Gilbert, Public Works Director DATE: July 1, 2005 (Council Meeting 7- 20 -05) SUBJECT: Consider Resolution Rescinding Resolution No. 2001 -1848, Pertaining to the Spring Road /Tierra Rejada Road Area of Contribution (SP /TR AOC) and the Gabbert Road /Casey Road Area of Contribution (GB /CSY AOC) , and Approving an Increase to the SP /TR AOC Fees; and a Second Resolution Re- Adopting the Gabbert Road /Casey Road AOC Fees Unchanged DISCUSSION A. Background On June 15, 2005, the City Council set July 20, 2005, as the date of a public hearing to consider increasing the fees for the Spring Road / Tierra Rejada Road Area of Contribution (SP /TR AOC) Fee. Notice of the public hearing was posted and published in accordance with the requirements of the Government Code. B. History Prior to the incorporation of the City, the County of Ventura created the subject Area of Contribution in order to provide a mechanism for future development within a certain specified geographical areas, to finance transportation improvements to Spring Road and to Tierra Rejada Road. Last Adjustment The SP /TR AOC fees were last adjusted in March of 1990, by the adoption of Resolution No. 90 -638. Later, Resolution No. 90- 638 was rescinded and the subject AOC fee was reenacted unchanged by the adoption of Resolution No. 2001 -1848, a copy of which is attached as Exhibit 1. The current SP /TR AOC fees, as set forth in Resolution No. 2001 -1848, are as follows: • Residential (per dwelling unit) $ 3,553 • Commercial / Industrial (per acre) $19,892 D. Inflation There has been a marked increase in the cost of construction in recent years. It is the view of staff that it is necessary to adjust the subject fee in order to allow for the collection of sufficient funds to provide for the construction, of the infrastructure improvements to be funded by this source. E. Analysis of Revenue Requirements Consistent with past practices, the proposed fee adjustment is not an increase based solely upon the increase to the Caltrans Highway Construction Cost Index. The proposed fee increase is based upon a summary analysis of the funds required to construct the list of identified projects to be funded by the SP /TR AOC. To that end, staff has performed an analysis of the SP /TR AOC funds available and the estimated costs of implementing a list of known future street improvement projects to be funded by the SP /TR AOC Fund. The purpose of that analysis was to determine the total additional SP /TR AOC fee revenues required to fully fund the construction of all of the projects on the list. Staff has also identified land development projects located within the SP /TR AOC boundary, and calculated the number of residential units and /or commercial / industrial acres proposed to be developed by each of those projects. Revenue Requirements The chart attached as Exhibit 2 summarizes the status and future requirements of the SP /TR AOC Fund (Fund 2502), including: • Current funds available; • Expense projections; and • Revenue requirements. G. Notice of that hearing has been posted and published as required by law. Also, a copy of information pertaining to this proposed fee increase, the attached Resolution and the public hearing notice has been provided to the Building Industry Association (BIA). Resolution The attached Resolution (Exhibit 3), if adopted, will revise the Spring Road / Tierra Rejada Road AOC fees to be as noted in Section G above. K. Effective Date of Fee Increase Any approved fee increase will not become effective until sixty (60) days after the date the action was taken to increase the fee. L. Gabbert Road / Casey Road AOC Fee Resolution No. 2001 -1848 also revised and reenacted the fees for the Gabbert Road / Casey Road Area of Contribution (GB /CSY AOC) . In that said Resolution is proposed to be rescinded by the adoption of the attached Resolution (Exhibit 3) increasing the SP /TR AOC fee, a separate Resolution is attached (Exhibit 4) reenacting the GB /CSY AOC fee unchanged. This AOC fee requires additional analysis before considering a fee adjustment. STAFF REMMMATION (Roll Call Vote) 1. Open the public hearing, receive public testimony, and close the public hearing. 2. Adopt the attached Resolution 2005- (Exhibit 3) increasing the fees for the Spring Road / Tierra Rejada Road AOC. 3. Adopt the attached Resolution 2005- (Exhibit 4) reenacting the Gabbert Road / Casey Road AOC Fees unchanged. Attachments: Exhibit 1: Prior Fee Adjustment Resolution Exhibit 2: Fund / Fee Calculations Exhibit 3: Resolution: SP /TR AOC Exhibit 4: Resolution: GB /CSY AOC SP_TR AOC-0506 000126 EXHIBIT 1 RESOLUTION NO. 2001 -1848 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF MOORPARK, CALIFORNIA, RESCINDING RESOLUTION NO. 90- 638, REVISING THE SCHEDULE OF FEES FOR THE GABBERT ROAD /CASEY ROAD AREA OF CONTRIBUTION AND RE- ADOPTING THE SPRING ROAD /TIERRA REJADA ROAD AOC FEES WHEREAS, the County of Ventura established certain areas of contribution in 1981 to provide a method of collecting fees from future development projects and to promote orderly growth, such fees to be used to finance specific street improvements; and WHEREAS, upon incorporation of the City of Moorpark, the County of Ventura transferred responsibility for the administration of these Areas of Contribution to the City; and WHEREAS, since the incorporation of the City, the City has periodically made adjustments to these fees and the improvements to be funded by said fees; and WHEREAS, said fees were last adjusted by the City by adoption of Resolution No. 90 -638, on March 21, 1990; and WHEREAS, the City Council received and considered a report, dated May 25, 2001, setting forth certain justification for the approval of an increase to the fees for the GABBERT ROAD /CASEY ROAD AREA OF CONTRIBUTION; and WHEREAS, the City Council received and considered a report on the Spring Road /Tierra Rejada Road Area of Contribution Fees on May 16, 2001, and concurred that no change to those fees was necessary; and WHEREAS, Government Code Section 66000 et. seq. requires the City to hold a public hearing as part of a regularly scheduled meeting to consider written or oral presentations concerning any proposed increase in fees; and WHEREAS, the City Council held such a public hearing on June 6, 2001, and duly considered any input provided regarding said proposed fee increase; and WHEREAS, it is the intent of the City Council to revise and re -adopt the Los Angeles Avenue AOC fees by separate action subsequent to the public hearing on June 6, 2001, said fees being set forth in Resolution No. 90 -638 to be rescinded herein. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF MOORPARK DOES RESOLVE AS FOLLOWS: 00012'7 Resolution No. 2001 -1848 Page No. 2 SECTION 1. That pursuant to Government Code Section 66017, this Resolution shall become effective sixty (60) days following the public hearing held on June 6, 2001, implementing those changes to the fees described herein, upon the effective date of August 6, 2001. SECTION 2. That Resolution No. 90 -638 is hereby rescinded upon the effective date of this Resolution. SECTION 3. That the fees set forth in Resolution No. 90 -638 pertaining to the Spring Road /Tierra Rejada Road AOC, shall remain unchanged and are hereby reenacted upon the effective date of this Resolution, said fees being restated as follows: Per Per Commercial / _ Residential Unit Industrial Acre Fee Amount: $3,553 $19,892 SECTION 4. That it has been determined that there has been an increase to the Engineering News Record (ENR) Highway Bid Price Index, between the date the fees were last adjusted (Fourth Quarter 19891 and the fourth quarter of 2000, said increase 'being equal to 37.64 %. SECTION 5. That the City Council wishes to adjust the fees for the Gabbert Road /Casey Road AOC to reflect this increase to the cost of highway construction. SECTION 6. That the fees for the Gabbert Road /Casey Road AOC are hereby revised to be as follows: Per Per Commercial / Residential Unit Industrial Acre Fee Amount: $2,030 $6,428 SECTION 7. The City Clerk shall certify to the adoption of this resolution and shall cause a certified resolution to be filed in the book of original Resolutions. Seq. requires the City to hold a public hearing, as part of a regularly scheduled meeting, to consider written or oral presentation concerning any proposed increase in fees; and WHEREAS, pursuant to said Sections of the Government Code, on June 15, 2005, the City Council set the date of July 20, 2005, as the date of a public hearing to consider possible action to increase the amount of the SP /TR AOC fees; and WHEREAS, the City Council received and considered a report on July 20, 2005, setting forth certain justifications for the approval of an increase to the fees for the SP /TR AOC; and 000130 Resolution No. 2005 - Page 2 WHEREAS, on July 20, 2005, the City Council held a public hearing, as required by law, and duly considered any input provided regarding said proposed fee increase. WHEREAS, the aforesaid Resolution No. 2001 -1848 also revised and reenacted certain fees for the Gabbert Road /Casey Road Area of Contribution; and WHEREAS, in that said Resolution No. 2001 -1848 is to be rescinded by the adoption of this Resolution, it is the intent of the City Council to re -enact the Gabbert Road /Casey Road AOC Fees, unchanged, by adoption of a separate Resolution on the same date as the date of the adoption of this Resolution. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF MOORPARK DOES HEREBY RESOLVE AS FOLLOWS: SECTION 1. This Resolution shall become effective sixty (60) days following the public hearing held on July 20, 2005, pursuant to Government Code Section 66017, (September 20, 2005) implementing those changes to the SP /TR AOC fees described herein, immediately upon the effective set forth herein. SECTION 2. Resolution No. 2001 -1848 is hereby rescinded upon the effective date of this Resolution. SECTION 3. The fees set forth in Resolution No. 2001 -1848 pertaining to the SP /TR AOC, are hereby revised to be as follows: Per Residential Per Commercial 1 j Unit j Industrial Acre -Fee Amount_ L— __ -$7, 240 . 11 - ! NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF MOORPARK DOES HEREBY RESOLVE AS FOLLOWS: SECTION 1.
