SUBJECT: Consider Ordinance of the City Council of the City of
Moorpark Adding Section 10.04.205 to the Moorpark
Municipal Code Pertaining to the Parking of Oversized
Vehicles
BACKGROUND
Moorpark Municipal Code Chapter 10.04 sets forth certain parking
restrictions and requirements for parking of vehicles in the
City of Moorpark. The Police Department staff is recommending
the addition of the above sections to provide better control of
the parking of oversized vehicles on certain streets.
DISCUSSION
The Police Department has responded to complaints of, and has
observed an increase of commercial vehicles parking on certain
streets within the City of Moorpark. The parking of these
oversized vehicles is in conflict with the police department's
efforts to ensure the safety of pedestrians and motorists because
the size of these vehicles restricts the view of pedestrians and
motorists from each other. In addition many of these oversized
commercial vehicles are not well- maintained and present
opportunities for damage to road surfaces in the location where
they are parked due to the weight of these vehicles and dripping
oil or other hazardous fluids onto the pavement.
In the case of Park Lane and Lassen Avenue the congregation of
these vehicles creates an attractive nuisance for students at the
adjacent Chaparral School and small children and spectators
involved at the Little League Field.

Additionally, with the soon to be opening of the City of Moorpark
Police Services Center at 610 Spring Road there is a need to
prohibit parking of these oversized vehicles on Flinn Avenue
between Spring Road and Minor Street. This prohibition is needed
so the entry and exit of emergency vehicles of the California
Highway Patrol /Ventura County Sheriff's Department and AMR
Emergency Ambulances that primarily will travel on Flinn Avenue is
not impeded.
The draft ordinance provides that the City Council designate by
resolution those streets to be restricted for oversized vehicle
parking.
STAFF RECOMMENDATION
1. Introduce Ordinance No. for first reading to add
Section 10.04.205 to the Moorpark Municipal Code.
2. Schedule second reading and adoption for March 16, 2005.

AN ORDINANCE OF THE CITY COUNCIL OF THE
CITY OF MOORPARK, CALIFORNIA, ADDING
SECTION 10.04.205 TO THE MOORPARK
MUNICIPAL CODE PERTAINING TO THE PARKING
OF OVERSIZED VEHICLES
THE CITY COUNCIL OF THE CITY OF MOORPARK DOES ORDAIN AS
FOLLOWS:
SECTION 1. THE CITY COUNCIL OF THE CITY OF MOORPARK DOES
HEREBY FIND AS FOLLOWS:
A. California Vehicle Code Section 22507 authorizes cities to
limit or prohibit the parking of vehicles by type within
the City; and
B. Oversized vehicles create public safety issues in that they
can impact passing vehicular traffic, impair visibility of
police, and create access problems for fire and medical
emergency vehicles. They can also create hazards for
pedestrians attempting to cross the street, and emerging
into traffic from behind such vehicles.
SECTION 2. The following section is added to the Moorpark
Municipal Code:
"Section 10.04.205 Parking of oversized vehicles, trailers and
fifth wheels.
(a) No person shall park or leave standing any oversized
vehicle, as further defined herein, upon any public street
or highway in the City designated by City Council
resolution as subject to the provisions of this section,
which designation shall become effective upon posting of
notice of such prohibition, as required by California
Vehicle Code section 22507 and sections supplementary or
amendatory thereto.
(b) For the purpose of this section the term "oversized
vehicle" shall mean any vehicle, as defined by Section 670
of the Vehicle Code, or combination of vehicles, which
exceeds nineteen (191) feet in length, seven (7) feet in
width, or eight (8) feet in height, exclusive of projecting
lights or devices allowed by Sections 35109, 35110, or
35112 of the Vehicle Code, as may be amended.

(c) The prohibitions contained in paragraph (a) shall not apply
to any commercial vehicles in a residential district making
pickups or deliveries of goods, wares, and merchandise from
or to any building or structure located on the restricted
streets or highways or for the purpose of delivering
materials to be used in the actual and bona fide repair,
alteration, remodeling, or construction of any building or
structure upon the restricted streets or highways for which
a building permit has previously been obtained.
SECTION 3. If any section, subsection, sentence, clause,
phrase or portion of this ordinance is for any reason held to be
invalid or unconstitutional by the decision of any court of
competent jurisdiction, such decision shall not affect the
validity of the remaining portions of this ordinance. The
Moorpark City Council hereby declares that it would have adopted
this ordinance and each section, subsection, sentence, clause,
phrase or portion thereof, irrespective of the fact that any one
or more section, subsection, sentence, clause, phrase or portion
may be declared invalid or unconstitutional.
SECTION 4. This Ordinance shall become effective thirty (30)
days after its passage and adoption.
SECTION 5. The City Clerk shall certify to the passage and
adoption of this ordinance; shall enter the same in the book of
original ordinances of said City; shall make a minute of the
passage and adoption thereof in the records of the proceedings of
the City Council at which the same is passed and adopted; and
shall, within fifteen (15) days after the passage and adoption
thereof, cause the same to be published once in the Moorpark Star
a newspaper of general circulation, as defined in Section 6008 of
the Government Code, for the City of Moorpark, and which is hereby
designated for that purpose.
