Consider Continuation of Local Emergency
On January 9, 2005, the Director of Emergency Services (City
Manager) proclaimed the existence of a local emergency due to the
"2005 Winter Storms" (Resolution 2005 - 2278). On January 12, 2005,
the City Council ratified this proclamation (Resolution 2005 - 2279).
The proclamation of a local emergency authorizes the use of
extraordinary police powers, provides limited immunity for
emergency actions of public employees and governing bodies,
authorizes issuance of orders and regulations to protect life and
property, and activates pre- established local emergency provisions
such as special purchasing and contracting. Government Code Section
8630 requires the City Council to review the need to continue the
local emergency at least every 21 days (every regularly scheduled
City Council meeting) until the City Council terminates the local
emergency.
On January 14, 2005, the City submitted an Initial Damage Estimate
Report to the State Office of Emergency Services (OES). On January
19, 2005, the City Council continued the local emergency to
finalize damage assessment and evaluate post -storm impacts. On
February 1, 2005, the City submitted a Preliminary List of Projects
to OES. On February 2 and 16, 2005, the City Council continued the
local emergency to complete the Public Assistance Program
application.
DISCUSSION
On February 22, 2005, staff will attend a Public Assistance Program
applicants' briefing. The City is seeking reimbursement for debris
removal, protective measures, and repair or replacement of damaged
facilities. In addition, staff is exploring other types of disaster
aid to mitigate losses. Staff recommends that the City Council
continue the proclamation of a local emergency during the analysis.
