HomeMy WebLinkAboutAGENDA REPORT 2005 0601 CC REG ITEM 10GTO: FROM: PREPARED BY: MOORPARK CITY COUNCIL AGENDA REPORT The Honorable City Council ITEM I o - G CITY OF MOORPARK, CALIFORNIA City Council Meeting of ACTION: Mary Lindley, Parks, Recreation & Community Services Director Bob Stallings, Recreation Manager DATE: May 18, 2005 (CC Meeting of June 1, 2005) SUBJECT: Consider Entering Into a Contractual Agreement with the Moorpark Packers of the Gold Coast Football League DISCUSSION In 2002 the City of Moorpark and the Moorpark Boys and Girls Club (Club) entered into the second of two five year facility use agreements. Similar to the first, the second agreement served as a link between the City of Moorpark and Moorpark Packers under the auspices of sponsorship through the Club. The purpose of the agreement was to define the use of Arroyo Vista Community Park (AVCP) by the Moorpark Packers football program. More specifically, it outlined the term, facility use fees, use authorization, maintenance and improvements, liability insurance, and other provisions deemed salient to the Moorpark Packers use of AVCP. This agreement was terminated recently when the Moorpark Packers severed their ties with the Boys and Girls Club. It was the intent of the Moorpark Packers to become an independent entity and discontinue all previous affiliations. However, their desire to continue to use game and practice facilities, including storage and concession areas located at AVCP necessitate the need for a formal agreement between the City and the Moorpark Packers. It is staff's objective to develop an agreement that will address all the activities of the Moorpark Football program as they pertain to the use of City property. Honorable city Council June 1, 2005 2 As an overview, since the late 1980's the Moorpark Packers have provided a football program for boys between eight and fourteen years of age. Traditionally their program consists of player registrations that begin in early spring and weigh -ins which will take place in late July. Practice begins in August and their season starts in late August and extends through the second week of December. Practices are held Monday through Friday from 5:00pm to dusk, or as lighting permits. Each Saturday league games are played from 9:00am to 6:00pm. Approximately 175 to 200 players participate in the program which represents 7 -8 teams of varying weight and age classifications. Recently the Moorpark Packers decided to take their program in a new direction when they ended their longtime association with the Pacific Youth Football League. The decision was made when the PYFL instituted a rule change which modified the weight classifications. The Board of Directors for the Packers felt this new rule change would pose a safety risk to a number of players in the program. The rule change would also effectively force a considerable percentage of returning players out of the Moorpark Packer program. Therefore, they felt compelled to drop their affiliation with PYFL and join the Gold Coast Football League. The idea behind the move was to join a league which maintains the same weight classifications previously held by the PYFL. The scope of the new agreement (Attachment A) is similar in many ways to the previous agreement with the Boys and Girls Club of Moorpark. The most significant difference in the proposed agreement is it holds Moorpark Packers Football directly responsible for the contents of the agreement and eliminates third party negotiations or involvement (Boys and Girls Club). Prior to entering into a formal agreement with any of our youth sports groups, the City requires each respective group to provide the staff with evidence of non - profit status and bylaws under which the organization will operate. This is to notify Council that the Moorpark Packers have already complied with this requirement and have supplied staff with proof of non - profit status & incorporation, and submitted copies of their bylaws. Changes in the terms, covenants and conditions that vary significantly from the previous agreement are summarized below. Honorable city Council June 1, 2005 3 • By March 1, 2006 the Moorpark Packers are to modify the existing semi - permanent lights and light system so the wiring from pole to pole will be reconfigured and all visible wires will be relocated underground. All work shall be done by a licensed electrical contractor in accordance with building and electrical codes at the sole expense of the Moorpark Packers. This requirement has been carried over from the previous agreement. The purpose of this section is to solidify the new date and notify Council as such. The completion date for reconfiguring the lighting system wiring has been extended by mutual agreement. • At no time shall the Moorpark Packers authorize the use or schedule games for AVCP facilities where both participating teams are from out of town (non- Moorpark teams). Staff has had several discussions with the leadership of the Moorpark Packers regarding the proposed agreement. In those discussions the Packers indicated they were comfortable with the proposed agreement and are eager to move forward. STAFF RECO14ONDATION Approve the proposed use agreement with Moorpark Packer Football pending final language approval by the City Attorney and City Manager, and authorize the Mayor to sign the Agreement on behalf of the City.
