TO: Honorable City Council FROM: Barry Hogan, Community Development Directo Prepared by Adam Burks, Assistant Engine Reviewed by Earl Schwartz, Assistant Ci Engineer "-f DATE: November 7, 2005 (City Council Meeting of December 7, 2005) SUBJECT: Consider Surety Bond Exoneration for Calabasas BCD Incorporated (Tract 3492, Lots 15 & 16) BACKGROUND This project was a commercial development located on the southeast corner of East Los Angeles Avenue and Condor Drive. A vicinity map has been attached for reference per Exhibit `A'. DISCUSSION The developer requests the exoneration of the Surety Bond on file with the City of Moorpark, associated with the aforementioned development (see attached chart). This Surety Bond guarantees the Grading on the premises known as Calabasas BCD, Inc. (Tract 3492, Lots 15 & 16). Although Improvement Plans were approved and Surety Bonds were procured, the site was never graded to plan nor were there any improvements constructed. Therefore areas of uncontrolled fill exist on the site and future development will be required to remove and recompact uncontrolled fill prior to any improvements. The site has been restored to acceptable conditions for site drainage only, and a note has been added to the as -built plans as such. Staff recommends that the bond be exonerated. 0002P16 Honorable City Council November 7, 2005 Page 2 Provided below is a chart describing recommended actions: STAFF RECOMMENDATION Authorize the City Clerk to fully exonerate the above referenced surety bond for Calabasas BCD, Inc.
