Ordinance No. 310 was December 15, 2004, to provide for false alarm fees to by resolution. Police Service Rates The City adopted the police service rates for the purpose of recovering all City costs associated with the review and development of permit conditions associated with new development projects, traffic control, crowd control, inspection of special events, emergency responses and other specific police related services. The requirement to advertise and hold a public meeting prior to adopting or increasing development fees (Government Code 66061), is not applicable because these fees only apply to the recovery of costs related to government regulatory action or approvals. This fee will apply specifically to the review of a development plan by the Community Services Officer in the Police Department, the 04101OGG Honorable City Council February 2, 2005 Regular Meeting Page 2 development of temporary use permit conditions for special events (including such applications as film permits, carnivals, and craft fairs), staffing special events, and emergency cost recovery, when the emergency is caused by an illegal activity and can be collected through the District Attorney's Office. The City is proposing to increase the service rate to reflect the current Sheriff's base contract rate charged to the City. In addition, a 15% general government overhead and 15% indirect costs have been applied to the base rate to come up with the police service rates as shown in "Exhibit A" of the attached resolution. The base hourly rate is calculated by dividing the monthly billing rate by 150 hours (1,800 hours per year) since these positions are all 40 hour per week without relief. This means the City does not receive backup personnel when the assigned person takes time off for sick and vacation leave or training. All rates were calculated using the anticipated rates for FY 2004/05. These rates have not yet been approved by the County but are projected to be 13% above FY 2003/04. False Alarm Billing Rates The police respond to alarms related to buildings and structures on a routine basis and occasionally these occur as a result of human or equipment failure, and not from a crime in progress or illegal entry. Currently, after the third false alarm in any 365 day period, a $55 dollar fee is charged, increasing up to $550 per response as needed. Each time a false alarm occurs, a new twelve month period begins. Staff is recommending a 10% increase, from $55 to $61 after the third false alarm and an increase of the cap from $550 to $605 dollars per response. Staff Recommendation Adopt Resolution No. 2005- establishing approval of Police Service Fees and rescinding Resolution No. 98 -1491. Attachment: Resolution No. 2005- RESOLUTION NO. 2005- A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF MOORPARK, CALIFORNIA, ESTABLISHING APPROVAL OF POLICE SERVICE FEES AND RESCINDING RESOLUTION NO. 98 -1491 WHEREAS, it is appropriate for the City to establish fees for City police services which are not of benefit nor the responsibility of the public -at- large; and WHEREAS, the City contracts for police services with the County of Ventura; and WHEREAS, the City uses police personnel for development plan review, traffic control, crowd control, special event permit review, inspection, emergency responses and other police services from time -to -time; and WHEREAS, these services are for the benefit of or precipitated by the actions of private individuals or companies and the expense is not appropriately the responsibility of the public -at- large. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF MOORPARK DOES HEREBY RESOLVE AS FOLLOWS: SECTION 1. All police service fees and charges shall be reviewed annually as part of the budget process to ensure that they are current and are related to actual costs. SECTION 2. City Resolution 98 -1491 is hereby rescinded. SECTION 3. The City Council hereby approves the fee schedule attached as Exhibit "A" - Police Service Fees. SECTION 4. The City Clerk shall certify to the adoption of this resolution and shall cause a certified resolution to be filed in the book of original resolutions.
