Hogan, Community Development Direct Prepared By: Jared Rosengren, Contract Plann o r May 5, 2005 (CC Meeting of 5/18/2005) SUBJECT: Consider the Establishment of an Develop a Draft Development Warehouse Discount Center and the General Plan Amendment No. 2004 -0, Development Permit No. 2004 -03, Permit No. 2005 -04 BACKGROUND /DISCUSSION w , -, Ad -Hoc Committee to Agreement between City of Moorpark for 4, Commercial Planned and Conditional Use Poliquin Kellogg Design Group has submitted applications on behalf of Warehouse Discount Center to allow the development of two commercial buildings on 8.5 acres located on the north side of New Los Angeles Avenue /White Sage Road, immediately east of the SR 23 Freeway. Warehouse Discount Center and a retail furniture store would occupy the two proposed commercial buildings. The project includes applications for a General Plan Amendment to provide for a new use category (and policy) for the proposed retail /distribution use, a Commercial Planned Development Permit for two (2) commercial buildings, and a Conditional Use Permit for architectural features on the building that exceed thirty -five feet (35') in height. The City Council authorized the negotiation of a new Development Agreement for this project at the September 15, 2004 meeting. Government Code Section 65864 and City of Moorpark Municipal Code Chapter 15.40 provide for Development Agreements between the City and property owners in connection with proposed plans of development for specific properties.
