SUBJECT: Consider Proposed Development Agreement Between North
Park Village Limited Partnership and City of Moorpark
Pertaining to General Plan Amendment No. 2001 -05,
Specific Plan No. 2001 -01, and Zone Change No. 2001 -02
BACKGROUND /DISCUSSION
On September 7, 2005, the City Council continued this agenda
item with the public hearing closed to September 21, 2005, to
coincide with the consideration of election issues related to
the North Park project (Item 9A). The draft Development
Agreement has been revised to include Section 6.43 with terms
for the developer to contribute to SR -118 wildlife crossing
enhancements, as directed by City Council on June 15, 2005.
Clarifying language proposed by Councilmember Mikos on September
7, 2005, has been added and the developer concurs with the
changes to this section.
In addition, the annual indexing in Section 6.4 has been amended
to be consistent with latest staff practice for determining the
annual increase in highway construction costs. This revised
draft Development Agreement is included with the draft General
Plan Amendment, Specific Plan, and Zone Change as part of a
Moorpark voter ordinance, to be considered by Council for
placement on a ballot under Agenda Item 9A. The resolution
referenced in this staff report is to be considered as part of
Agenda Item 9A.

STAFF RECOMMENDATION
Adopt Resolution No. 2005- (in Agenda Item 9A) placing an
ordinance on the ballot that includes Development Agreement No.
2005 -01 with General Plan Amendment No. 2001 -05, Specific Plan
No. 2001 -01, and Zone Change No. 2001 -02 for consideration by
Moorpark voters.
