Design and Specifications for New
Equipment at Virginia Colony Park and
the City's Purchasing Procedures
The City's FY 2004/05 budget includes $60,000 to replace
the existing playground equipment at Virginia Colony Park.
The Parks and Recreation Commission discussed and selected
the proposed design of the new equipment and is
recommending that the City approve the design and equipment
proposed by Miracle Recreation Equipment Company (see
Attachment Al- A4).
There are two playlots, one consisting of a play structure
and the other consisting of a swing set. The existing
equipment was installed when the park was constructed in
1993. A number of the components on the play structure have
rusted completely through and have had to be dismantled.
Replacement parts are no longer available. The design and
equipment proposed by Miracle is challenging, durable, and
attractive. The City has installed Miracle equipment in
several of its parks (Community Center Park, Campus Park,
Campus Canyon Park, and Peach Hill Park) and staff is
satisfied with the quality.

The State of California has a purchasing contract
(California Multiple Award Schedule - CMAS) with Miracle.
Contracts included on the CMAS have been competitively
bidded. The State allows local governments to procure items
on the CMAS and successful vendors must extend the price,
terms, and conditions to the participating local agency.
Public Contract Code Section 10298 authorized the
aforementioned process. To that end, staff proposes that
the Council waive the City's purchasing procedures and
authorize the purchase of the Miracle equipment from the
State's CMAS contract list.
The design plans for the Virginia Colony Park playground
include replacing the existing playground structure and
swing set, and the existing woodchip surface in the larger
of the two playlots. The recommended color scheme of the
proposed equipment is green, brown, and tan. The new
proposed playground surface is sand with poured -in -place
rubber material to provide the required ADA access. The
City has been phasing out the use of woodchips to provide
ADA access because they require a greater degree of
maintenance than does the combined use of sand and
rubberized surfacing material. Additionally, sand has a
play value, where the woodchips do not.
With the City Council's approval, staff will issue a
Request for Proposals for the installation of the new
playground equipment and play surface. At a future meeting,
the Council will be asked to award a contract to the lowest
qualified bidder.
The expenditure budget for the project is estimated to be
as follows:

Following the completion of the playground improvements,
staff plans to design a walkway connecting the two

playgrounds to the sidewalk along the perimeter of the park
(to facilitate ADA access to the two playlots. Any funds
remaining after the completion of the playlot improvements
will go towards engineering and design the walkway.
Additional funding and City Council action will be required
to complete the construction of the walkway improvements,
which will be included in the FY 2005/06 budget
recommendation.
STAFF RECOMbMNDATION
Approve the design and specifications for the replacement
playground equipment for Virginia Colony Park, waive the
City's purchasing procedures, and authorize purchase of
Miracle play equipment from the California Multiple Award
Schedule list.
