Gilbert, Public Works Director DATE: July 1, 2005 (Council Meeting 7- 20 -05) SUBJECT: Consider Approval of an Increase to the Los Angeles Avenue Area of Contribution (L A Ave. AOC) Fee DISCUSSION A. Background On June 15, 2005, the City Council set July 20, 2005, as the date of a public hearing to consider increasing the fees for the Los Angeles Avenue Area of Contribution (L A Ave. AOC) fee. Notice of the public hearing was posted and published in accordance with the requirements of the Government Code. B. History Prior to the incorporation of the City, the County of Ventura created the subject Area of Contribution in order to provide a mechanism for future development within a certain specified geographical area, to finance improvements to the Los Angeles Avenue / New Los Angeles Avenue corridor. C. Last Adjustment The subject fee was last adjusted in adoption of Resolution No. 2001 -1849, attached as Exhibit 1. A. Avenue AOC Update July 20, 2005 Page 2 D. Inflation There has been a marked increase in the cost of construction in recent years. It is the view of staff that it is necessary to adjust the subject fee in order to allow for the collection of sufficient funds to provide for the construction of the infrastructure improvements to be funded by this source. It should also be noted that land costs have gone up significantly in the past few years, increasing right -of -way acquisition costs. E. Analvsis of Revenue Reauirements As was done with the 2001 adjustment, the proposed adjustment is not an increase based solely upon the increase to the ENR (Engineering News Record) State Highway Bid Price Index. Like the 2001 adjustment, the fee increase recommended herein is based upon a summary analysis of the funds requ�xed to construct the list of identified projects to be funded-by the L A Ave. AOC. To that end, staff has performed an analysis of the funds currently available in the L A Ave. AOC Fund (Fund 2501) and the estimated costs of implementing a list of known future street improvement projects to be funded by the L A Ave. AOC Fund. The purpose of that analysis was to determine the total additional L A Ave. AOC fee revenues required to fully fund the construction of all of the projects on the list. Staff has also developed a list of future land development projects located within the L A Ave. AOC boundary, along with the identification of the number of residential units and commercial / industrial acres proposed to be developed by each of those projects. The purpose of that effort was to determine the total number of future units (dwelling units or acres) subject to payment of L A Ave. AOC fees. Finally, staff has prepared a calculation of the per unit (dwelling unit or acre) L A Ave. AOC fees required to be paid by each of the remaining land development projects within the boundaries of the L A Ave. AOC. 000111 L A AOC-0506b L. G. Future Project Costs Attached as Exhibit 2, is a chart listing all of the future street improvement projects to be funded by the L A Ave. AOC Fund, along with the estimated cost of each project. The total project cost estimates include costs for design engineering, right -of -way acquisition, construction, and construction engineering. That list indicates the total cost of implementing all of the projects identified, is $22,551,119. H. Estimated Future Land Development Projects (Exhibit 3) Attached as Exhibit 3, is a chart listing all of the future land development projects within the boundaries of the L A Ave. AOC, along with an estimate of the number of units (dwelling units / acres) proposed by each of those land development projects. Avenue AOC Update July 20, 2005 Page 4 The fees established by the L A Ave. AOC provided for -a conversion factor of 5.6 dwelling units per acre to compute the per acre fee for commercial / industrial properties. Based on the total number of units set forth in Exhibit 3, the resultant total number of EDU (equivalent dwelling units) required for the calculation of revised fees is as follows: Description Number Total Acres Commercial / Industrial 169.5 Multiplied by the Conversion Factor x 5.6 Number of EDUs for Comm. / Ind. A. Avenue AOC Update July 20, 2005 Page 5 M. Public Hearin As stated above, a Public Hearing on this matter was set for July 20, 2005. Notice of that hearing has been posted and published as required by law. Also, a copy of information pertaining to this proposed fee increase, the attached Resolution and the public hearing notice have been provided to the Building Industry Association (BIA). N. Resolution The attached Resolution (Exhibit 4), if adopted, will revise the L A Ave. AOC fees to be as indicated above. 0. Effective Date of Fee Increase Any approved fee increase will not become effective until sixty (60) days after the date the action was taken to increase the fee. STAFF RECOMMMATION (Roll Call Vote) Staff recommends that the City Council take the following actions: 1. Open the public hearing, receive public testimony, and close the public hearing. 2. Adopt the attached Resolution 2005- increasing the fees for the L A Ave. AOC. Attachments: Exhibit 1: Prior Fee Adjustment Resolution Exhibit 2: Summary of Anticipated Future Projects / Costs Exhibit 3: Summary of Future Land Development Projects Exhibit 4: Resolution L A AOC-0506b 000114 EXHIBIT 1 RESOLUTION NO. 2001 -1849 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF MOORPARK, CALIFORNIA, REVISING THE SCHEDULE OF FEES FOR THE LOS ANGELES AVENUE AREA OF CONTRIBUTION WHEREAS, the County of Ventura established certain areas of contribution in 1981 to provide a method of collecting fees from future development projects and to promote orderly growth, such fees to be used to finance specific street improvements; and WHEREAS, upon incorporation of the City of Moorpark, the County of Ventura transferred responsibility for the administration of these Areas of Contribution to the City; and WHEREAS, since the incorporation of the City, the City has periodically made adjustments to these fees and the improvements to be funded by said fees; and WHEREAS, said fees were last adjusted by the City by adoption of Resolution No. 90 -636, on March 21, 1990; and WHEREAS, the City Council received and considered a report, dated May 25, 2001, setting forth certain justification for.' the approval of an increase to the fees for the Los Angeles Avenue Area Of Contribution (AOC) And The Gabbert Road /Casey Road; and WHEREAS, Government Code Section 66000 et. seq. requires the City to hold a public hearing as part of a regularly scheduled meeting to consider written or oral presentations concerning any proposed increase in fees; and WHEREAS, the City Council held such a public hearing on June 6, 2001, and duly considered any input provided regarding said proposed fee increase; and WHEREAS, by City Council Resolution No. 2001 -1848, adopted on June 6, 2001, the City Council rescinded Resolution No. 90 -638, effective August 6, 2001; and WHEREAS, said Resolution No. 2001 -1848 re- established the Spring Road /Tierra Rejada Road AOC fees unchanged from those fees previously set forth in Resolution No. 90 -638; and WHEREAS, said Resolution No. 2001 -1848 also took action to revise the Gabbert Road /Casey Road AOC fees; and WHEREAS, on June 6, 2001, the City Council considered a report regarding certain changes to the basis upon which the Los Angeles Avenue AOC fees should be calculated; and 000115 Resolution No. 2001 -1849 Page 2 WHEREAS, said report set forth certain findings indicating the need and necessity to adjust the amount of the L. A. Avenue AOC fees. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF MOORPARK DOES HEREBY RESOLVE AS FOLLOWS: SECTION 1. That, pursuant to Government Code Section 66017, this resolution shall become effective sixty (60) days following the public meeting held on June 6, 2001, implementing those changes to the fees described herein, upon the effective date of August 6, 2001. SECTION 2. Seq. requires the City to hold a public hearing, as part of a regularly scheduled meeting, to consider written or oral presentation concerning any proposed increase in fees; and WHEREAS, pursuant to said Sections of the Government Code, on June 15, 2005, the City Council set the date of July 20, 2005, as the date of a public hearing to consider possible action to increase the amount of the L A AOC fees; and WHEREAS, the City Council received and considered a report on July 20, 2005, setting forth certain justifications for the approval of an increase to the fees for the L A AOC; and WHEREAS, on July 20, 2005, the City Council held a public hearing, as required by law, and duly considered any input provided regarding said proposed fee increase. OOOJL21 Resolution No. 2005 - Page 2 NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF MOORPARK DOES HEREBY RESOLVE AS FOLLOWS: SECTION 1. This Resolution shall become effective no sooner than sixty (60) days following the public hearing held on July 20, 2005, pursuant to Government Code Section 66017, (September 20, 2005) implementing those changes to the L A AOC fees described herein immediately upon the effective date set forth herein. SECTION 2. Resolution No. 2001 -1849 is hereby rescinded upon the effective date of this Resolution. SECTION 3.
