notice in advance of said meeting.

SUBJECT: City Selection Committee — LAFCO Appointment
Please request the Chief Deputy Clerk of the Board to convene a meeting of the City Selection
Committee to select a new City Commissioner to LAFCO. Evaristo Barajas, one of the two
regular city members, did not run for re- election and will be leaving the Fillmore City Council on
or before December 14, 2004. His ability to serve on LAFCO ends when he leaves the city
council, but the LAFCO term he is filling does not end until January 1, 2006. Thus, it is
necessary for the City Selection Committee to make an appointment to fill the unexpired regular
member term ending January 1, 2006.
The City Selection Committee has basically two options for filling this upcoming vacancy:
1. Appoint the cummt Altercate City Commissioner, John Zaragoza, to fill the unexpired
term being vacated by Mr. Barajas that ends January 1, 2006. If this option is selected
the City Selection Committee will need to appoint a new Alternate City Commissioner to
fill the term of Mr. Zaragoza that ends January 1, 2008. In past years, the alternate
member has routinely been appointed to fill regular member vacancies, but there is
nothing in the law that requires this type of succession.
2. Appoint a new representative to fill the unexpired term being vacated by Mr. Barajas
ending January 1, 2006.
Attached for reference are:
• Government Code sections relating to the organization of the City Selection Committee.
• Government Code sections relating to LAFCO membership, selection and terms.
• A list of the current LAFCO Commissioners and alternates and their respective terms of
office.
• A table showing the city representatives on LAFCO since LAFCO was created in 1963.
Please notify me of the date, time and place of the City Selection Committee meeting. It would
be appreciated if the City Selection Committee could meet and make their appointment(s) so
that any new Commissioners can be sworn in prior to the January 19, 2005 LAFCO meeting.

50270. In any county in which two or more cities are incorporated there is hereby
created a city selection committee the purpose of which shall be to appoint city
representatives to boards, commissions, and agencies as required by law. The
membership of each such city selection committee shall consist of the mayor of each
city within the county.
50270.5. As used in this article, "clerk" means the clerk of a county or the legislative
body thereof. Where the office of county clerk is separate from the office of clerk of the
board of supervisors, "clerk" means the clerk of the board of supervisors.
50271. When the mayor is unable to attend a meeting of a city selection committee, he
shall designate another member of the city's legislative body to attend and vote at the
meeting in his place and as his representative.
50272. Representatives of a majority of the number of cities within a county entitled to
representation on the city selection committee shall constitute a quorum of the
committee; provided, however, that a majority vote of the representatives of the number
of cities within a county entitled to representation on the committee is necessary to
appoint representatives to boards, commissions, or agencies. Whenever a quorum is
not present at a meeting of any city selection committee, the meeting shall be
postponed or adjourned to a subsegi ent time and place, as determined by the
chairman.
50273. In order to provide for initial organization of a city selection committee pursuant
to this article, an organizational meeting of each committee shall be held within 60 days
after the effective date of this article. The clerk of each county shall act as temporary
chairman of the city selection committee. As temporary chairman of the city selection
committee, the clerk shall fix a time and place for the organizational meeting of the
committee and shall give notice of such date and time to the mayor of each city
incorporated within the county. Each selection committee shall meet on the date and at
the time designated by the clerk. After the organizational meeting, a selection
committee shall meet on such dates and at such times as it may determine or as are
required by law.
50274. (a) At the first organizational meeting of a city selection committee held
pursuant to Section 50273, it shall select from among its members a permanent
chairman and vice chairman, and such other officers as it deems necessary. The term
of office of the chairman and vice chairman shall be not less than one year nor more
than four years as determined in the rules and regulations adopted by a city selection
committee pursuant to Section 50275. At least 60 days prior to the expiration of the term
of office of the chairman and vice chairman, or as otherwise provided in the rules and
regulations adopted by a city selection committee pursuant to Section 50275, the city
selection committee shall meet and select a successor to the chairman and to the vice
chairman.

(b) The officers of the County of San Mateo's City Selection Committee may be the
same as San Mateo County's Council of Cities. Any person elected to serve as
chairman, vice chairman, or officer may serve his or her entire term of office on San
Mateo County's City Selection Committee, provided that the person continues to serve
on a city council. If a city selection committee officer is not a mayor, that person may
preside, but not vote on any matters before San Mateo County's City Selection
Committee unless authorized pursuant to Section 50271.
50275. In order to carry out the provisions and purposes of this article, a city selection
committee shall formulate and adopt rules and regulations to govern the conduct of their
meetings and the selection of city representatives. Such rules and regulations shall
include, but not be limited to, the term of office of the chairman and vice chairman of the
city selection committee, such term to be not less than one year nor more than four
years, the time and place of the committee's regular meetings, a procedure for
nominating and selecting city representatives, and the manner in which voting by the
city selection committee shall be conducted.
50276. The clerk of each county shall act as the permanent secretary and recording
officer of the city selection committee organized within such county. All meetings of a
city selection committee shall be conducted in the presence of the clerk of the county in
which the committee is organized or his deputy. All votes and action taken by a city
:,election committee shall be recorded in writing by the secretary of the committee. The
written record of any vote or action taken by the selection committee shall include the
name of each member voting and how he voted. Written records and minutes of a
selection committee's secretary are public records.
50277. A city selection committee shall conduct regular meetings at the times specified
by it in its rules and regulations, and shall also meet upon the call of its chairman. The
chairman of a selection committee may call a special meeting of the committee at any
time, and the chairman shall call a special meeting of the selection committee upon the
written request of 50 percent of the members of the city selection committee. When a
chairman is required to call a special meeting of a city selection committee pursuant to
this section, such a meeting shall be called and held within 60 days after receipt of such
written request. Within three weeks prior to the date fixed for a special meeting of the
committee, the chairman of the committee shall notify the committee secretary of the
date, time, and place of the special meeting.
50278. At least two weeks prior to the date of any meeting of a city selection
committee, the secretary of the committee shall give notice of the meeting to each
member of the committee. The secretary shall also give reasonable notice to each
member of a selection committee of the time, date, and place to which a meeting of the
committee is continued.
50279. Members of a city selection committee shall serve without compensation.

50279.2. Notwithstanding any other provision of this article, in any county in which
there is only one incorporated city, the legislative body of such city is hereby created
and shall serve as the city selection committee in the county for the purpose of
appointing city representatives to boards, commissions and agencies as required by
law. A majority of the members of the legislative body of a city which is created as a city
selection committee pursuant to this section shall constitute a quorum of the committee.
In order for the city selection committee to make appointments, or in any other manner
conduct business of the committee, a quorum shall be required. The presiding officer of
the legislative body of a city which is created as a city selection committee pursuant to
this section, shall serve as chairman of the committee. The clerk of the legislative body
shall act as permanent secretary and recording officer of the city selection committee
and, as permanent secretary and recording officer, shall perform all the duties specified
in Section 50276.
50279.4. Notwithstanding any other provision of this article, in any county in which city
representatives are required to be appointed by a city selection committee to a regional
coastal zone conservation commission pursuant to Division 18 (commencing with
Section 27000) of the Public Resources Code, the city selection committee created in
such county pursuant to this article shall make such appointments. Each such city
selection committee shall hold an organizational meeting for such purposes prior to
December 31, 1972.

56325. There is hereby continued in existence in each county a local agency formation
commission. Except as otherwise provided in this chapter, the commission shall
consist of members selected as follows:
(a) Two appointed by the board of supervisors from their own membership. The
board of supervisors shall appoint a third supervisor who shall be an alternate
member of the commission. The alternate member may serve and vote in place of
any supervisor on the commission who is absent or who disqualifies himself or
herself from participating in a meeting of the commission. If the office of a regular
county member becomes vacant, the alternate member may serve and vote in place
of the former regular county member until the appointment and qualification of a
regular county member to fill the vacancy.
(b) Two selected by the cities in the county, each of whom shall be a mayor or
council member, appointed by the city selection committee. The city selection
committee shall also designate one alternate member who shall be appointed
and serve pursuant to Section 56335. The alternate shall also be a mayor or
council member. The city selection committee is encouraged to select
members to fairly represent the diversity of the cities in the county, with
respect to population and geography.
(c) Two presiding offcers or member; of legislative bodies of independent specie 1
districts selected by the independent special district selection committee pursuant to
Section 56332. The independent special district selection committee shall also
designate a presiding officer or member of the legislative body of an independent
special district as an alternative member who shall be appointed and serve pursuant
to Section 56332. The independent special district selection committee is
encouraged to make selections that fairly represent the diversity of the independent
special districts in the county, with respect to population and geography.
(d) One representing the general public appointed by the other members of the
commission. The other members of the commission may also designate one
alternate member who shall be appointed and serve pursuant to Section 56331.
Selection of the public member and alternate public member shall be subject to the
affirmative vote of at least one of the members selected by each of the other
appointing authorities.
56325.1. While serving on the commission, all commission members shall
exercise their independent judgment on behalf of the interests of residents,
property owners, and the public as a whole in furthering the purposes of this
division. Any member appointed on behalf of local governments shall represent
the interests of the public as a whole and not solely the interests of the
appointing authority. This section does not require the abstention of any member
on any matter, nor does it create a right of action in any person.
56334. The term of office of each member shall be four years and until the
appointment and qualification of his or her successor. Upon enlargement of the

commission by two members, as provided in Section 56332, the new members first
appointed to represent, independent special districts shall classify themselves by lot so
that the expiration date of the term of office of one new member coincides with the
existing member who holds the office represented by the original two -year term on the
commission and of the other new member coincides with the existing member who
holds the office represented by the original four -year term on the commission. The body
which originally appointed a member whose term has expired shall appoint'his or her
successor for a full term of four years. Any member may be removed at any time and
without cause by the body appointing that member. The expiration date of the term
of office of each member shall be the first Monday in May in the year in which the term
of the member expires, unless procedures adopted by the commission specify an
alternate date to apply uniformly to all members; provided, however, that the length of a
term of office shall not be extended more than once. Any vacancy in the membership
of the commission shall be filled for the unexpired term by appointment by the
body which originally appointed the member whose office has become vacant.
The chairperson of the commission shall be selected by the members of the
commission.
Commission members and alternates shall be rf imbursed for the actual amourt of their
reasonable and necessary expenses incurred in attending meetings and in performing
the duties of their office. The commission may authorize payment of a per diem to
commission members and alternates for each day while they are in attendance at
meetings of the commission.
56335. In each county containing two or more cities, regular and alternate city
members to the commission shall be appointed by the city selection committee
organized in the county pursuant to and in the manner provided in Article 11
(commencing with Section 50270) of Chapter 1 of Part 1 of Division 1. Regular
members of the commission shall be appointed by the city selection committee pursuant
to Sections 56325, 56326, and 56327. The city selection committee shall appoint
one alternate member to the commission in the same manner as it appoints a
regular member. If one of the regular city members is absent from a commission
meeting, or disqualifies himself or herself from participating in a meeting, the
alternate member may serve and vote in place of that regular city member for that
meeting. Except in the case of a member appointed pursuant to subdivision (d) of
Section 56326 or subdivision (b) of Section 56327, a city selection committee, may,
at the time it appoints a member or alternate, provide that the member or
alternate is disqualified from voting on proposals affecting the city which the
member or alternate represents. If the office of a regular city member becomes
vacant, the alternate member may serve and vote in place of the former regular
city member until the appointment and qualification of a regular city member to
fill the vacancy.
