BACKGROUND:
Government Code Section 65864 and City of Moorpark Municipal Code
Section 15.40 provide for Development Agreements between the City
and property owners in connection with proposed plans of
development for specific properties. Development Agreements are
designed to strengthen the planning process, to provide developers
some certainty in the development process and to assure development
in accordance with the terms and conditions of the agreement.
On December 16, 1998, the Moorpark City Council adopted Ordinance
No. 250 (effective January 15, 1999), approving a Development
Agreement between the City of Moorpark and A -B properties and a
Development Agreement between the City of Moorpark and Southern
California Edison Company. The agreements were approved in
connection with General Plan Amendment (GPA) NO. 97 -02 and Zone
Change (ZC) No. 97 -06, for a proposed thirty -four and one -half
(34.5) acre industrial development (A -B Properties) and
approximately nine (9) acres owned by Southern California Edison.
These properties are located approximately 1,300 feet west of
Gabbert Road, north of the Union Pacific Railroad right -of -way.
Both Development Agreements remain in full force and effect for

twenty (20) years from the operative date of the agreements (until
January 15, 2019).
Provisions of the agreements require an annual review and report to
the City Council on the status of completion of all aspects of the
agreements. The developers have submitted the necessary
application forms, related materials, and fees /deposits. The
Community Development Director has reviewed the submitted
information, including the project status and provides the
following report.
DISCUSSION:
Protect Status
Tentative Tract No. 5147, a seventeen (17) lot subdivision proposed
by A -B Properties, was conditionally approved by the City Council
on March 15, 2000, per Resolution No. 2000 -1714. The approved
tentative tract map includes offsite improvements for the north -
south connector to the future North Hills Parkway, and for the
southerly half and easterly extension of "C" Street to Gabbert
Road. The easterly extension of "C" Street would serve as interim
access to the project until a railroad underpass and linkage to Los
Angeles Avenue are constructed. Following completion of this
linkage to Los Angeles Avenue, the "C" Street connection to Gabbert
Road would be for emergency access only. Portions of these offsite
improvements are within the Southern California Edison property.
All other activities had been on hold pending resolution of funding
mechanisms for infrastructure requirements.
On June 7, 2004, the City Council approved the selection of a
consultant to prepare a preliminary design report for North Hills
Parkway from Los Angeles Avenue on the west to the extension of
Spring Road on the east. The preliminary report will address
crossing of the railroad at the A/B Properties /Southern California
Edison properties. With the approved and proposed projects along
the proposed alignment, there may likely be enough properties to
fund, through an assessment district or other financial mechanism,
the full construction of North Hills Parkway from Spring Road west
to Los Angeles Avenue.
On December 8, 2004, A -B Properties informed the City that they
intend to proceed with completion of grading, drainage, street and
utility plans for Tract 5147, along with recordation of the Final

Map, based on the likelihood that a financing mechanism for
infrastructure may now be be feasible.
No applications have been filed with the City for the Southern
California Edison Company property.
Developer Compliance with Terms of Their Respective Agreements
A -B Properties' and Southern California Edison Company's
development responsibilities are included in Section 6 of each
respective Development Agreement. Both Development Agreements are
similar. There are, however, exceptions for developer names and
revisions to Section 6.10 regarding the future 118 by -pass,
(subsequently recognized by the City Council as North Hills
Parkway, a future arterial) as it relates to each property. The
differences also include deletion of Section 6.17 on the Southern
California Edison agreement, which relate to A -B Properties
requirement to dedicate a conservation easement. Compliance with
the terms and conditions of the Development Agreement will occur at
various stages of the development process. Action by the developer,
and other clarifying information, has been noted.

Evaluation of Good Faith Compliance
Based on a review of the Development Agreement Annual Review

SUBJECT: Consider Approval of Selection of a Consultant to
Prepare a Preliminary Design Report for the North
Hills Parkway Improvement Project
n February o= this year the City Council directed staff to
proceed with the distribution of a Request for Proposals (RFP)
for the preparation of the subject report, the scc=e of which is
described in more detail herein. Proposals were received from
Pcyle Engineering and from Parson.

A. Project Need
Ci- -Twide traffic analysis of the buildout of the City in
accordance with the General Plan shows that North Hills
Par:-',.-ray is a vital circulation component of the overall
circulation system. At- buildout, our traffic analysis shows
that there will be approximately 38,000 average daily trips
(ADT) on North Hills Parkway from SR -118 Free,�:ay easterly to
Spring Road and +22,000 ADT from Spring Road easterly to Los
Angeles Avenue. The existing road netwcrk does not have
sufficient capacity to accommodate these trios.
E. Project Scone and Limits
The project limits to be addressed in the subject srudy extend
from the proposed future intersection of North Hills Parkway
and Los Angeles Avenue (to be located east of Butter Creek

Road) north and east to the proposed future intersection of
North Hills Parkway and the future northerly extension of
Spring Road northeast of the Suncal Project. The possible
future extension of North Hills Parkway east of Spring Road
will be addressed at a future date.
Key components of the - project include:
• the intersection of North Hills Parkway and Los Angeles
Avenue [State Route 118) ;
• t ^ie railroad grade separation (bridge or underpass);
• the turn or curve north of the railroad; and
• the bridge to be constructed over Walnut Canyon_ Road (State
Route 23).
• All comccnents of design shall meet Caltrans standards.
C. Scope of Nork
The purpose of the subject study 1s to compile the information
required to clearly describe and define the North Hills
Parkway Project. Some of the facts and information to be
determined by the study include:
• the vertical and horizontal alignment of the roadway;
• a conceptual design for a bridge to cross over Walnut
Canyon Road
• a roadway grading design and other ccmpcnents which conform
to Caltrans standards;
• design alternatives for the railroad grade separation
(bridge or underpass) near the west end of the project;
• design alternatives and options for the turn or curve north
of the railroad grade separation;
• gectec'n_nical analysis and grading requirements;
• intersection locations and designs;
• right -ef -way reeds (including the cost of the acquisition
of properties on the west side of Walnut Canyon Road under
the proposed Walnut Canyon bridge); and
• cost estimates for all of the above.
This general alignment was adopted as part of the 1992
Circulation. Element. The purpose of this study will be to
develop a fairly precise preliminary design in order to
determine a fairly accurate project scope and cost. This will

then enable ti.e City staff to proceed with project
implementation efforts which would include:
• development of a financing plan;
• preparation of the required enviren- mental document;
• preparation of the final design plans; and
• acquisition: c- the recaired rights -of -way.
D. Project Fund inc
Along the reach of North Hills Parkway from Spring Road, west
to Los Angeles Avenue, are the following approved or proposed
projects:
1. Suncal's approved 110 Single Family Homes.
2. Centex's proposed 120 Single Family Hcr;es (north of
Casey Rcad) .
3. Hitch Ranch`s proposed 600 Single Family and Multiple
Family ::cores (Specific Plan No. 1).
4. A/3 Properties approved Industrial Project (Tract 'No.
5147) .
5. Southern. Califc=ia Edison approved Industrial Land
Us e.
It is anticipated that development fees or assess -ments paid by
these developments will fund a large portion of the project
construction costs. S•-'^sequent to the ccmaletion of the study

overall project costs identified in the study.
E. Proposals
As mentioned above, Proposals were submitted by Boyle
Engineering and by Parsons. The proposals were reviewed and
evaluated by the Ccm unity Cevelopment Director, the Public
Works Director and -_he City Engineer. Both firms were deemed,
by all of the reviewers, to be extremely well qualified to
provide the required services.
The RFP did not dictate to the responding consulting firms the
scope of work, approach or level of effort deemed to be
necessary or appropriate to develop the needed study. The RFP

Accordingly, the two proposals were quite different in their
description of the recorurended approach and level of effort.
The Parsons proposal vjas more detailed and described a final
work product which would be more specific and able to be :-ore
accurate in defining and "costing" the proposed project. _z
should be noted that when the levels of effort (content) of
each proposal was adjusted to be more comparable, the fees
quoted by each firm were also comparable. It was the unani -.cus
conclusion of the evaluation team that the Proposal sub,: i _zed
by Parsons best met the reeds of the City.
It should be pointed cut that the purpose of an RFP for
professional design services is to solicit Proposals for type,
kind and level of consultant services deemed to be necessary
to best meet the needs of the City. The City is not obligated
to select the low bidder. The objective of this t,.r--e of
selection process is to select the most qualified consu -zan�
offering that scope of services which will best address the
requirements of the City.

A -B Properties' principals have elected to proceed to record the Final Industrial Tract
111,11) for the above - referenced project. The reasons for moving forward at this time include: the
City's decision to proceed with alignment, engineering design and a fiuiancin", plan for the North
Hills Parkway; the ever- lncreaslnv demand for industrial parcels (of which there are none left in
IN1oolpark); and, the need to record the tentative map prior to its expiration.
We are notityin- the most affected City departments of A -B's decision to proceed so that
department heads can plan for: the ill 0LIX of plan -check work, payment of "prior to recordation"
fees and conditions compliance activity.
Peak Surveys, Rick Widmer and staff, has been selected by A -B principals to complete
the improvement plans and complete the engineering /survey requirements to record the Final
Map.

STATUS OF DEVELOPMENT AGREEMENT (GPA 97 -2)
Over the past twelve months, there has been no substantial change occur in the status of
GPA 97 -2, the Southern California Edison parcel west of Gabbert Road and north of the Union
Pacific Railroad tracks. The intent is for this site to develop in conjunction with the development
of the A -B Properties tract map located adjacent to the north of the SCE parcel. A combination
of market conditions, design issues and physical site constraints have precluded development
to date.
It is the intent of SCE to fully cooperate in the improvement and development of this site in the
near future. SCE requests that the Development Agreement remain in effect with the same
terms and conditions upon payment of the annual review fees and action by the City of
Moorpark
