Lindley, Parks, Recreation, and Community Services Director DATE: July 12, 2005 (CC Meeting of 7/20/05) SUBJECT: Consider Authorization of Recordation of the Notice of Completion and FY 2005/06 Budget Amendment for the Mountain Meadows Park Playground Improvement Project SUMMARY On June 1, 2005, the City Council awarded a contract to Premium Construction to perform playground improvements at Mountain Meadows Park. The total cost of the contract was $38,630. As of July 12, the project is substantially completed with one Change Order in the amount of $4,175, bringing the final construction contract cost to $42,805. The City Council recordation of the attached Resolution accommodate the one DISCUSSION is being asked to authorize the Notice of Completion and adopt the amending the FY 2005/06 budget to Change Order. The project consisted of the removal of the existing play equipment and the purchase and installation of new playground equipment. The completed improvements include traditional playground equipment - two separate play apparatuses, one designed for children 5 to 12 years of age, a smaller apparatus for children 2 to 5 years of age, and a new swing set that includes two bays of two individual swings each (total of 4 swings), of which two swings will accommodate toddler aged children. 111 :• Honorable City Council July 20, 2005 Page 2 Additionally, the improvements include a stand -alone play apparatus called Supernova. The Supernova is a large slanting ring that spins while children attempt to balance on it. It is most similar to a traditional merry -go- round. The Supernova is made by Kompan and sold by a company called Three Wishes. Also, the small circle playground to the east of the larger playground area now contains a new climbing apparatus called a "Space Ball ". The Space Ball is made by a German playground company and it adds a unique feature to Mountain Meadows Park not found in the City's other parks. All of the equipment included in the design meets the current California playground safety requirements. The play surface in the large lot contains a mixture of sand and "poured -in- place" rubber material. This meets the ADA accessibility requirements. The surface in the small round play lot with the Space Ball contains sand. Notice of Completion As stated above, construction of the Project has been substantially completed pursuant to the approved plans and specifications, less minor "punch" list items. There was one Change Order for 50 tons of additional playground sand for the amount of $4,175. At the completion of the construction work, the total cost of the construction contract awarded to Premium Construction was $42,805. With the Council's authorization to record the Notice of Completion, the Contractor will receive the balance of the payment due, 35 days after the recordation and fulfillment of all contractual obligations as determined by the City. Additionally, the City Clerk's Office will be authorized to release the project bonds in accordance with the contract provisions. Budget Amendment The Mountain Meadows Park Playground Improvement budget is currently $120,427. To cover the Change Order identified above, the Council is being asked to adopt a resolution amending the FY 2005/06 budget by appropriating an additional $4,175 from the Park Improvement Zone 3 Fund Balance, to the Mountain Meadows project budget. With the project now complete, final expenditures total $124,602 and are broken down as follows: M: \MLindley \PARKS \Mountain Meadows \MM Park Notice of Completion Budget Amendment ccagda 7- 20- 05.doc 000290 Honorable City Council July 20, 2005 Page 3 Exoenditure Cost Play equipment purchase $69,797 Play equipment install (includes CO #1) 42,805 Rubber ADA Surface 10,000 Project Coordinator 2,000 Estimated Total $124,602 STAFF RECOMMENDATION (Roll Call Vote) Authorize the City Clerk to file the Notice of Completion for the project, and authorize the release of the balance of payment, due upon satisfactory clearance, thirty -five (35) days after Notice of Completion records, release bonds in accordance with the contract, and completion of closeout contractual obligations on the part of contractor, and adopt the attached Resolution No. 2005- ,amending the project budget. Attachment A - Resolution 2005- M: \MLindley \PARKS \Mountain Meadows \MM Park Notice of Completion Budget Amendment ccagda 7- 20- 05.doc 0 0 0 2 9'L Honorable City Council July 20, 2005 Page 4 RESOLUTION NO. 2005- ATTACHMENT A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF MOORPARK, CALIFORNIA, AMENDING THE FY 2005/06 BUDGET TO ALLOCATE $4,175 FROM THE PARK IMPROVEMENT ZONE 3 FUND BALANCE (2113) TO THE MOUNTAIN MEADOWS PLAYGROUND IMPROVEMENT EXPENDITURE BUDGET WHEREAS, on June 15, 2005, the City Council adopted the budget for Fiscal Year 2005/06; and WHEREAS, a staff report has been presented to said Council requesting a budget amendment allocating $4,175 to the Mountain Meadows Playground Improvement expenditure budget from the Park Improvement Zone 3 Fund Balance; and WHEREAS, Exhibit "A" hereof describes said budget amendment and its resultant impacts to the budget line item(s) . NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF MOORPARK DOES HEREBY RESOLVE AS FOLLOWS: SECTION 1. A budget amendment allocating $4,175 to the Mountain Meadows Playground Improvement expenditure budget from the Park Improvement Zone 3 Fund Balance as more particularly described in Exhibit "A" attached hereto is hereby approved. SECTION 2. The City Clerk shall certify to the adoption of this resolution and shall cause a certified resolution to be filed in the book of original resolutions.
