HomeMy WebLinkAboutAGENDA REPORT 2005 0420 CC REG ITEM 10DITEM 10 • _D - !J 4 L , G�.....� MOORPARK CITY COUNCIL AGENDA REPORT TO: The Honorable City Council FROM: John Brand, Senior Management Analyst NV Shaun Kroes, Community Services Technician (!� DATE: April 8, 2005 (CC meeting of April 20, 2005) SUBJECT: Consider Resolution Authorizing Submittal of a Three Year (2005 -2008) Used Oil Recycling Block Grant Application to the California Integrated Waste Management Board SUMMARY The City Council is being asked to consider a resolution approving the submittal of the City's annual application for a Used Oil Block Grant to the state of California Integrated Waste Management Board. DISCUSSION The City began receiving Used Oil Recycling Block Grants when the program began in 1993. The grants are administered by the California Integrated Waste Management Board (CIWMB). The main purpose of this grant program is to provide funding to local governments to establish used motor oil collection programs that encourage recycling of used motor oil. Recently the state allowed Used Oil Block Grant funds to be spent on certain federally- mandated National Pollutant Elimination System (NPDES) activities connected to illegal disposal of motor oil. The main ways used motor oil is recycled are through Certified Used Oil Collection Centers and the monthly Household Hazardous Waste (HHW) collection events. Moorpark residents can attend HHW events three times per month: on the second Friday; on the Saturday following the second Friday; and on the third Saturday of the month. The exception is December when HHW drop offs occur only on the second Friday and the Saturday after it. A local business can also become a state - certified used oil collection center by applying to the CIWMB. The certified centers must accept, at no charge, a maximum of fifty -five (55) gallons of used lubricating oil from a Used Oil Block Grant 2005- 2008.doc CC Meeting of April 20, 2005 Page 2 person, per day. A certified center must offer a $0.04 per quart recycling incentive to walk -in clients. As of April 2005, two Moorpark businesses: AutoZone, 455 W. Los Angeles Avenue; and Jiffy Lube, 797 W. Los Angeles Avenue; have become certified collection centers. It is staff's objective to work with these two new collection centers to continue their operation. Staff also intends to establish another local used motor oil collection center this year. Grant funds may be used to purchase equipment for a certified center such as holding tanks and tools to test for contamination. The funding is distributed on a per capita basis. Moorpark is entitled to receive approximately $9,000 in the upcoming cycle, and the money is available on a reimbursement basis for three years. The grant administrators at the CIWMB have the authority to determine if grant funds can be used for a particular activity. Approved uses include purchasing equipment, contaminated oil disposal, overhead costs, staff time, public information, promotional items, and NPDES activity related to preventing disposal of used motor oil into the environment. Historically the City has used the grant funds for a balanced mix of all the approved expense categories. The grant application must contain an approved resolution from each City's governing body authorizing submittal of the application and identify the individual authorized to executive any agreements, contracts, and requests for payments. STAFF RECON4ENDATION Adopt Resolution No. 2005- Used Oil Block Grant 2005- 2008.doc 000iVw RESOLUTION NO. 2005- A RESOLUTION OF THE CITY OF MOORPARK, CALIFORNIA, AUTHORIZING SUBMITTAL OF A USED OIL BLOCK GRANT APPLICATION TO THE CALIFORNIA INTEGRATED WASTE MANAGEMENT BOARD, AND AUTHORIZING THE CITY MANAGER TO EXECUTE ANY AGREEMENTS, CONTRACTS, AND REQUESTS FOR PAYMENT WHEREAS, the City of Moorpark recognizes that it is in the public interest to enact and implement an integrated waste management plan to address the state's diminishing landfill space and the potential adverse environmental impacts from inappropriate disposal of waste materials including used oil; and WHEREAS, the people of the State of California have enacted the California Oil Recycling Enhancement Act and related legislation that provides funds to cities and counties for establishing and maintaining local used oil collection programs that encourage recycling or appropriate disposal of used oil; and WHEREAS, the people of the State of California have enacted §47000 et seq. of the California Public Resources Code that provides grants to local governments to establish and implement waste diversion and separation programs to prevent disposal of hazardous waste, including household hazardous waste, in solid waste landfills; and WHEREAS, the California Integrated Waste Management Board has been delegated the responsibility for the administration of these programs within the state, setting up necessary procedures governing application by cities and counties under these programs. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF MOORPARK DOES HEREBY RESOLVE AS FOLLOWS: SECTION 1. The City Council of the City of Moorpark authorizes the submittal of grant applications to the California Integrated Waste Management board for all 0 0033 Resolution No. 2004 -2190 Page 2 available grants under the California Oil Recycling Enhancement Act and all available Household Hazardous Waste grants under the California Integrated Waste Management Act through June 30, 2008. SECTION 2. The City Manager; Parks, Recreation & Community Services Director; Community Services Senior Management Analyst; Community Services Technician; or a designee named by the City Manager, is hereby authorized and empowered to execute in the name of the City of Moorpark all necessary applications, contracts, payment requests, agreements and amendments hereto for the purposes of securing grant funds and to implement and carry out the purposes specified in the grant application. SECTION 3. adoption of the resolution to be ATTEST: The City Clerk shall certify to the resolution and shall cause a certified filed in the book of original Resolutions.
