SUBJECT: Consider the Establishment of an Ad -Hoc Committee to
Develop a Draft Development Agreement between Toll
Brothers, Inc. and the City of Moorpark for General
Plan Amendment No. 2003 -04, Zone Change No. 2003 -03,
Tentative Tract Map Nos. 5463 and 5464, Residential
Planned Development Permit No. 2003 -04 and
Modification No. 6 to Residential Planned Development
Permit No. 1994 -01
BACKGROUND /DISCUSSION
Toll Brothers, Inc. has submitted applications to allow:
1. Development of thirty -six (36) single- family homes on 28.69
acres north of Championship Drive and west of Walnut Canyon
Road; and
2. Development of fifty -one (51) single- family homes on 43.04
acres north of Championship Drive and east of Grimes Canyon
Road.
The proposed projects are expansions of the Toll Brothers, Inc.
Country Club Estates and include applications for General Plan
Amendment No. 2003 -04, Zone Change No. 2003 -03, Tentative Tract
Map Nos. 5463 and 5464, Residential Planned Development Permit
No. 2003 -04 and Modification No. 6 to Residential Planned
Development Permit No. 1994 -01. A Development Agreement is also
proposed.

Government Code Section 65864 and City of Moorpark Municipal
Code Section 15.40 provide for Development Agreements between
the City and property owners in connection with proposed plans
of development for specific properties. Development Agreements
are designed to strengthen the planning process, to provide
developers some certainty in the development process and to
assure development in accordance with the terms and conditions
of the agreement.
As with past projects involving changes in land use and hillside
grading, it is recommended that an Ad -Hoc Committee be appointed
to negotiate a Development Agreement for the proposed project.
STAFF RECOMMENDATION
Appoint two (2) Councilmembers to an Ad -Hoc Committee.
