WENNNOMMMOM CITY OF MOORPARK, CALIFORNIA City Council Meeting of 9- 7- o?DO,✓r ACTION : '4- Qoo_4.2AW�, 9--91-06 4"� BY: MOORPARK CITY COUNCIL AGENDA REPORT TO: The Honorable City Council FROM: Steven Kueny, City Manager DATE: August 18, 2005 (CC Meeting of 9/7/2005) SUBJECT: Consider Proposed Development Agreement Between North Park Village Limited Partnership and City of Moorpark Pertaining to General Plan Amendment No. 2001 -05, Specific Plan No. 2001 -01, and Zone Change No. 2001 -02 BACKGROUND /DISCUSSION On June 15, 2005, the City Council continued the closed public hearing on this item to September 7, 2005, and directed staff to add a new Section 6.43 to the proposed Development Agreement (copy attached) for the applicant to provide a $400,000 contribution dedicated to the construction of a future SR -118 wildlife under - crossing. This date was to coincide with the consideration of election resolutions for this project. On July 6, 2005, the City Council directed the election resolutions to be scheduled for consideration on September 21, 2005. In order for the Development Agreement to be considered concurrently with the election resolutions, the closed public hearing should be continued to the September 21, 2005 City Council meeting. STAFF RECOMMENDATION Continue closed public hearing to September 21, 2005. ATTACHMENT: Section 6.43 of the proposed Development Agreement 000002 6.43 Developer agrees to pay $400,000 to the City as a contribution to a regional funding and improvement program designed to enhance wildlife movement across the SR -118 corridor, west of Alamos Canyon. Wildlife movement enhancements may include improvements to existing crossings and /or the construction of new crossings. The payment shall be made to the City, upon determination by the City, in its sole discretion, that an SR -118 wildlife movement enhancement program has been established by Caltrans, a joint powers entity, or similar public agency empowered to fund or construct SR -118 corridor wildlife movement enhancements west of Alamos Canyon, but in no event prior to the issuance of the first market -rate residential building permit. If said contribution has not been paid by the developer at the issuance of the 1,400th market -rate residential building permit of the Project, developer shall provide a surety in a type and form as determined by the City in its sole discretion. The surety shall remain in place for ten (10) years or upon payment of the contribution, whichever first occurs. Commencing one year after the first market -rate residential building permit is issued, and annually thereafter, the contribution amount shall be increased to reflect the change in the Caltrans Highway Bid Price Index for Selected California Construction Items for the twelve (12) month period available on December 31 of the preceding year ( "annual indexing "). In the event there is a decrease in the referenced Index for any annual indexing, the current amount of the fee shall remain until such time as the next subsequent annual indexing which results in an increase.
