On January 12, 2005, the City Council ratified this proclamation (Resolution 2005 - 2279). On January 19, 2005, the City Council continued the local emergency to finalize damage assessment and evaluate post -storm impacts. Government Code Section 8630 requires the City Council to review the need to continue the local emergency at least every 21 days (every regularly scheduled City Council meeting) until the City Council terminates the local emergency. The proclamation of a local emergency authorizes use of extraordinary police powers, provides limited immunity for emergency actions of public employees and governing bodies, authorizes issuance of orders and regulations to protect life and property, and activates pre - established local emergency provisions such as special purchasing and contracting. DISCUSSION On January 14, 2005, the City submitted an Initial Damage Estimate Report to the Federal Emergency Management Agency (FEMA) through the State Office of Emergency Services (OES). If the president declares a major disaster, FEMA will award grants to state and local governments and certain private nonprofit entities for disaster response and recovery. In anticipation of a presidential declaration, staff recommends that the City Council continue the local emergency while staff completes the Public Assistance Program application. STAFF RECOMMENDATION Continue the proclamation of a local emergency. 00(30SG
